H.B. 2073 expands the power of cities and counties regarding storm water sewers to authorize the construction of a variety of storm water improvements including channels and retention basins within the three-mile ring of a city's boundaries if the board of county commissioners approve and to construct storm water improvements within another city if the governing body of the other city approves. The city making the improvements is authorized to issue general obligation bonds of the city to finance these costs.
The bill also gives the board of county commissioners the power to construct storm water improvements anywhere within the county including within the boundary of a city if the city governing body approves. Counties are also authorized to issue general obligation bonds for such improvements.
Background
The bill was supported by the League of Kansas Municipalities and the cities of Lenexa, Olathe, and Topeka. Bond counsel for the City of Lenexa said the bill provides a more comprehensive approach to storm water management, allowing a more regional approach to addressing these problems.
