 The House met Session pro forma pursuant to adjournment with Speaker Jennison in the
chair.

PRESENTATION OF PETITIONS
   The following petitions were presented and filed:

    HP 2003, by Rep. O'Neal, a petition opposing the funding of abortions through tax
dollars, signed by Meredith McNaul and 74 others from Hutchinson and Reno County.

 HP 2004, by Gatewood, a petition urging state officials to consider the issue of traffic
control and a traffic signal at Baxter Spring High School, signed by Cathy Maskal and 678
other citizens of Baxter springs and others from Cherokee County.

 HP 2005, by Rep. Freeborn, a petition imploring the local, state, and federal government
leaders to safeguard vulnerable water supplies (such as the Equus Beds) from contamination,
including waste from confined animal feed lots, signed by Donna Hamel and 11 others.

INTRODUCTION OF BILLS AND CONCURRENT RESOLUTIONS
   The following bills were introduced and read by title:

   HB 2864, An act concerning public meetings and public records; amending K.S.A. 45-
215, 45-222 and 75-4320 and K.S.A. 1999 Supp. 75-4317 and repealing the existing sections,
by Committee on Local Government.

 HB 2865, An act concerning income taxation; providing a credit therefrom for certain
expenses incurred by food locker plants, by Committee on Agriculture.

 HB 2866, An act repealing K.S.A. 80-1201, 80-1202, 80-1203, 80-1204, 80-1205, 80-
1206, 80-1207 and 80-1208, concerning the eradication of prairie dogs, by Committee on
Agriculture.

 HB 2867, An act concerning crimes and punishment; relating to restitution; amending
K.S.A. 1999 Supp. 21-4603d and repealing the existing section, by Representatives Findley
and Sloan and Ballard, Flower and Tanner.

REFERENCE OF BILLS AND CONCURRENT RESOLUTIONS

CHANGE OF REFERENCE
   Speaker Jennison announced the withdrawal of HB 2843 from Committee on Education
and referral to Committee on Taxation.

REPORTS OF STANDING COMMITTEES
 The Committee on Utilities recommends HB 2597 be amended on page 3, in line 13,
by striking all after ``payments''; in line 14, by striking all before ``rates'' and inserting ``. If
annual payments are elected, such payments shall be based on current''; after line 24, by
inserting:

      ``Sec.  4. K.S.A. 55-1208 is hereby amended to read as follows: 55-1208. (a) When the
owner of an underground natural gas storage facility a natural gas public utility has
permanently abandoned the storage facility and that facility was an underground natural
gas storage facility certificated by the state corporation commission pursuant to K.S.A. 55-
1201 et seq., the owner and amendments thereto, the utility shall file with the commission
a notice of abandonment. If any such storage facility was certificated pursuant to federal
authority, the owner utility shall file a copy of any federal abandonment authority with the
commission. Unless such notice of abandonment authority has been filed with the
commission, there shall be a presumption that the storage facility and all rights associated
with it remain as certificated. In either case the owner utility shall file an instrument with
the register of deeds office in the appropriate county or counties, stating that such storage
has ceased and, except in cases in which the owner of the storage facility utility has
purchased the fee, that the ownership of all property acquired by the owner utility, both
mineral and surface, has reverted to those who owned the property at the time of the
acquisition or their heirs, successors or assigns.

      (b) The state corporation commission may conduct an administrative hearing pursuant
to the Kansas administrative procedures act upon application for abandonment of an
underground natural gas storage facility if such facility was certificated by the commission.

      Sec.  5. K.S.A. 55-1209 is hereby amended to read as follows: 55-1209. The owner of A
natural gas public utility owning an underground natural gas storage facility shall provide
to the state corporation commission and shall file with the register of deeds of each county
within which the facility is located a plat map identifying the location of such facility and a
description of the geological formation or formations to be used for storage.'';

      By renumbering the remaining sections accordingly;

      On page 4, in line 23, by striking ``not exceed the highest'' and inserting ``be based on
current''; after line 37, by inserting:

      ``(4) The compensation provided in subsection (c)(3) shall be exclusive of all other
remedies provided by law for the recovery of damages or compensation for the prior use of
a stratum, or affected portion thereof, and no other remedy under case law, common law
or statutes shall apply.'';

      On page 5, in line 3, before ``and'' by inserting ``, 55-1208, 55-1209''; in line 6, by striking
``statute book'' and inserting ``Kansas register'';

      In the title, in line 10, after ``55-1205'' by inserting ``, 55-1208, 55-1209''; and the bill be
passed as amended.

REPORT ON ENGROSSED BILLS
   Sub. HB 2290 reported correctly engrossed February 3, 2000.

   On motion of Rep. Weber, the House adjourned until 11:00 a.m., Monday, February 7,
2000.
