An Act concerning the state of Kansas sports hall of fame;
providing for separation from
the state historical society; amending K.S.A. 74-2906a and K.S.A.
1996 Supp. 74-2912
and repealing the existing sections.
Be it enacted by the Legislature of the State of
Kansas:
Section 1. K.S.A. 74-2906a is hereby amended to read as follows:
74-
2906a. (a) There is hereby created the state of Kansas sports hall
of fame
board of trustees, hereinafter referred to as the board of
trustees, which
board shall be composed of seven members appointed by the
governor.
(b) Upon the expiration of the term of office of any member, a
suc-
cessor shall be appointed for a term of four years. All vacancies
in office
of members so appointed shall be filled by appointment for the
unexpired
term of the member creating the vacancy. Members of the
Kansas all-
sports hall of fame board of trustees immediately prior to the
effective
date of this act shall become members of the state of Kansas sports
hall
of fame and shall serve as such members until the expiration of
their term
of office established as members of the Kansas all-sports hall of
fame
board of trustees.
(c) The board of trustees shall organize annually by electing
one of
its members as chairperson and one as vice-chairperson. Meetings of
the
board of trustees shall be held upon call of the chairperson, or
may be
called by a majority of the board of trustees.
(d) The board of trustees shall have such powers and duties as
are
provided by law. Members of the board of trustees attending
meetings
of such board of trustees, or attending a subcommittee meeting
thereof
authorized by such board of trustees, shall be paid amounts
provided in
subsection (e) of K.S.A. 75-3223 and amendments thereto.
(e) The board of trustees may employ such professional and
clerical
personnel, on a part-time or full-time basis, as may be necessary
in its
judgment, and all such personnel shall be in the classified service
under
the Kansas civil service act.

(f) The state of Kansas sports hall of fame board of
trustees is hereby
attached to the state historical society as a part thereof. All
budgeting,
purchasing and related management functions of the board of
trustees
shall be administered under the direction and supervision of the
state
historical society. The state historical society shall provide
office space
and such clerical and other staff assistance as may be necessary to
assist
the board of trustees in carrying out its functions, powers and
duties.
(g) (f) Whenever the Kansas all-sports
hall of fame board of trustees,
or words of like effect, is referred to or designated by any
appropriations
act or other act of the legislature, or any statute, contract or
other doc-
ument, such reference or designation shall be deemed to apply to
the
state of Kansas sports hall of fame board of trustees which is
created by
this act.
Sec. 2. K.S.A. 1996 Supp. 74-2912 is hereby amended to read
as
follows: 74-2912. (a) There is hereby created in the state
treasury the
state of Kansas sports hall of fame fund. The board of trustees
shall remit
all moneys received by the board of trustees, including all moneys
re-
ceived as gifts, grants, bequests and gratuities as provided in
K.S.A. 74-
2909 and amendments thereto, to the state treasurer at least
monthly.
Upon receipt of each such remittance the state treasurer shall
deposit the
entire amount thereof in the state treasury and the same shall be
credited
to the state of Kansas sports hall of fame fund.
(b) In accordance with and subject to the provisions of
this act and (a) The board of trustees
may make expenditures
of appropriation acts,
from the state of Kansas sports hall of fame fund
for contracts entered
into with private entities, for the maintenance and operating
expenditures
of the state of Kansas sports hall of fame and the board of
trustees, for
the expenses of state of Kansas sports hall of fame induction
ceremonies,
including the actual and necessary expenses of speakers and persons
being
inducted into the state of Kansas sports hall of fame for their
attendance
at such induction ceremonies, for official hospitality, for capital
improve-
ment projects for remodeling of or for additions or repairs to the
state of
Kansas sports hall of fame and for such other purposes as may be
au-
thorized by law.
(c) (b) All expenditures
from by the board of trustees of the state
of
Kansas sports hall of fame fund shall be exempt
from competitive bid
procedures under K.S.A. 75-3739 and amendments thereto and
shall be.
made in accordance with appropriation acts upon warrants of the
director
of accounts and reports issued pursuant to vouchers approved by
the
board of trustees or by a person or persons designated by the board
of
trustees
(d) (c) On the effective date of
this act July 1, 1997, the director of
accounts and reports shall transfer all moneys in the
all-sports hall of fame state of Kansas sports hall of fame fund to
the bank account

established under this section in accordance with the
procedures pre-
scribed by this section therefor. On the effective date
of this act July 1,
1997, all liabilities of the all-sports hall of
fame state of Kansas sports hall
of fame fund are hereby transferred to and imposed upon
the state of such bank account.
On
Kansas sports hall of fame fundthe effective date July 1, 1997, the

hall of fame state of Kansas sports
hall of fame fund is hereby abolished.
(e) On or before the 10th of each month, the director of
accounts
and reports shall transfer from the state general fund to the state
of Kan-
sas sports hall of fame fund interest earnings based
on:
(1) The average daily balance of moneys in the state of
Kansas sports
hall of fame fund for the preceding month; and
(2) the net earnings rate of the pooled money investment
portfolio
for the preceding month.
(f) (d) Upon the request
of The state of Kansas sports hall of fame
board of trustees and in accordance with the provisions of
appropriations shall deposit all moneys of
the state of Kansas
acts, the state historical society may transfer moneys in the state
of Kansas
sports hall of fame fund to
sports hall of fame in a bank to the account of the state of
Kansas sports
hall of fame. Such bank account shall be awarded to a bank located
in
the county in which the state of Kansas sports hall of fame is
located by
the pooled money investment board under a written agreement in
ac-
cordance with procedures for state bank accounts under K.S.A.
75-4217
and amendments thereto and shall be secured by pledge of securities
in
the manner prescribed for state bank accounts under K.S.A. 75-4218
and
amendments thereto and in the amount prescribed for fee agency
ac-
counts under that statute. Each such transfer shall be made
upon vouch-All moneys in such bank account shall be
used by the board of trustees

and re-
ports and the state treasurer are hereby authorized and directed to
honor
by making such transfers, and the moneys so transferred shall be
for use
of the state of Kansas sports hall of fame in operating and
conducting the
activities of the state of Kansas sports hall of fame. The board of
trustees
of the state of Kansas sports hall of fame shall make a
full and completekeep and maintain accounting records of
receipts, expenditures and other
report on a monthly basis and by object classification to the state
historical
society of all expenditures for each fiscal year from such bank
account
disbursements in accordance with procedures and guidelines approved
by
the director of accounts and reports therefor. All receipts,
accounts, ex-
penditures and other disbursements from the moneys of the state of
Kan-
sas sports hall of fame shall be subject to audit in accordance
with the
legislative post audit act.
Sec. 3. K.S.A. 74-2906a and K.S.A. 1996 Supp. 74-2912 are
hereby
repealed.

Sec. 4. This act shall take effect and be in force from and
after its
publication in the statute book.
