SENATE BILL No. 292
An Act concerning imported meat, poultry or dairy products
labeling; providing for en-
forcement by the attorney general; amending K.S.A. 65-6a48,
65-6a49, 65-6a50 and 65-
6a51 and repealing the existing sections.
Be it enacted by the Legislature of the State of Kansas:
Section 1. K.S.A. 65-6a48 is hereby
amended to read as follows: 65-
6a48. It shall be the duty of the secretary of health and
environment to
aid in the enforcement of The attorney general
shall enforce the provisions
of this act. The secretary or his or her
attorney general or the duly au-
thorized agents of the attorney general shall have access at
all regular
business hours to every retail establishment which sells or offers
to sell
meat, poultry, eggs or butter to the public.
Sec. 2. K.S.A. 65-6a49 is hereby
amended to read as follows: 65-
6a49. In addition to other remedies provided by this act the
secretary of
health and environment attorney general is
authorized to apply to the
district court, and such court shall have jurisdiction upon a
hearing and
for cause shown to grant a temporary or permanent injunction
restraining
any person from violating this act.
Sec. 3. K.S.A. 65-6a50 is hereby
amended to read as follows: 65-
6a50. Upon determining that a provision of this act has been
violated, it
shall be the duty of a county attorney to whom the
secretary of health
and environment or his or her agent reports a violation of
this act the
attorney general to institute appropriate proceedings in the
proper courts
without delay and to prosecute the same in the manner provided by
law.
Sec. 4. K.S.A. 65-6a51 is hereby
amended to read as follows: 65-
6a51. The secretary of health and environment
attorney general is hereby
authorized to adopt such rules and regulations as the
secretary may deem
attorney general deems necessary to properly enforce the
provisions of
this act.
Sec. 5. K.S.A. 65-6a48, 65-6a49, 65-6a50 and 65-6a51 are
hereby re-
pealed.
Sec. 6. This act shall take effect and be in force
from and after its
publication in the statute book.
