Brief ⁽¹⁾

Sub. for SB 265 would do the following:

• Raise the Kansas minimum wage from the current $2.65 per hour to $5.15 per hour.



• Delete the percentage reference regarding tips and gratuities.



• Enact a measure that would prohibit local units of government (a city or county) from enacting a law or ordinance that establishes a minimum wage. If the prohibition would prevent the availability of federal moneys for a city or county, the prohibition would be suspended to the extent necessary to prevent the denial of federal moneys.

Background

The conferees who testified in support of the original SB 265 include the primary sponsor, the conferees from the Kansas Association of Centers for Independent Living, the Kansas Catholic Conference, Kansans Respond, the Kansas AFL-CIO, and the Kansas Association of Community Action Programs. Opposition was expressed on behalf of the Kansas Chamber of Commerce and Industry, Kansas Chapter of the National Federation of Independent Business, and the Kansas Restaurant and Hospitality Association. Officials with the Department of Human Resources presented informational materials. The fiscal note on SB 265, as drafted, indicated no significant impact.

The provision regarding the prohibition on a local minimum wage was originally contained in SB 520.
