SUPPLEMENTAL NOTE ON SENATE BILL NO. 220

Brief(1)



S.B. 220 amends the crime of criminal use of explosives to clarify that it covers pipe bombs and molotov cocktails. This crime is a level 8 person felony and under certain circumstances a level 6 person felony.



The crime of criminal use of weapons is amended to delete coverage of pipe bombs and molotov cocktails. This crime is a class A misdemeanor.



The House Committee of the Whole amendment is a technical change regarding the crime of hypnotic exhibition.





Background



The bill was supported by the Assistant Attorney General assigned to the Kansas State Fire Marshal's Office. The proponent said current law was unclear whether pipe bombs and molotov cocktails would be covered under the crime of criminal use of explosives.



The bill has no fiscal impact.
