SUPPLEMENTAL NOTE ON SENATE BILL NO. 71

Brief(1)



S.B. 71 amends several of the statutes in the act under which dentists and dental hygienists are licensed and regulated. The major amendments make three policy changes which apply to both licensed dentists and licensed dental hygienists.



The law currently sets a penalty of $50 for renewal of a license that has been canceled automatically through the failure of the licensee to renew the license within one month of the renewal date and who has not renewed the license within two months of the date of the automatic cancellation. As amended, the penalty would be set by the Kansas Dental Board through rules and regulations in any amount up to a fee maximum of $500.



The second substantive change requires a licensee who establishes a practice location to notify the Board within 30 days of the new practice location.



Finally, S.B. 71 allows the Kansas Dental Board to determine whether a dentist or dental hygienist who is licensed in another state and who has applied for a Kansas license must appear in person before the Board as a part of the application process. Currently, the law requires such an applicant to appear in person before the Board.



The other amendments in the bill delete outdated dates from the laws.





Background



S.B. 71 was requested by the Kansas Dental Board. The President of the Board and a representative of the Kansas Dental Association supported the bill during Committee hearings.



The fiscal note on S.B. 71 indicates no impact from the bill on agency expenditures.
