The roll was called with thirty-eight senators present.

President Bond introduced as guest chaplain, Father Frank Krische, Pastor of Most Pure
Heart of Mary Catholic Church, Topeka, who delivered the invocation:

INTRODUCTION OF BILLS AND CONCURRENT RESOLUTIONS
The following bill was introduced and read by title:

SB 654, An act relating to property taxation; concerning the valuation of land devoted to
agricultural use; amending K.S.A. 1999 Supp. 79-1476 and repealing the existing section,
by Committee on Ways and Means.

REMOVE FROM CONSENT CALENDAR
An objection having been made to HB 2659 appearing on the Consent Calendar, the
President directed the bill be removed and placed on the calendar under the heading of
General Orders.

REPORTS OF STANDING COMMITTEES
Committee on Commerce recommends HB 2832, as amended by House Committee,
be amended on page 3, in line 1, after ``findings'', by inserting ``in writing''; in line 2, by
striking ``the chair of''; in line 3, by striking ``and the chair of'' and inserting a comma; also
in line 3, before the period, by inserting ``and the joint committee on economic
development''; and the bill be passed as amended.

Committee on Education recommends HB 2357 be amended by substituting a new bill
to be designated as ``Senate Substitute for HOUSE BILL No. 2357,'' as follows:

``SENATE Substitute for HOUSE BILL No. 2357 By Committee on Education

``AN ACT concerning charter schools; rescinding the limitation on the number of such
schools being operated in the state; amending K.S.A. 1999 Supp. 72-1904, 72-1906 and
72-1907 and repealing the existing sections; also repealing K.S.A. 1999 Supp. 72-1905.'';

and the substitute bill be passed.

Also, SB 432 be amended on page 1, in line 15, by striking all after ``applicant''; in line
16, by striking all before ``a'' and inserting ``be subjected to''; in line 19, after the period, by
inserting ``An applicant for employment by a school district in a position that requires a
certificate issued by the state board of education shall authorize release of the results of the
criminal history records check to the state board and an applicant for employment by a
school district in a classified position shall authorize release of the results of the criminal
history records check to the board of education of the school district.''; in line 26, before
``shall'', by inserting ``or to the board of education of a school district''; in line 27, after
``education'', by inserting ``or by a member of the board of education of a school district'';
in line 33, after ``district'', by inserting ``in a position that requires a certificate issued by the
state board''; also in line 33, by striking ``No'' and inserting ``Except as otherwise provided
in subsection (d), no''; following line 37, by inserting two new paragraphs as follows:

``(d) The board of education of a school district may offer provisional employment to
an applicant pending receipt of the results of the criminal history records check required
by subsection (a). Any contract for provisional employment offered to an applicant under
authority of this subsection shall specify that the contract is subject to termination by the
board of education, without further proceedings and without reference to any other law or
contractual arrangement, if the results of the criminal history records check reveal that the
applicant has been convicted of any offense or attempt to commit any offense specified in
K.S.A. 1999 Supp. 72-1397, and amendments thereto.

(e) For the purposes of this section, the term ``applicant'' means any person who has
applied for employment by a school district, has been offered a position of employment by
the school district, and has not had a fixed and continuous residence in this state for at least
10 years immediately preceding submission of an application for employment by the school
district.'';

By renumbering sections 7 and 8 as sections 4 and 5, respectively;

In the title, in line 12, by striking ``schools'' and inserting ``school districts''; in line 14, by
striking all after the semicolon; in line 15, by striking all before ``amending''; in line 16, by
striking ``72-1904, 72-1906, 72-1907,''; in line 17, by striking all after ``sections''; in line 18,
by striking all before the period; and the bill be passed as amended.

Committee on Energy and Natural Resources recommends SB 634 be amended on
page 1, in line 14, by striking ``Whenever'' and inserting ``Subject to the limitations of this
section, whenever''; after line 41, by inserting:

``(d) The aggregate outstanding balance of all loans pursuant to this section shall not
exceed $1,000,000 at any one time.''; and the bill be passed as amended.

Committee on Public Health and Welfare recommends HB 2701, 2756 be passed.
