SUPPLEMENTAL NOTE ON SUBSTITUTE FOR

SENATE BILL NO. 115

Brief (1)



The bill would amend existing law to include in the definition of "ambulatory surgical center" any facility operated primarily for the purpose of performing procedures for the induced termination of human pregnancy, including any physician's office where such procedures are performed. The effect of the amendment would be to impose on those two types of facilities existing license requirements. Under current law, ambulatory surgical centers are licensed by the Department of Health and Environment.





Background



The substitute bill includes the provisions of HB 2078 as introduced. At the House Federal and State Affairs Committee hearing on that bill, two physicians presented testimony in support of the bill. A physician and representatives of Planned Parenthood, the American Association of University Women, and the Kansas Choice Alliance presented testimony in opposition to the bill at the House Committee hearing.



Regulations of the Department of Health and Environment regarding licensure of ambulatory surgical centers are at KAR 28-34-50 through 28-34-62a.

The Division of the Budget's fiscal note on the introduced version of the House bill states that the bill would have no fiscal effect.



SB 115, into which the provisions of HB 2078 were amended, as passed by the Senate, would have raised the statutory caps on certain fees charged by the Real Estate Commission. The bill was heard by the House Committee on Federal and State Affairs during the 1999 Session, but was not acted upon.
