Brief(1)
Sub for H.B. 2182 authorizes the township board of any township to request, by the passage of a resolution, that the board of county commissioners acquire land in an amount of no more than three acres by purchase or eminent domain described in the resolution for the township. The board is required to hold a public hearing on the issue. Following the public hearing the board of county commissioners may adopt a resolution of its intent to acquire such land described or other land determined by the county to be more suitable. The county resolution must be published and is subject to a 5 percent protest petition of the township electors which, if filed, would require an election on the issue.
Once acquired, the land shall be conveyed by the county to the township. The township is authorized to construct, purchase, or lease buildings for township purposes and may issue general obligation bonds of the township subject to the approval of the electors to pay the costs of the acquisition of the land and buildings.
Background
The bill was supported by the trustee of Lecompton Township in Douglas County and by a representative of the Kansas Association of Counties.
The bill has no fiscal impact on the state.
