An Act concerning the department of commerce and housing; amending K.S.A. 72-4436 and 72-4437 and K.S.A. 1995 Supp. 74-50,100 and repealing the existing sections.

Be it enacted by the Legislature of the State of Kansas:

Section 1. K.S.A. 72-4436 is hereby amended to read as follows: 72- 4436. As used in this act:

(a) ``Area vocational school,'' ``area vocational-technical school,'' ``community college,'' and ``school year'' have the meanings respectively ascribed thereto in K.S.A. 72-4412 and amendments thereto.

(b) ``Board'' means the board of directors of the Kansas technology enterprise corporation.

(c) (b) ``Operating budget'' has the meaning ascribed thereto in K.S.A. 72-4430 and amendments thereto.

(d) (c) ``School'' means any area vocational school, any area voca- tional-technical school, and any community college.

(e) (d) ``Vocational education instructional equipment aid'' means state financial aid distributed under this act by the board secretary of commerce and housing to a school for the purpose of acquiring vocational education instructional equipment.

Sec. 2. K.S.A. 72-4437 is hereby amended to read as follows: 72- 4437. (a) Subject to the provisions of appropriations acts, vocational ed- ucation instructional equipment aid shall be distributed to schools in ac- cordance with this act. Any such distribution shall be on a competitive basis and the amount thereof for each school shall be determined by the board secretary of commerce and housing on the basis of the condition of existing equipment and potential for stimulating economic growth and enhancing employment opportunities within the state. The board secre- tary of commerce and housing shall establish criteria for evaluating ap- plications of schools for vocational education instructional equipment aid.

(b) Payments of vocational education instructional equipment aid shall be distributed by the Kansas technology enterprise corporation sec- retary of commerce and housing on dates to be determined by the board secretary. Upon receipt of such payment, the treasurer of each area vo- cational school shall deposit the amount thereof to the credit of the area vocational school fund. The treasurer of each area vocational-technical school shall deposit the amount of such warrant to the credit of the vo- cational education instructional equipment fund established by this act.

Sec. 3. K.S.A. 1995 Supp. 74-50,100 is hereby amended to read as follows: 74-50,100. (a) No planning grants shall be awarded to applicants from nonmetropolitan counties under this act on or after July 1, 1995. No planning grants shall be awarded to metropolitan counties under this act on or after July 1, 1997.

(b) No action grants shall be awarded to applicants from nonmetro- politan counties under this act on or after July 1, 1996 1997. No action grants shall be awarded to applicants from metropolitan counties under this act on or after July 1, 1998.

Sec. 4. K.S.A. 72-4436 and 72-4437 and K.S.A. 1995 Supp. 74-50,100 are hereby repealed.

Sec. 5. This act shall take effect and be in force from and after its publication in the statute book.
