An Act concerning the Kansas national guard; relating to pay and allowances;
amending K.S.A. 48-225 and repealing the existing section.
Be it enacted by the Legislature of the State of Kansas:

      Section  1. K.S.A. 48-225 is hereby amended to read as follows: 48-
225. (a) When an officer or enlisted person of the Kansas national guard
is ordered by the governor to perform active state service, in a nonemer-
gency situation, such person shall receive from the state, pay and allow-
ances as may be authorized by the adjutant general at the rate now or
hereafter paid or allowed by law to officers and enlisted persons of the
same rank and length of service in the armed forces of the United States
except that should. The minimum amount of such pay and allowances
shall not be less than the amount received by an individual in the pay
grade of E-6 with six years of military service credited for pay purposes.
If any part of the compensation of such persons for the above service be
is paid by the United States, then there shall be paid from state funds,
only that part thereof not paid by the United States.

      (b) Members of the Kansas national guard ordered by the governor
to active duty in case of riot, tumult, breach of peace, invasion, war, or
imminent danger thereof, or for the protection of life or property shall
receive the amount of pay allowed to persons of the same rank or grade
and length of service in the armed forces of the United States or a total
of $48 per day, whichever is greater, except that should any part of the
compensation of such persons for the above service be paid by the United
States government, then there shall be paid from state funds, only that
part thereof not paid by the United States.

      (c) (b) The governor shall have authority to detail any member of the
governor's staff or any other officer or enlisted person of the Kansas
national guard upon any tour of military duty or to attend any military or
civil ceremony, within or without the state, as the governor may deem for
the best interest of the service and when so detailed, such persons shall
be allowed not to exceed the sum of $5 per day and necessary expenses
for travel and subsistence.

      (d)  (1)  Whenever the rates of compensation of the pay plan for per-
sons in the classified service under the Kansas civil service act are in-
creased, the per day compensation under subsection (b) shall be increased
by an amount, adjusted to the nearest dollar, computed by multiplying
the average of the percentage increases in all monthly steps of such pay
plan by the per day compensation under subsection (b) which is in effect
prior to the effective date of such increase in the rates of compensation
of the pay plan for persons in the classified service under the Kansas civil
service act.

      (2) If increases in monthly rates of compensation from step move-
ments of the pay plan for persons in the classified service under the
Kansas civil service act are authorized for the fiscal year ending June 30,
1993, or any fiscal year thereafter, the per day compensation under sub-
section (b) shall be increased by an amount, adjusted to the nearest dollar,
computed by multiplying the average percentage increase in the monthly
rate of compensation from step movements on the pay plan for persons
in the classified service under the Kansas civil service act determined
under paragraph (3) by the per day compensation under subsection (b)
which is in effect prior to the effective date of such increase. The increase
in the per day compensation under subsection (b) pursuant to this sub-
section shall take effect on the first day of the first payroll period which
is chargeable to the fiscal year in which such step movements on the pay
plan are authorized to take effect.

      (3) For purposes of paragraph (2), the average percentage increase
in the monthly rate of compensation from step movements on the pay
plan for persons in the classified service under the Kansas civil service
act shall be equal to the percentage certified by the secretary of admin-
istration which equals the estimated average of the percentage increases
in all monthly rates of compensation from step movements on the pay
plan for persons in the classified service under the Kansas civil service
act which are authorized to take effect during the fiscal year in which
such step movements on the pay plan are authorized to take effect.

      (4) If the increase under paragraph (1) takes effect on the first day
of the first payroll period of the fiscal year, the percentage rate increases
determined under paragraphs (1) and (2) shall be added together and the
aggregate percentage increase of compensation under this section shall
be used to increase the per day compensation instead of applying the
increases under paragraphs (1) and (2) separately.

 Sec.  2. K.S.A. 48-225 is hereby repealed.
 Sec.  3. This act shall take effect and be in force from and after its
publication in the statute book.
