SESSION OF 1999

SUPPLEMENTAL NOTE ON HOUSE BILL NO. 2446

As Amended by House Committee on

Business, Commerce, and Labor

Brief(1)

H.B. 2446 would amend current law regarding accounting firms. The bill would allow certified public accountant firms to use fictitious names, such as trade names, as the formal name of their corporation.

Background

A representative from KPMG Peat Marwick LLP testified in support of the bill. The representative testified that as long as the name is not false or misleading, this change would make some corporations more recognizable. The representative also testified that trade names are allowed in other states and this would reduce confusion in Kansas and in other states. A representative of the Kansas Society of Certified Public Accountants and the Board of Accountancy testified in support of the bill. There were no opponents to the bill.

The bill has no fiscal impact.
