Brief (1)



SB 423 expands the requirement that a $150 Kansas Bureau of Investigation laboratory analysis fee be assessed against the defendant to cover all DUI cases involving a conviction or diversion. Current law limits the DUI fee assessment to those cases also involving drugs or controlled substances.





Background



The bill was supported by the Kansas Bureau of Investigation. A spokesperson estimated the fee would generate an added $94,000 annually for the forensic laboratory materials fee fund. The primary use of the fund has been to be used as a match for federal grant moneys.



The fiscal note estimates the bill will result in an added $100,000 being deposited in the fee fund which is in addition to the amount in the Governor's FY 2001 budget.
