An Act concerning drainage districts; relating to the apportionment of certain costs; amend- ing K.S.A. 24-628 and repealing the existing section.
Be it enacted by the Legislature of the State of Kansas:
Section 1. K.S.A. 24-628 is hereby amended to read as follows:
24- 628. When two or more districts shall have
their outlet or discharge into the same natural or man-made
watercourse or stream and it shall become
becomes necessary to maintain, deepen
or, enlarge said or
otherwise im- prove the natural or man-made watercourse
or stream each district shall be assessed for the cost of such work
in the same ratio to such total cost as the discharge of waters of
such district bears to the combined discharge of waters of
the several all districts emptying into
said the natural or man- made
watercourse or stream; but. No district
shall be liable to contribute for any improvement or costs and
expenses incurred in improving said the
natural or man-made watercourse or stream above the point of
dis- charge of the waters of such district into the
same such natural or man- made watercourse.
Sec. 2. K.S.A. 24-628 is hereby repealed.
Sec. 3. This act shall take effect and be in force from and after its publication in the statute book.
