SUPPLEMENTAL NOTE ON SENATE BILL NO. 404

Brief (1)



SB 404 would remove existing statutory authority which permits the use of studded traction equipment and studded tires on automobiles. The effect of the change would be to prohibit the use of studded tires and studded traction equipment.





Background



SB 404 was recommended by the Joint Committee on Administrative Rules and Regulations. Representative Melvin Neufeld and Senator Dwayne Umbarger, Chairman and Vice Chairman of that Committee, testified in support of the bill. The spokesperson of the Kansas Department of Transportation also testified in support of the bill noting that studded tires cause damage to roadways and bridges. It was also noted that Illinois, Indiana, and Minnesota have banned the use of studded tires.



"Studded traction equipment" is defined by KAR 36-7-2 as any device designed to be attached or placed on an automobile tire or small truck for the purpose of increasing traction in snow, ice, or other conditions tending to cause a vehicle to skid. This equipment is currently permitted after November 1 to April 1.



"Stud" is defined by KAR 36-7-1 as a pin-type device prepared for installation in the tread design of an automobile tire.



"Stud tire" is defined by KAR 36-7-1 as an automobile tire fitted with studs in the tread design in openings molded for that purpose by the tire manufacturer. Studded tires are permitted from November 1 to April 15.



The passage of SB 404 would have no fiscal impact.
