KANSAS GUARDIANSHIP PROGRAM

KSA 74-9601 et. seq., Judge Frank J. Yeoman, Jr., Chairperson, submitted the 1999 annual
report.
The President announced the above report is on file in the office of the Secretary of the
Senate and is available for review at any time.

REPORTS OF STANDING COMMITTEES
Committee on Elections and Local Government recommends SB 465 be passed
and, because the committee is of the opinion that the bill is of a noncontroversial nature,
be placed on the consent calendar.
Committee on Energy and Natural Resources recommends SCR 1630 be adopted.
Committee on Federal and State Affairs recommends SB 475 be amended on page
3, in line 16, by striking ``30'' and inserting ``10'';
On page 7, in line 8, by striking ``statute book'' and inserting ``Kansas register''; and the
bill be passed as amended.
Committee on Financial Institutions and Insurance recommends SB 440, 441, 457
be passed.
Also, SB 459 be amended on page 2, after line 35, by inserting the following:
``Sec. 3. K.S.A. 1999 Supp. 9-2208 is hereby amended to read as follows: 9-2208. (a)
Every certificate of registration shall be properly displayed in a prominent place within the
registrant's place of business in a way that reasonably assures recognition by customers and
members of the general public who enter the registrant's place of business.
(b) Prior to entering into any contract for the provision of services or prior to the
registrant receiving any compensation or promise of compensation for a mortgage loan the
registrant shall acquire from the customer a signed acknowledgment containing such
information as the commissioner may prescribe by rule and regulation. A copy of the
acknowledgment shall be provided to the customer.
(c) The registrant shall identify that such registrant is registered under this act in all
advertising or solicitations directed to Kansas residents, including internet solicitations. For
the purpose of this subsection, ``advertising'' does not include business cards or promotional
items.
(d) No registrant shall conduct mortgage business in this state using any name other
than the name or names stated on the certificate of registration.'';

COMMITTEE OF THE WHOLE
On motion of Senator Emert, the Senate resolved itself into Committee of the Whole for
