S.B. 434 amends two statutes that are a part of the act under which the Health Care Data Board is created and operates. Amendments to K.S.A. 1997 Supp. 65-6805 add health researchers who are receiving state or federal funds to the statutory listing of those who are required to file health care data with the Board. Health care researchers would be required to file information describing the health-related studies they had undertaken. Amendments to K.S.A. 1997 Supp. 65-6803 result in making the Secretaries of Social and Rehabilitation Services and Health and Environment and the Insurance Commissioner or their designees full members of the Health Care Data Board with the same voting privileges as the other members.
S.B. 434 is to become effective on publication in the Kansas Register.
Background
As introduced, S.B. 434 was requested on behalf of the Board by the Secretary of Health and Environment who serves as the Chairperson of the Health Care Data Board. The amendments in Section 2 of the bill were recommended by a member of the Health Care Data Board who represents the Kansas Medical Society, who stated the Board had found the three state agencies who are now represented on the Board as nonvoting members utilize health-related data and have an interest in and use for data that is equal to that of the appointed members. For this reason, the appointed members of the Board believe the members representing state agencies should be full voting members of the Health Care Data Governing Board.
The fiscal note on S.B. 434 indicates no fiscal effect on state operations would result from enactment of the legislation.
