SUPPLEMENTAL NOTE ON SENATE BILL NO. 79

Brief (1)



SB 79, as amended, concerns municipal funded pools. The bill allows any Kansas municipality to enter into agreements to pool their insurance liability risks with municipalities located in other states if the pool was formed on or before January 1, 1990. (Current law restricts interstate pooling of liability to municipalities in Douglas, Johnson, Leavenworth, Miami, and Wyandotte counties.)



The types of liabilities the municipalities would be authorized to pool include fire; marine, inland marine, and allied lines; casualty, surety, and fidelity lines, including workers' compensation and employers' liability; group sickness and accidents; and life insurance. (Current law restricts interstate pooling for sickness and accident related liabilities.)





Background



SB 79, as originally introduced, provided the Insurance Commissioner greater regulatory powers over municipal group-funded pools. The provisions of the bill were enacted in the 1999 Session in SB 60.



The House amendment deletes the provisions of SB 79 and inserts the provisions described above.
