H.B. 2203 provides that whenever more than a simple majority vote of the governing body of a city is required to take action under the city planning and zoning law, the number of votes required to act shall be based on the total number of council members-elect or commissioners-elect. Under a mayor-council form of government, if the number of favorable votes is one less than required, the mayor shall have the power to cast the deciding vote in favor of the proposed action.
Background
A representative from the Kansas League of Municipalities testified in support of the bill. He stated that the bill would clarify confusion among city officials concerning whether the mayor's vote should count towards the super majority votes required under certain sections of the planning and zoning laws for a city governing body to take action. A representative of the Kansas Building Industry testified in opposition to the bill.
The fiscal note indicates that passage of H.B. 2203 would have no fiscal impact.
