An  Act making and concerning appropriations for the fiscal years ending June 30, 2000,
and June 30, 2001, for the Kansas dental board, state bank commissioner, behavioral
sciences regulatory board, legislative coordinating council, legislature, division of post
audit, governor's department, lieutenant governor, attorney general, secretary of state,
state treasurer, insurance department, judicial council, state board of indigents' defense
services, judicial branch, Kansas public employees retirement system, governmental
ethics commission, Kansas human rights commission, state corporation commission, cit-
izens' utility ratepayer board, department of administration, state board of tax appeals,
department of revenue, Kansas lottery, Kansas racing and gaming commission, depart-
ment of commerce and housing, Kansas, Inc., Kansas technology enterprise corporation,

authorizing certain transfers and capital improvement projects, imposing certain restric-
tions and limitations, and directing or authorizing certain receipts and disbursements
and acts incidental to the foregoing; amending K.S.A. 1999 Supp. 79-34,147 and re-
pealing the existing section.

Be it enacted by the Legislature of the State of Kansas:

 Section 1. (a) For the fiscal years ending June 30, 2000, and June 30,
2001, appropriations are hereby made, restrictions and limitations are
hereby imposed, and transfers, capital improvements projects, fees, re-
ceipts, disbursements and acts incidental to the foregoing are hereby di-
rected or authorized as provided in this act.

 (b) This act shall not be subject to the provisions of subsection (a) of
K.S.A. 75-6702 and amendments thereto.

 Sec. 2.

KANSAS DENTAL BOARD
 (a) On the effective date of this act, the expenditure limitation estab-
lished for the fiscal year ending June 30, 2001, by section 10(a) of chapter
132 of the 1999 Session Laws of Kansas on the dental board fee fund is
hereby increased from $258,179 to $298,179.

 Sec. 3.

STATE BANK COMMISSIONER
 (a) On the effective date of this act, the expenditure limitation estab-
lished for the fiscal year ending June 30, 2000, by section 4(a) of chapter
132 of the 1999 Session Laws of Kansas on the bank commissioner fee
fund is hereby decreased from $3,750,515 to $3,728,927.

 (b) On July 1, 2000, the expenditure limitation established for the fiscal
year ending June 30, 2001, by section 4(a) of chapter 132 of the 1999
Session Laws of Kansas on the bank commissioner fee fund is hereby
decreased from $3,845,899 to $3,784,474.

 Sec. 4.

BEHAVIORAL SCIENCES REGULATORY BOARD
 (a) On the effective date of this act, the expenditure limitation estab-
lished for the fiscal year ending June 30, 2000, by section 35(a) of chapter
160 of the 1999 Session Laws of Kansas on the behavioral sciences reg-
ulatory board fee fund is hereby increased from $421,736 to $430,504.

 (b) On July 1, 2000, the expenditure limitation established for the fiscal
year ending June 30, 2001, by section 6(a) of chapter 132 of the 1999
Session Laws of Kansas on the behavioral sciences regulatory board fee
fund is hereby increased from $399,536 to $424,641.

 (c) On July 1, 2000, the position limitation established for the fiscal
year ending June 30, 2001, by section 22 of chapter 132 of the 1999
Session Laws of Kansas for the behavioral sciences regulatory board is
hereby increased from 6.8 to 7.8.

 Sec. 5.

LEGISLATIVE COORDINATING COUNCIL
 (a) On the effective date of this act, of the $620,964 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 24(a)
of chapter 132 of the 1999 Session Laws of Kansas from the state general
fund in the legislative coordinating council--operations account, the sum
of $106,651 is hereby lapsed.

 (b) On the effective date of this act, of the $2,325,509 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 24(a)
of chapter 132 of the 1999 Session Laws of Kansas from the state general
fund in the legislative research department--operations account, the sum
of $63,744 is hereby lapsed.

 (c) On the effective date of this act, of the $1,982,995 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 24(a)
of chapter 132 of the 1999 Session Laws of Kansas from the state general
fund in the office of revisor of statutes--operations account, the sum of
$29,940 is hereby lapsed.

 Sec. 6.

LEGISLATURE
 (a) On the effective date of this act, of the $12,056,411 appropriated
for the above agency for the fiscal year ending June 30, 2000, by section
25(a) of chapter 132 of the 1999 Session Laws of Kansas from the state
general fund in the operations (including official hospitality) account, the
sum of $751,441 is hereby lapsed.

 Sec. 7.

DIVISION OF POST AUDIT
 (a) On the effective date of this act, of the $1,566,913 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 26(a)
of chapter 132 of the 1999 Session Laws of Kansas from the state general
fund in the operations (including legislative post audit committee) ac-
count, the sum of $44,478 is hereby lapsed.

 Sec. 8.

GOVERNOR'S DEPARTMENT
 (a) On the effective date of this act, of the $1,849,391 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 27(a)
of chapter 132 of the 1999 Session Laws of Kansas from the state general
fund in the governor's department account, the sum of $19,340 is hereby
lapsed.

 Sec. 9.

LIEUTENANT GOVERNOR
 (a) On the effective date of this act, of the $129,546 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 28(a)
of chapter 132 of the 1999 Session Laws of Kansas from the state general
fund in the operations account, the sum of $50,928 is hereby lapsed.

 Sec. 10.

ATTORNEY GENERAL
 (a) On the effective date of this act, the director of accounts and reports
shall transfer $475,609 from the operating expenditures relating to inter-
state water rights regarding the Republican river and its tributaries ac-
count of the state general fund of the attorney general to the additional
operating expenditures for investigation and litigation regarding interstate
water rights account of the state general fund of the attorney general.

 (b) On the effective date of this act, of the $1,015,000 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 29(a)
of chapter 132 of the 1999 Session Laws of Kansas from the state general
fund in the operating expenditures relating to interstate water rights re-
garding the Republican river and its tributaries account, the sum of
$288,277 is hereby lapsed.

 Sec. 11.

SECRETARY OF STATE
 (a) On the effective date of this act, of the $2,086,754 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 30(a)
of chapter 132 of the 1999 Session Laws of Kansas from the state general
fund in the operating expenditures account, the sum of $20,596 is hereby
lapsed.

 Sec. 12.

STATE TREASURER
 (a) On the effective date of this act, of the $1,726,816 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 31(a)
of chapter 132 of the 1999 Session Laws of Kansas from the state general
fund in the operating expenditures account, the sum of $210,639 is hereby
lapsed.

 (b) On the effective date of this act, of the $340,000 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 31(a)
of chapter 132 of the 1999 Session Laws of Kansas from the state general
fund in the banking services account, the sum of $25,000 is hereby lapsed.

 Sec. 13.

INSURANCE DEPARTMENT
 (a) On the effective date of this act, the expenditure limitation estab-
lished for the fiscal year ending June 30, 2000, by section 32(a) of chapter
132 of the 1999 Session Laws of Kansas on the insurance department
service regulation fund is hereby decreased from $6,846,969 to
$6,686,972.

 Sec. 14.

JUDICIAL COUNCIL
 (a) On the effective date of this act, of the $248,199 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 34(a)
of chapter 132 of the 1999 Session Laws of Kansas from the state general
fund in the operating expenditures account, the sum of $42,157 is hereby
lapsed.

 Sec. 15.

STATE BOARD OF INDIGENTS' DEFENSE SERVICES
 (a) On the effective date of this act, of the $12,256,991 appropriated
for the above agency for the fiscal year ending June 30, 2000, by section
35(a) of chapter 132 of the 1999 Session Laws of Kansas from the state
general fund in the operating expenditures account, the sum of $435,455
is hereby lapsed.

 Sec. 16.

JUDICIAL BRANCH
 (a) On the effective date of this act, of the $76,179,060 appropriated
for the above agency for the fiscal year ending June 30, 2000, by section
36(a) of chapter 132 of the 1999 Session Laws of Kansas from the state
general fund in the judiciary operations account, the sum of $779,980 is
hereby lapsed.

 Sec. 17.

KANSAS PUBLIC EMPLOYEES RETIREMENT SYSTEM
 (a) On the effective date of this act, the expenditure limitation estab-
lished for the fiscal year ending June 30, 2000, by section 37(b) of chapter
132 of the 1999 Session Laws of Kansas on the agency operations account
of the Kansas public employees retirement fund is hereby decreased from
$4,986,334 to $4,918,994.

 (b) On the effective date of this act, the expenditure limitation estab-
lished for the fiscal year ending June 30, 2000, by section 37(b) of chapter
132 of the 1999 Session Laws of Kansas on the investment related ex-
penses account of the Kansas public employees retirement fund is hereby
increased from $24,803,544 to $26,644,408.

 Sec. 18.

GOVERNMENTAL ETHICS COMMISSION
 (a) There is appropriated for the above agency from the state general
fund for the fiscal year ending June 30, 2000, the following:

Operating expenditures $4,336
 (b) On the effective date of this act, the expenditure limitation estab-
lished by section 38(b) of chapter 132 of the 1999 Session Laws of Kansas
on the governmental ethics commission fee fund is hereby increased from
$171,956 to $175,297.

 Sec. 19.

KANSAS HUMAN RIGHTS COMMISSION
 (a) On the effective date of this act, of the $1,455,796 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 39(a)
of chapter 132 of the 1999 Session Laws of Kansas from the state general
fund in the operating expenditures account, the sum of $50,311 is hereby
lapsed.

 Sec. 20.

STATE CORPORATION COMMISSION
 (a) On the effective date of this act, the expenditure limitation estab-
lished by section 40(b) of chapter 132 of the 1999 Session Laws of Kansas
on the aggregate expenditures from the public service regulation fund,
the motor carrier license fees fund and the conservation fee fund is
hereby decreased from $12,618,403 to $11,868,452.

 (b) On the effective date of this act, the director of accounts and reports
shall transfer $400,000 from the abandoned oil and gas well fund of the
state corporation commission to the state general fund.

 (c) On the effective date of this act, the position limitation established
by section 90(a) of chapter 132 of the 1999 Session Laws of Kansas for
the state corporation commission is hereby decreased from 211.0 to
209.0.

 Sec. 21.

CITIZENS' UTILITY RATEPAYER BOARD
 (a) On the effective date of this act, the expenditure limitation estab-
lished by section 41(a) of chapter 132 of the 1999 Session Laws of Kansas
on the utility regulatory fee fund is hereby increased from $457,793 to
$465,388.

 (b) On the effective date of this act, the director of accounts and reports
shall transfer all moneys in the gifts and donations fund to the utility
regulatory fee fund. On the effective date of this act, all liabilities of the
gifts and donations fund are hereby transferred to and imposed on the
utility regulatory fee fund and the gifts and donations fund is hereby
abolished.

 Sec. 22.

DEPARTMENT OF ADMINISTRATION
 (a) On the effective date of this act, of the $344,567 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 42(a)
of chapter 132 of the 1999 Session Laws of Kansas from the state general
fund in the performance review board account, the sum of $151,322 is
hereby lapsed.

 (b) On the effective date of this act, of the $1,323,554 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 42(a)
of chapter 132 of the 1999 Session Laws of Kansas from the state general
fund in the budget analysis account, the sum of $14,793 is hereby lapsed.

 (c) On the effective date of this act, of the $133,375 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 42(a)
of chapter 132 of the 1999 Session Laws of Kansas from the state general
fund in the policy analysis initiatives account, the sum of $2,713 is hereby
lapsed.

 (d) On the effective date of this act, of the $2,075,212 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 42(a)
of chapter 132 of the 1999 Session Laws of Kansas from the state general
fund in the public broadcasting council grants account, the sum of $3,177
is hereby lapsed.

 (e) On the effective date of this act, of the $250,000 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 42(a)
of chapter 132 of the 1999 Session Laws of Kansas from the state general
fund in the year 2000 readiness reviews account, the sum of $6,373 is
hereby lapsed.

 (f) On the effective date of this act, of the $139,858 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 42(a)
of chapter 132 of the 1999 Session Laws of Kansas from the state general
fund in the long-term care ombudsman account, the sum of $1,158 is
hereby lapsed.

 (g) On the effective date of this act, of the $18,043,940 appropriated
for the above agency for the fiscal year ending June 30, 2000, by section
42(a) of chapter 132 of the 1999 Session Laws of Kansas from the state
general fund in the department of administration operations account, the
sum of $36,928 is hereby lapsed.

 (h) On June 30, 2000, any unencumbered balance as of June 30, 2000,
in each of the following accounts of the state general fund is hereby
lapsed: Paint and grounds shop--debt service.

 (i) (1) On the effective date of this act, of the amount of the unencum-
bered balance appropriated for the above agency for the fiscal year ending
June 30, 2000, by section 42(a) of chapter 132 of the 1999 Session Laws
of Kansas in the year 2000 computer repair for state agencies account of
the state general fund, the sum of $130,831 is hereby lapsed.

 (2) On the effective date of this act and after the lapse prescribed by
subsection (i)(1), the director of accounts and reports shall transfer from
the year 2000 computer repair for state agencies account of the state
general fund to the department of administration operations account of
the state general fund, the amount of $249,509 or the unencumbered
balance that remains credited in the year 2000 computer repair for state
agencies account of the state general fund if such balance is less than
$249,509.

 (j) On the effective date of this act, of the amount of the unencumbered
balance appropriated for the above agency for the fiscal year ending June
30, 2000, by section 153(a) of chapter 132 of the 1999 Session Laws of
Kansas in the fire and safety alarms -- statehouse account of the state
general fund, the sum of $98,779 is hereby lapsed.

 (k) In addition to the other purposes for which expenditures may be
made by the above agency from the state buildings depreciation fund for
the fiscal year ending June 30, 2000, expenditures may be made by the
above agency from the following capital improvement account or accounts
of the state buildings depreciation fund during fiscal year 2000 for the
following capital improvement project or projects, subject to the expend-
iture limitations prescribed therefor:

Landon fail safe power supply $1,050,000
Docking heating, ventilation and air condition system renovations $275,000
Landon security improvements $110,000
 (l) There is appropriated for the above agency from the following spe-
cial revenue fund or funds for the fiscal year ending June 30, 2000, all
moneys now or hereafter lawfully credited to and available in such fund
or funds, except that expenditures other than refunds or indirect cost
recoveries authorized by law shall not exceed the following:

Facilities conservation improvement fund-- administration No limit
State revolving fund services fee fund No limit
 (m) In addition to the other purposes for which expenditures may be
made from the state budget stabilization fund for the fiscal year ending
June 30, 2000, expenditures may be made by the above agency from the
state budget stabilization fund for fiscal year 2000 for the following capital
improvement project or projects, subject to the expenditure limitation
prescribed therefor:

Statehouse fire and safety alarms $98,799
Provided, That all expenditures from each such capital improvement ac-
count shall be in addition to any expenditure limitation imposed on the
state budget stabilization fund for fiscal year 2000.

 (n) On the effective date of this act, the expenditure limitation estab-
lished for the fiscal year ending June 30, 2000, by section 12(e) of chapter
160 of the 1999 Session Laws of Kansas on the architectural services
recovery fund is hereby decreased from $1,497,412 to $1,471,061.

 (o) On the effective date of this act, the expenditure limitation estab-
lished by section 12(j) of chapter 160 of the 1999 Session Laws of Kansas
on the salaries and wages and other operating expenditures account of
the cafeteria benefits fund is hereby decreased from $2,322,792 to
$2,087,251.

 (p) On the effective date of this act, the position limitation established
by section 12(a) of chapter 160 of the 1999 Session Laws of Kansas for
the department of administration is hereby decreased from 889.4 to
885.4.

 Sec. 23.

STATE BOARD OF TAX APPEALS
 (a) On the effective date of this act, of the $2,335,988 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 43(a)
of chapter 132 of the 1999 Session Laws of Kansas from the state general
fund in the operating expenditures account, the sum of $651,086 is hereby
lapsed.

 (b) On the effective date of this act, the expenditure limitation estab-
lished by section 43(b) of chapter 132 of the 1999 Session Laws of Kansas
on the duplicating fees fund is hereby decreased from no limit to $14,500.

 (c) On the effective date of this act, the position limitation established
by section 90(a) of chapter 132 of the 1999 Session Laws of Kansas for
the state board of tax appeals is hereby decreased from 37.0 to 31.0.

 Sec. 24.

DEPARTMENT OF REVENUE
 (a) On the effective date of this act, of the $31,051,780 appropriated
for the above agency by section 44(a) of chapter 132 of the 1999 Session
Laws of Kansas from the state general fund in the operating expenditures
account, the sum of $631,601 is hereby lapsed.

 (b) On the effective date of this act, the expenditure limitation estab-
lished for the fiscal year ending June 30, 2000, by section 11(d) of chapter
160 of the 1999 Session Laws of Kansas on the division of vehicles op-
erating fund is hereby decreased from $36,155,674 to $36,148,484.

 (c) On the effective date of this act, the expenditure limitation estab-
lished for the fiscal year ending June 30, 2000, by section 11(e) of chapter
160 of the 1999 Session Laws of Kansas on the salaries and wages account
of the division of vehicles operating fund is hereby increased from
$17,144,750 to $17,798,331.

 (d) On the effective date of this act, the expenditure limitation estab-
lished by section 44(b) of chapter 132 of the 1999 Session Laws of Kansas
on the state bingo regulation fund is hereby increased from $332,750 to
$345,958.

 (e) On the effective date of this act, the expenditure limitation estab-
lished by section 44(b) of chapter 132 of the 1999 Session Laws of Kansas
on the electronic databases fee fund is hereby increased from $4,675,000
to $5,125,000.

 (f) On and after the effective date of this act, expenditures from moneys
appropriated to the department of revenue shall be made by the secretary
of revenue during the remainder of fiscal year 2000 to provide for cor-
porate income tax audits at least equal in number to the average monthly
number of corporate income tax audits, calculated in a comparable man-
ner, conducted by the department of revenue for the comparable period
from fiscal year 1996 through fiscal year 1998.

 Sec. 25.

KANSAS LOTTERY
 (a) On the effective date of this act, the expenditure limitation estab-
lished by section 45(a) of chapter 132 of the 1999 Session Laws of Kansas
on the lottery operating fund is hereby decreased from $8,641,218 to
$8,616,987.

 Sec. 26.

KANSAS RACING AND GAMING COMMISSION
 (a) On the effective date of this act, the expenditure limitation estab-
lished for the fiscal year ending June 30, 2000, by section 46(a) of chapter
132 of the 1999 Session Laws of Kansas on the state racing fund is hereby
decreased from $3,301,917 to $3,283,383.

 Sec. 27.

DEPARTMENT OF COMMERCE AND HOUSING
 (a) On the effective date of this act, of the $2,244,177 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 47(a)
of chapter 132 of the 1999 Session Laws of Kansas from the state general
fund in the state operations account, the sum of $26,382 is hereby lapsed.

 Sec. 28.

KANSAS, INC.
 (a) On the effective date of this act, of the $197,659 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 48(a)
of chapter 132 of the 1999 Session Laws of Kansas from the state general
fund in the Kansas, Inc. account, the sum of $15,097 is hereby lapsed.

 Sec. 29.

KANSAS TECHNOLOGY ENTERPRISE CORPORATION
 (a) On the effective date of this act, the amount of $1,119,279 directed
by section 49(d) of chapter 132 of the 1999 Session Laws of Kansas to be
transferred by the director of accounts and reports on August 15, 1999,
and on the 15th day of each month thereafter during the fiscal year ending
June 30, 2000, or as soon after each such date as moneys are available,
from the Kansas economic development endowment account of the state
economic development initiatives fund of the department of commerce
and housing to the economic development research and development
fund of the Kansas technology enterprise corporation, is hereby decreased
to an amount determined by the director of accounts and reports pursuant
to this subsection. The amount of each such transfer on and after the
effective date of this act during fiscal year 2000 shall be the amount
determined by the director of accounts and reports so that the aggregate
of all amounts transferred from the Kansas economic development en-
dowment account of the state economic development initiatives fund of
the department of commerce and housing to the economic development
research and development fund of the Kansas technology enterprise cor-
poration during fiscal year 2000 pursuant to section 49(d) of chapter 132
of the 1999 Session Laws of Kansas and this subsection shall not exceed
$12,942,963.

 (b) On the effective date of this act, the expenditure limitation estab-
lished by section 49(a) of chapter 132 of the 1999 Session Laws of Kansas
on the economic development research and development fund is hereby
decreased from $13,951,457 to $13,460,653.

 (c) On the effective date of this act, the expenditure limitation estab-

sum of $309,713 is hereby lapsed.

 (f) On the effective date of this act, of the $2,134,964 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 52(a)
of chapter 132 of the 1999 Session Laws of Kansas from the state general
fund in the operating expenditures--Kansas veterans' home account, the
sum of $880,649 is hereby lapsed.

 (g) The director of accounts and reports shall not make the transfer of
$50,000 from the soldiers' home outpatient clinic fund of the Kansas
commission on veterans affairs to the state general fund which was di-
rected to be made on June 1, 2000, by section 52(c) of chapter 132 of
the 1999 Session Laws of Kansas.

 (h) On the effective date of this act, the director of accounts and reports
shall transfer $545,570 from the Wichita veterans administration nursing
home fee fund of the Kansas commission on veterans affairs to the state
general fund.

 (i) On the effective date of this act, the expenditure limitation estab-
lished by section 52(b) of chapter 132 of the 1999 Session Laws of Kansas
on the veterans' home fee fund is hereby increased from $1,965,760 to
no limit.

 (j) On the effective date of this act, the expenditure limitation estab-
lished by section 52(b) of chapter 132 of the 1999 Session Laws of Kansas
on the soldiers' home fee fund is hereby increased from $3,764,082 to

 (f) On the effective date of this act, of the $221,184 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 53(a)

fund in the adult care homes criminal record checks operating expendi-
tures account, the sum of $88,410 is hereby lapsed.

 (g) On the effective date of this act, of the $950,000 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 53(a)
of chapter 132 of the 1999 Session Laws of Kansas from the state general
fund in the match for title XIX for nursing home inspections account, the

 (o) On the effective date of this act, the expenditure limitation estab-

increased from $20,001,058 to no limit.

 (p) On the effective date of this act, the expenditure limitation estab-
lished by section 53(b) of chapter 132 of the 1999 Session Laws of Kansas
on the adult care licensing revolving fund is hereby increased from $0 to
no limit.

 (q) On the effective date of this act, the expenditure limitation estab-
lished by section 53(b) of chapter 132 of the 1999 Session Laws of Kansas
on the salaries and wages account of the insurance statistical plan fund is
hereby increased from $148,321 to $155,340.

 (r) On the effective date of this act, the expenditure limitation estab-
lished by section 53(b) of chapter 132 of the 1999 Session Laws of Kansas
on the state operations account of the preventive health and health serv-
ices block grant fund is hereby increased from $740,143 to $848,922.

 (s) On the effective date of this act, the expenditure limitation estab-
lished by section 53(b) of chapter 132 of the 1999 Session Laws of Kansas
on the state operations account of the maternal and child health services
block grant fund is hereby decreased from $3,039,161 to $2,871,389.

 (t) On the effective date of this act, the expenditure limitation estab-
lished by section 53(b) of chapter 132 of the 1999 Session Laws of Kansas
on the state operations account of the AIDS project--education and risk
reduction--federal fund is hereby increased from $794,240 to
$1,592,966.

 (u) (1) On the effective date of this act, the director of accounts and
reports shall transfer from the air quality fee fund of the department of
health and environment to the state general fund the amount equal to
the aggregate of all amounts of interest credited to the air quality fee fund
pursuant to K.S.A. 1999 Supp. 65-3024 and amendments thereto during
the fiscal year ending June 30, 2000, prior to the effective date of this
act.

 (2) On and after the effective date of this act, during the fiscal year
ending June 30, 2000, the director of accounts and reports shall not make
the transfers of amounts of interest earnings from the state general fund
to the air quality fee fund of the department of health and environment
which are directed to be made on or before the 10th day of each month
by K.S.A. 1999 Supp. 65-3024 and amendments thereto.

 (v) On the effective date of this act and on the first day of each month
thereafter, the director of accounts and reports shall transfer from the
food inspection fee fund to the food service inspection reimbursement
fund an amount equal to 80% of all fees received during the fiscal year
ending June 30, 2000, and credited to the food inspection fee fund for
food service inspection services that are provided by a local agency under
contract with the secretary of health and environment to inspect food
service establishments located in a municipality.

 (w) On the effective date of this act, the director of accounts and re-
ports shall transfer $500,000 from the children's health care programs--
smoking prevention grants fund of the department of health and envi-
ronment to the state general fund. On the effective date of this act, all
liabilities of the children's health care programs--smoking prevention
grants fund are hereby transferred to and imposed on the state general
fund and the children's health care programs--smoking prevention grants
fund is hereby abolished.

 Sec. 33.

DEPARTMENT ON AGING
 (a) There is appropriated for the above agency from the state general

institutions are hereby changed to the amounts specified, but expendi-
tures from the mental health and retardation services aid and assistance
and state institutions operations account of the state general fund for any
such institution shall not be limited to, or be required to be made in, the
amount listed for the institution, as follows: (1) The amount for Kansas
neurological institute is hereby decreased from $7,931,823 to $7,640,245;
(2) the amount for Larned state hospital is hereby decreased from
$11,768,273 to $11,210,786; (3) the amount for Osawatomie state hospital
is hereby decreased from $5,988,178 to $5,790,631; (4) the amount for
Parsons state hospital and training center is decreased from $5,943,156
to $5,799,369; and (5) the amount for Rainbow mental health facility is
hereby decreased from $1,583,476 to $719,111.

 (n) On the effective date of this act, the expenditure limitation estab-
lished by section 55(b) of chapter 132 of the 1999 Session Laws of Kansas
on the Larned state hospital fee fund is hereby increased from $1,727,034
to $1,728,712.

 (o) On the effective date of this act, the expenditure limitation estab-
lished by section 55(b) of chapter 132 of the 1999 Session Laws of Kansas
on the Rainbow mental health facility fee fund is hereby increased from
$418,113 to $878,113.

 (p) On the effective date of this act, the position limitation established

 (a) In addition to the amount authorized to be expended from the
technology lending library account of the state general fund for the fiscal
year ending June 30, 2000, as authorized by section 60 (a) of chapter 132
of the 1999 Session Laws of Kansas and the state finance council, an
additional amount of expenditures may be made by the above agency
from the technology lending library account of the state general fund for
fiscal year 2000 for the purpose of matching an equal or greater amount
of federal or other nonstate governmental grant moneys or private grant
or donation moneys, or any combination thereof, received by the Kansas
state school for the blind: Provided, That such additional amount of ex-
penditures shall not exceed $4,957.

 (b) On the effective date of this act, of the $4,287,704 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 60(a)
of chapter 132 of the 1999 Session Laws of Kansas from the state general
fund in the operating expenditures account, the sum of $49,823 is hereby
lapsed.

 Sec. 40.

KANSAS STATE SCHOOL FOR THE DEAF
 (a) On the effective date of this act, of the $7,237,942 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 61(a)
of chapter 132 of the 1999 Session Laws of Kansas from the state general
fund in the operating expenditures account, the sum of $102,055 is hereby
lapsed.

 Sec. 41.

STATE HISTORICAL SOCIETY
 (a) On the effective date of this act, of the $6,009,530 appropriated for

shall transfer all moneys in the EDIF first territorial capitol renovation
project fund of the state historical society to the state economic devel-
opment initiatives fund of the department of commerce and housing. On
the effective date of this act, all liabilities of the EDIF first territorial
capitol renovation project fund of the state historical society are hereby
transferred to and imposed on the state economic development initiatives
fund of the department of commerce and housing and the EDIF first
territorial capitol renovation project fund of the state historical society is
hereby abolished.

 (c) On the effective date of this act, the director of accounts and reports
shall transfer all moneys in the EDIF cyclical maintenance projects fund
of the state historical society to the state economic development initiatives
fund of the department of commerce and housing. On the effective date
of this act, all liabilities of the EDIF cyclical maintenance projects fund
of the state historical society are hereby transferred to and imposed on
the state economic development initiatives fund of the department of
commerce and housing and the EDIF cyclical maintenance projects fund
of the state historical society is hereby abolished.

 (d) On the effective date of this act, of the amount of the unencum-

 (d) (1) On the effective date of this act, the amount of the unencum-

shall transfer all moneys in the Kansas special capital improvements fund

STATE CONSERVATION COMMISSION
 (a) On the effective date of this act, of the $605,899 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 86(a)
of chapter 132 of the 1999 Session Laws of Kansas from the state general
fund in the operating expenditures account, the sum of $6,177 is hereby
lapsed.

 (b) On the effective date of this act, the director of accounts and reports
shall transfer all moneys in the Jetmore Lake EDIF grant fund of the
state conservation commission to the state economic development initia-
tives fund of the department of commerce and housing. On the effective
date of this act, all liabilities of the Jetmore Lake EDIF grant fund of the
state conservation commission are hereby transferred to and imposed on
the state economic development initiatives fund of the department of
commerce and housing and the Jetmore Lake EDIF grant fund of the
state conservation commission is hereby abolished.

 (c) On the effective date of this act, the director of accounts and reports
shall transfer all moneys in the Centralia site 50 fund of the state con-
servation commission to the state conservation storage water supply fund
of the Kansas water office. On the effective date of this act, all liabilities
of the Centralia site 50 fund of the state conservation commission are
hereby transferred to and imposed on the state conservation storage water
supply fund of the Kansas water office and the Centralia site 50 fund of
the state conservation commission is hereby abolished.

 (d) On the effective date of this act, the director of accounts and reports
shall transfer $103,755 in the Wellington Lake fund of the state conser-
vation commission to the state conservation storage water supply fund of
the Kansas water office and shall transfer $19,196 in the Wellington Lake
fund of the state conservation commission to the state water plan fund of
the Kansas water office. On the effective date of this act, all liabilities of
the Wellington Lake fund of the state conservation commission are
hereby transferred to and imposed on the state conservation storage water
supply fund of the Kansas water office and the Wellington Lake fund of
the state conservation commission is hereby abolished.

 Sec. 67.

KANSAS WATER OFFICE
 (a) On the effective date of this act, of the $1,450,321 appropriated for
the above agency for the fiscal year ending June 30, 2000, by section 87(a)
of chapter 132 of the 1999 Session Laws of Kansas from the state general
fund in the water resources operating expenditures account, the sum of
$43,599 is hereby lapsed.

 (b) On the effective date of this act, the expenditure limitation estab-
lished by section 87(b) of chapter 132 of the 1999 Session Laws of Kansas
on the state water plan fund is hereby increased from $2,626,418 to
$2,769,857.

decreased from $212,487,075 to $206,946,902.

 (b) On the effective date of this act, if the aggregate of the amounts
transferred from the state general fund to the state highway fund prior
to the effective date of this act during the fiscal year ending June 30,
2000, pursuant to K.S.A. 79-34,147 and amendments thereto, exceeds
$62,240,428, then the director of accounts and reports shall transfer from
the state highway fund to the state general fund the amount equal to the
difference between such aggregate of the amounts transferred to the state
highway fund and $62,240,428.

 Sec. 70. (a) Notwithstanding the provisions of K.S.A. 25-4501 through
25-4508 and amendments thereto or any other statute, no presidential
preference primary election shall be held on the first Tuesday in April of
the year 2000 and no actions shall be taken or expenses incurred by the
secretary of state, by any county election officer or by any other state or
local governmental officer or employee for a presidential preference pri-
mary election on the first Tuesday in April of the year 2000. The secretary
of state shall refund any fees received from candidates for political party
nominations for president of the United States prior to the effective date
of this act.

 (b) On the effective date of this act, the provisions of K.S.A. 25-4501
through 25-4508 and amendments thereto are hereby suspended and
shall have no force and effect during the period commencing on the
effective date of this act and ending on June 30, 2000.

 (c) The secretary of state is hereby directed to undertake to develop,
in cooperation with at least six other states in the midwestern region of
the United States, a regional presidential primary election by having a
presidential primary election scheduled on a common date by each such
state. The secretary of state shall report to the 2001 regular session of the
legislature progress made toward such a regional presidential primary
election and any recommendations relating to such regional presidential
primary election which the secretary of state may deem appropriate.

 Sec. 71. (a) Notwithstanding the provisions of subsection (4) of K.S.A.
74-4927 and amendments thereto, no participating employer under the
Kansas public employees retirement system shall pay any amount to the
system for the cost of the plan of death and long-term disability benefits
under subsection (4) of K.S.A. 74-4927 and amendments thereto for the
period from April 1, 2000, through June 30, 2000.

 (b) On the effective date of this act, the amount in each account of the
state general fund of each state agency that is appropriated for the fiscal
year ending June 30, 2000, by chapter 132 or chapter 160 of the 1999
Session Laws of Kansas or by this act and that is budgeted for payment
of the cost of the plan of death and long-term disability benefits under
subsection (4) of K.S.A. 74-4927 and amendments thereto, as certified
by the director of the budget to the director of accounts and reports, for
the period from April 1, 2000, through June 30, 2000, is hereby lapsed.
The provisions of this subsection shall not apply to the appropriation for
the department of education for the fiscal year ending June 30, 2000,
made by section 57(a) of chapter 132 of the 1999 Session Laws of Kansas
from the state general fund in the KPERS--employer contributions ac-
count.

 (c) On the effective date of this act, of the $91,696,756 appropriated
for the department of education for the fiscal year ending June 30, 2000,
made by section 57(a) of chapter 132 of the 1999 Session Laws of Kansas
from the state general fund in the KPERS--employer contributions ac-
count, there is hereby lapsed the amount equal to the total of (1) the
amount that is budgeted for the payment of the cost of the plan of death
and long-term disability benefits under subsection (4) of K.S.A. 74-4927
and amendments thereto, as would normally be determined on or before
March 31, 2000, for payment by transfer normally on or after April 1,
2000, from the KPERS--employer contributions account of the state
general fund to the Kansas public employees retirement fund in accord-
ance with K.S.A. 74-4939 and amendments thereto, with adjustments for
prior payments by transfer, and (2) the amount that is budgeted for the
payment of the cost of the plan of death and long-term disability benefits
under subsection (4) of K.S.A. 74-4927 and amendments thereto, as
would normally be determined on or before June 30, 2000, for payment
by transfer normally on or after July 1, 2000, from the KPERS--employer
contributions account of the state general fund to the Kansas public em-
ployees retirement fund in accordance with K.S.A. 74-4939 and amend-
ments thereto, with adjustments for prior payments by transfer. The
amount lapsed by this subsection shall be determined by the director of
the budget, in consultation with the staff of the department of education
and the staff of the Kansas public employees retirement system, and shall
be certified by the director of the budget to the director of accounts and
reports.

 Sec. 72. (a) On the effective date of this act, all positions of officers or
employees of each state agency named in chapter 132 of the 1999 Session
Laws of Kansas that are vacant as of January 1, 2000, and that have been
vacant for a continuous period of 48 months or more, as determined by
the director of the budget in consultation with the director of personnel
services, are hereby abolished and no moneys appropriated for any such
state agency for the fiscal year ending June 30, 2000, from the state gen-
eral fund or any special revenue fund by chapter 132 or 160 of the 1999
Session Laws of Kansas or by this or other appropriation act of the 2000
regular session of the legislature, shall be expended for any such abolished
position.

 (b) On the effective date of this act, the position limitations established
by sections 22 and 90(a) of chapter 132 of the 1999 Session Laws of
Kansas, as amended by chapter 160 of the 1999 Session Laws of Kansas
or by this act or other appropriation act of the 2000 regular session of the
legislature or as established by the state finance council on the number
of full-time and regular part-time positions equated to full-time for the
fiscal year ending June 30, 2000, for the state agencies for which such
position limitations are established and for which positions are abolished
under subsection (a), are hereby decreased accordingly for each such
agency by the full-time equivalent number of such abolished positions.

 Sec. 73. K.S.A. 1999 Supp. 79-34,147 is hereby amended to read as
follows: 79-34,147. (a) (1) On July 1, 1999, and quarterly thereafter the
secretary of revenue shall certify to the director of accounts and reports
the amount equal to 7.628% of the total revenues received by the sec-
retary from the taxes imposed under the Kansas retailers' sales tax act
and deposited in the state treasury and credited to the state general fund
during the preceding three calendar months.

 (2) On July 1, 2001, and quarterly thereafter, the secretary of revenue
shall certify to the director of accounts and reports the amount equal to
9.5% of the total revenues received by the secretary from the taxes im-
posed under the Kansas retailers' sales tax act and deposited in the state
treasury and credited to the state general fund during the preceding three
calendar months.

 (3) On July 1, 2002, and quarterly thereafter, the secretary of revenue
shall certify to the director of accounts and reports the amount equal to
11% of the total revenues received by the secretary from the taxes im-
posed under the Kansas retailers' sales tax act and deposited in the state
treasury and credited to the state general fund during the preceding three
calendar months.

 (4) On July 1, 2003, and quarterly thereafter, the secretary of revenue
shall certify to the director of accounts and reports the amount equal to
11.25% of the total revenues received by the secretary from the taxes
imposed under the Kansas retailers' sales tax act and deposited in the
state treasury and credited to the state general fund during the preceding
three calendar months.

 (5) On July 1, 2004, and quarterly thereafter, the secretary of revenue
shall certify to the director of accounts and reports the amount equal to
12% of the total revenues received by the secretary from the taxes im-
posed under the Kansas retailers' sales tax act and deposited in the state
treasury and credited to the state general fund during the preceding three
calendar months.

 (b) Upon receipt of each certification under subsection (a), the director
of accounts and reports shall transfer from the state general fund to the
state highway fund an amount equal to the amount so certified, on each
July 1, October 1, January 1 and April 1, except that (1)(A) the amount
of the transfer on each such date during state fiscal year 2000 shall not
exceed the amount equal to 101.7% of the amount of the transfer on each
such date during state fiscal year 1999 and (B) the aggregate amount of
all such transfers during state fiscal year 2000 shall not exceed
$62,240,428; and (2) the amount of the transfer on each such date during
state fiscal year 2001 shall not exceed the amount equal to 101.7% of the
amount transferred on the same date during state fiscal year 2000. All
transfers made pursuant to this section are subject to reduction under
K.S.A. 75-6704, and amendments thereto.

 (c) All transfers made in accordance with the provisions of this section
shall be considered to be demand transfers from the state general fund.

 Sec. 74. Appeals to exceed position limitations. (a) The limitations im-
posed by this act on the number of full-time and regular part-time posi-
tions equated to full-time, excluding seasonal and temporary positions,
paid from appropriations for the fiscal year ending June 30, 2000, made
in this act or in any appropriation act of the 1999 regular session of the
legislature or in any other appropriation act of the 2000 regular session
of the legislature may be exceeded upon approval of the state finance
council.

 (b) The limitations imposed by this act on the number of full-time and
regular part-time positions equated to full-time, excluding seasonal and
temporary positions, paid from appropriations for the fiscal year ending
June 30, 2001, made in this act or in any other appropriation act of the
2000 regular session of the legislature may be exceeded upon approval of
the state finance council.

 Sec. 75. Appeals to exceed limitations. Upon written application to the
governor and approval of the state finance council, expenditures from
special revenue funds may exceed the amounts specified in this act.

 Sec. 76. K.S.A. 1999 Supp. 79-34,147 is hereby repealed.

 Sec. 77. This act shall take effect and be in force from and after its
publication in the Kansas register.
