(Amends Chapter 5)
An Act concerning social and rehabilitation services; relating to
the sale of certain real
estate; disposition of proceeds; amending K.S.A. 2000 Supp.
75-3365, as amended by
section 383 of 2001 Senate Bill No. 15, and repealing the
existing section.
Be it enacted by the Legislature of the State of Kansas:
Section 1. K.S.A. 2000 Supp.
75-3365, as amended by section 383 of
2001 Senate Bill No. 15, is hereby amended to read as follows:
75-3365.
(a) The secretary of social and rehabilitation services is hereby
authorized
to sell and convey on behalf of the state of Kansas in the manner
provided
by this act the following described real estate: The southwest
Quarter of
Section 24; Township 22, Range 13 in Stafford County, Kansas. The
above
described property being that which was willed to the state of
Kansas by
Otto Hitz following the life estate created for Delmar Lee
Hitz.
(b) When the real estate described in
subsection (a) is sold, the pro-
ceeds thereof, after deduction of the expenses of such sale and the
cost
of the survey and the appraisal of the real estate, shall be
remitted to the
state treasurer in accordance with the provisions of K.S.A.
75-4215, and
amendments thereto. Upon receipt of each such remittance, the
state
treasurer shall deposit the entire amount in the state treasury
to the credit
of the Winfield properties special revenue with
1/2 being credited to the
Parsons state hospital patient benefit fund and 1/2 being
credited to the
Kansas neurological institute patient benefit fund.
Sec. 2. K.S.A. 2000 Supp. 75-3365, as amended by
section 383 of
2001 Senate Bill No. 15, is hereby repealed.
Sec. 3. This act shall take effect and be in force
from and after its
publication in the statute book.
