Journal of the Senate

TENTH DAY
______
Senate Chamber, Topeka, Kansas
Monday, January 24, 2000--2:30 p.m.
The Senate was called to order by Vice-President Alicia L. Salisbury.

The roll was called with thirty-nine senators present.

 Senator Praeger was excused.

Invocation by Chaplain Fred S. Hollomon:

         Heavenly Father,

We know You've heard it all before,

But it really is a fact

We have stacks and stacks of bills

       To kill or to enact.

One of the items we consider

       Is Public Education,

       Including Community Services

       Required for graduation.

           Public Safety is an issue

       Under consideration

       One proposal on the list

       Involves consolidation.

           Open Records and Abortion

       Are demanding our attention.

       Social Services and Senior Citizens

       Also should be mentioned.

           Health Issues and State Employees

       Will certainly take some time.

(Which will also do its part

To help this prayer to rhyme!)

           Speaking of time  .  .  .  .  .

We could use Your help, O God,

For we think it'd be a crime

To have to watch this session

       Go into overtime!

I pray in the Name of Christ,

           Amen

EXPLANATION OF VOTE

Madam Vice-President: I vote NO on SB 39.

On May 10, 1869, at Promontory Point, Utah, a silver sledge drove a gold-headed spike
into a railroad tie. Then two locomotives, one from the East and one from the West, nosed
forward until their pilots touched, and their crews doused them with champagne. Thus, the
first transcontinental railroad was completed.

Today, 130 years later, history has repeated itself, absent the champagne. Two locomo-
tives, one from the East wing of the Statehouse, the other from the West wing, railroaded
through the passage of SB 39. Thus, they drove a spike through the FY 2000 budget.

This bill was engineered on a fast track making it impossible for thoughtful debate to gain
steam. The people of Kansas ended up riding the caboose and most legislators were little
more than passengers, trained to vote without considering the implications of these budget
cuts.

For some of us, we could never get on board because the trains were flagged ahead by
the chief conductor, who ordered them to run full throttle and flatten everyone in their
way.

This is no way to run a railroad.--Anthony Hensley

Madam Vice-President: My no vote on SB 39 simply reflects my continued and ded-
icated representation of the citizens of Wyandotte County which includes the members of
the Kansas City, Kansas School Board.--Sherman Jones

Madam Vice-President: I vote yes on the conference committee report on SB 39
because it successfully deals with revenue shortfalls while protecting education and impor-
tant social services for our most vulnerable citizens.

This compromise fully funds the base state aid per pupil increase of $50. It adds $3.6
million SGF dollars ($9.2 million all funds) to reduce or eliminate the waiting list for services
among our poor, frail and elderly population. It provides an additional $2 million SGF for
people in nursing homes. Nearly $15 million SGF ($33 million AF) is added to address the
growing number of poor needing Medicaid. These are mostly children.

I am astonished that the minority party is voting against this bill in a block. Surely in their
haste to be political, they have overlooked the fact that this bill is very important to the
education, health and well-being of Kansans from kindergarten to old age.

A good budget bill reflects the priorities of the body that crafts it. This bill clearly shows
those priorities. Sixty-four million dollars is cut from the current year's budget, while high
priority areas like education are protected. I proudly vote yes.--Dave Kerr

Senators Emert, Harrington, Jordan, Salmans and Umbarger request the record to show
they concur with the ``Explanation of Vote'' offered by Senator Kerr on SB 39.

Madam Vice-President: In a year when state revenues are short, and demands on
resources are growing, I am pleased and gratified that the legislature is able to keep our
commitment to the school children of Kansas by passing SB 39. This measure contains the
provision of the additional $50 per pupil which passed the body last year, and upon which
most school districts built their 99-00 budgets.

It is also important to me that this process was conducted in a timely manner, because
school districts could not wait longer to finalize their planning, and proceed with next year's
budget.--Barbara Lawrence

Senators Harrington, Salmans and Umbarger request the record to show they concur with
the ``Explanation of Vote'' offered by Senator Lawrence on SB 39.

Madam Vice-President: I vote no on SB 39. I support and voted for the elimination
of the Presidential Primary and keeping our promise to fund the $50 increase in the base
aide for K-12 education.

I cannot support cuts of $1.75 million in funding for mental health services for kids and
the homeless. Last session, we promised to help the most vulnerable Kansans, including
those Kansans afflicted with mental illness. This spending cut blatantly breaks that promise.

Kansans have a right to be safe in their homes and neighborhoods. By eliminating almost
$1 million from public safety programs, we are threatening the safety of Kansas citizens.
The Community Corrections grants and SRS Sexual Predator Program are important pro-
grams and I cannot support these cuts.

School districts from around the state have told us that they are having a hard time
providing special education. Last session, we pledged to help them fund special education.
This bill breaks that pledge with a $2.3 million cut in funding.

We need, as the Governor said, ``Patience to let the process work, to engage in full debate,
to calmly think our way through difficult moments.'' We did not use patience or allow our
constituents to be part of these debates. This is wrong and I must vote no.--Janis K. Lee

Madam Vice-President: Just think, it was almost two weeks ago that we were given
our only opportunity to speak on this bill. Imagine what we could have done with those two
weeks. Full, public hearings would have been held. Constituents would have had the op-
portunity to speak, and we, their elected representatives, would have had the opportunity
to investigate the true impact of these cuts.

Instead, a conference committee rubber stamps the Governor's proposal, and we move
on. Well, those affected will not move on. This bill makes damaging cuts to mental health
programs, special education, veterans, and public safety. This bill will effect our communities
in ways that we have failed to discuss.

I vote no on SB 39. I cannot, and will not, vote for a bill that has been denied public
comment, and that limited our ability to properly legislate. We have failed to fulfill our
responsibility to Kansas.--Marge Petty

Senators Downey and Stephens request the record to show they concur with the ``Expla-
nation of Vote'' offered by Senator Petty on SB 39.
