SUPPLEMENTAL NOTE ON SENATE BILL NO. 361

Brief(1)



S.B. 361 amends the law to permit a school district board of education to contract with a state university or corporation controlled by a state university for provision of meals for students, alumni, and other members of the public who are attending the institution's functions or activities. The contracting party must pay the meal service costs to the school district. These payments will be deposited in the school district's food service fund.



The state institution would only be able to contract with a school district if fewer than two bids from private entities are received.





Background



Introduction of the bill was requested by a representative of Kansas State University. Ms. Elizabeth Matthews, Dietitian, Manhattan (USD 383), presented testimony in support of the bill at the Senate Committee hearing.



School districts currently are authorized by law to contract for provision of meals with nonpublic schools or child care institutions that provide meals for children in attendance and with the governing board of a municipality for provision of meals to persons for whom the municipality must provide meals.



The Senate Committee amended the bill to place conditions on the state educational institutions' authority to enter into food service contracts with school districts.



The fiscal note prepared by the Division of the Budget states that any fiscal impact of the bill would accrue to the school districts and state educational institutions that enter into the authorized contracts and that any fiscal impact was not included in the Governor's budget.
