SUPPLEMENTAL NOTE ON SENATE BILL NO. 93

Brief(1)



S.B. 93 amends the law dealing with venue of juvenile offender proceedings. The bill provides that when the sentencing hearing is to be held in a county other than the county where the offense was committed, upon adjudication, the judge shall contact the judge of the sentencing court and advise the court of the transfer. The court adjudicating the juvenile shall send forthwith to the sentencing court a facsimile of the complaint, the adjudication journal entry or judge's minutes, if available, and any recommendations in regard to sentencing. The documents shall be sent for purposes of notification and shall not constitute original court documents. The court adjudicating the juvenile shall also send to the sentencing court a complete copy of the official file in the case by mail within five working days of the adjudication.



The Senate Committee amended the bill to be effective upon publication in the Kansas Register.



The House Committee substituted the word immediately with the word forthwith regarding the time frame for the adjudicating court to send the necessary material to the sentencing court.





Background



The bill was supported by the Office of Judicial Administration, the Kansas State Department of Education, and the Juvenile Justice Authority. A judicial representative said that the bill was the product of the Court, Education, Juvenile Justice Authority, and Department of Social and Rehabilitation Services Liaison Committee. The purpose of the bill is to facilitate the handling of juvenile matters in multiple jurisdictions, to increase communications between courts, and to make the notification procedures in juvenile offender cases similar to those found in child-in-need-of-care cases.
