SUPPLEMENTAL NOTE ON SENATE BILL NO. 252

Brief(1)



S.B. 252, as amended by the House Taxation Committee, would:



make the current tax lid (aggregate levy limitation) permanent; and



repeal a number of specific statutory fund levy limits imposed on local taxing subdivisions.





Background



The current tax lid is scheduled to sunset on July 1 pursuant to K.S.A. 79-5038.



The Senate Committee amended the bill to remove: (1) language which would have required moneys levied for a specific purpose be maintained in specific levy funds; and (2) a requirement that all individual fund levy limits not repealed by the bill be recomputed to allow for annual growth.



The House Committee amended the bill to make the current tax lid permanent. Another House Committee amendment removed language which suspended all other fund levy limits not repealed by the bill (such fund levy limits would continue to be suspended under the provisions of the aggregate tax lid law).
