H.B. 2236 concerns the transfer of the school records of children by school districts to other school districts or to nonpublic schools. The amendment provides that when a request is made for a school district to transfer a pupil's school records to another school district or a nonpublic school, the school district that has received the request will immediately prepare and send a certified copy of all requested school records to the school district or nonpublic school specified in the request.



The amendment also specifies that the school district may not require any prior return of property or payment or other compliance with law as a condition precedent to delivering the school records.





Background



H.B. 2236, as introduced, was recommended by the SRS Transition Oversight Committee. In its original version, the bill was specific to the Secretary of Social and Rehabilitation Services (SRS). It required the transfer of school records to other school districts or nonpublic schools when the Secretary of SRS made the request. The Committee amendments also delete a provision of current law which, under some circumstances, allows school districts to withhold a pupil's record until school property in possession of a pupil is returned or paid for.



Spokespersons for SRS and Kansas Advocacy and Protective Services, Inc. expressed support for the bill. The Kansas Association of School Boards also supported the measure but suggested that it not be limited only to pupils in the custody of SRS.
