An Act concerning social welfare; establishing a pilot project of alcohol and drug screening within the KanWork program.
Be it enacted by the Legislature of the State of Kansas:
Section 1. (a) For the purposes of providing early intervention and treatment, the secretary of social and rehabilitation services, subject to the provisions of subsection (f), shall establish and implement an alcohol and drug screening pilot project which may include a drug test for persons who have symptoms of alcoholism and drug addiction, who are receiving assistance as provided in K.S.A. 39-709 and amendments thereto and who are participants in the KanWork program.
(b) No applicant for assistance shall be required to submit to a screen- ing as a part of such pilot project unless the applicant is determined to be eligible for assistance and is a participant in the KanWork program.
(c) If a cash assistance recipient who is a participant in the KanWork program is diagnosed with alcoholism or drug addiction, or both, such person shall complete a treatment program recommended as a result of the evaluation. Failure to undergo such alcohol and drug screening and to complete a treatment program shall result in the termination of a por- tion or all cash assistance benefits for such recipient.
(d) The results of any test administered as a part of the pilot project authorized by this section shall be confidential and shall not be disclosed publicly except that such information may be disclosed to officers or em- ployees of the department of social and rehabilitation services when nec- essary in the performance of their official duties or disclosed to profes- sional persons when necessary to assist such professional persons providing treatment to the assistance recipient as specified by rules and regulations of the secretary of social and rehabilitation services. Any em- ployee or professional persons to which such information is disclosed shall be subject to the confidentiality requirements of this section.
(e) The secretary of social and rehabilitation services shall adopt such rules and regulations as necessary to carry out the provisions of this sec- tion.
(f) The secretary of social and rehabilitation services shall seek waiv- ers from program requirements of the federal government as may be needed to carry out the provisions of the alcohol and drug screening pilot project for persons receiving cash assistance who are participants in the KanWork program, as necessary. The secretary of social and rehabilitation services shall implement the alcohol and drug screening pilot project un- der this section for persons receiving cash assistance who are participants in the KanWork program only if such waivers to federal program require- ments have been obtained from the federal government.
(g) The words and phrases used in this section shall have the same meaning as is ascribed to such words and phrases under K.S.A. 39-702 and amendments thereto.
(h) The secretary of social and rehabilitation services shall report on or before January 13, 1997, and January 12, 1998, to the legislature eval- uations, findings and recommendations of the secretary concerning the pilot project established under this section.
(i) The provisions of this section shall expire on July 1, 1998.
Sec. 2. This act shall take effect and be in force from and after its publication in the statute book.
