H.B. 2230, as amended, would allow the Department of Social and Rehabilitation Services (SRS) to convey two parcels of land which are currently a part of the Osawatomie State Hospital property. One parcel of not more than 12.34 acres, would be conveyed to the Miami County Mental Health Center (MCMHC). The other parcel, of not more than one acre, would be conveyed to the city of Osawatomie. The Attorney General would have to approve the deed. As amended, the bill excludes the conveyance from the provisions of K.S.A. 75-3043a which requires that the property be appraised three times prior to transfer.
Background
H.B. 2230 was introduced by Representative Vickrey who appeared in support of the bill along with representatives from SRS and the MCMHC.
Osawatomie State Hospital currently leases out the land for pasture use. SRS testified that there are no future plans for hospital use of this land.
MCMHC plans to build a facility to house children and family programs. According to testimony from the MCMHC, its current location does not meet ADA requirements nor does it allow for expansion. The Center has received a $400,000 Small Cities Community Building Development Grant to develop the new facility.
The Division of the Budget fiscal note states that the fiscal impact of the transfer would be an annual reduction of $200 in rental revenues. According to the Division of the Budget, the Office of the Attorney General states that if a quit claim were required, there would be no cost to the state. However, if a warranty deed were required, one of the parties would have to purchase title insurance or hire a local abstractor to perform a title search so that the Attorney General could approve the transfer.
The Senate Ways and Means Committee amendment excludes the conveyance from the provisions of K.S.A. 75-3043a which requires that the property be appraised three times prior to transfer.
