HOUSE BILL No. 2685
An Act concerning certain public officers; relating to the powers and duties thereof; amend-
ing K.S.A. 19-304, 19-3423 and 53-504 and repealing the existing sections.
Be it enacted by the Legislature of the State of Kansas:

Section 1. K.S.A. 19-304 is hereby amended to read as follows: 19-
304. The county clerk shall keep his:

(a) Keep the clerk's office at the county seat; shall

(b) attend the sessions of the board of county commissioners, either
in person or by deputy;

(c) keep the seals, records and papers of the said board of commis-
sioners; and shall

(d) sign the records of the proceedings of the board of commission-
ers, and attest the same with the seal of the county; and

(e) have the general powers of a notary public in the performance of
all notarial acts.

Sec. 2. K.S.A. 19-3423 is hereby amended to read as follows: 19-
3423. (a) Election commissioners shall procure a seal of office, properly
inscribed, and shall authenticate all his official acts therewith. Said com-
missioner is hereby given of the commissioner with such seal. The com-
missioner shall have full and complete power and authority over all elec-
tions in the county and to shall see that such elections are conducted
according to law.

(b) The election commissioner and assistant election commissioner
shall have the general powers of a notary public in the performance of all
notarial acts.

Sec. 3. K.S.A. 53-504 is hereby amended to read as follows: 53-504.
(a) A notarial act may be performed within this state by the following
persons:

(1) A notary public of this state,;

(2) a judge, clerk or deputy clerk of any court of this state, or;

(3) a county clerk or deputy county clerk;

(4) an election commissioner or assistant election commissioner; or

(3) (5) any other person authorized to perform the specific act by the
law of this state.

(b) Notarial acts performed within this state under federal authority
as provided in K.S.A. 53-506, and amendments thereto, shall have the
same effect as if performed by a notarial officer of this state.

(c) The signature and title of a person performing a notarial act are
prima facie evidence that the signature is genuine and that the person
holds the designated title.

Sec. 4. K.S.A. 19-304, 19-3423 and 53-504 are hereby repealed.

Sec. 5. This act shall take effect and be in force from and after its
publication in the statute book.
