H.B. 2854 amends the Civil Procedure Code to provide that documents to be admitted into evidence may be certified as authentic by the legal custodian of the documents. Under current law, documents kept outside Kansas require an additional procedure, a two-step process, in order to be authenticated and thereby admissible as evidence in civil proceedings.
The Senate Committee amendment was technical.
Background
The Kansas Securities Commissioner and the General Counsel to the Commissioner appeared in support of the bill. The Commissioner indicated the intent of the bill is to conform Kansas law to the Federal Rules of Evidence as well as certain other states which follow the federal model.
The fiscal note indicates no effect.
