Friday, March 5, 1999--9:00 a.m.
 The Senate was called to order by President Dick Bond.

 The roll was called with thirty-four senators present.

 Senators Bleeker, Corbin, Hardenburger, Jones, Oleen and Petty were excused.

 President Bond introduced and welcomed Governor Graves and Rev. Dr. Lloyd Ogilvie,
Chaplain of the U.S. Senate. Dr. Ogilvie, distinguished author and biblical scholar, and
speaker for the early morning Governor's Prayer Breakfast, brought remarks to the Senate
and delivered the invocation:

        Almighty God, we echo Daniel's gratitude, ``I thank You and praise You, O God of
      my fathers; You have given me wisdom and might'' (Daniel 2:23). We need both of
      these gifts as we come to the end of this week and the challenges of this day. Thank
      You for the spiritual gift of wisdom that gives us x-ray penetration into the issues
      before us. Wisdom comes from listening to You and being open to others who have
      opened their minds to You. Thank You for the divine discernment that comes from
      talking to You before we talk publicly. Give us Your perspective. Reveal Your will.
      Then multiply Your gift of wisdom with might, the courage of our convictions, and
      the boldness to stand for Your truth.

         Oh God, give this Senate men and women like Daniel who know they belong to
      You, who seek Your supernatural wisdom, who base their leadership on Your values,
      and who have Your character traits of faithfulness, righteousness, and truthfulness.
      Bless them as You have blessed lodestar leaders in each period of our history. May
      this be a great day when Your wisdom and might are expressed with undeniable
      vigor. Through our Lord and Savior. Amen.

PRESENTATION OF PETITIONS
 The following petition was presented, read and filed:

   SP 9, a petition opposing the upgrade of existing Highway 59 and supporting the proposed
building of an Eastern Alignment Freeway between Lawrence and Ottawa, signed by Bonnie
McConnell Smith and 167 other Kansas citizens residing between Lawrence and Ottawa.

INTRODUCTION OF BILLS AND CONCURRENT RESOLUTIONS
 The following bill was introduced and read by title:

   SB 346, An act regulating traffic; providing penalties for certain overweight vehicles;
amending K.S.A. 1998 Supp. 8-1901 and repealing the existing section; also repealing K.S.A.
8-1342, by Committee on Federal and State Affairs.

REFERENCE OF BILLS AND CONCURRENT RESOLUTIONS
 The following bills and resolution were referred to Committees as indicated:

   Assessment and Taxation: HB 2099.

 Education: SCR 1613.

 Elections and Local Government: HB 2337.

CHANGE OF REFERENCE
 The President withdrew SB 168 from the calendar under the heading of General Orders,
and rereferred the bill to the Committee on Judiciary.

COMMUNICATIONS FROM STATE OFFICERS
    KANSAS DEPARTMENT OF SOCIAL
AND REHABILITATION SERVICES
    March 1, 1999
   Teresa Markowitz, former Commissioner of Children and Family Services, prepared the
attached report to inform the Senate of the status of the Kansas child welfare initiatives as
of December 31, 1998, submitted by Joyce Allegrucci, Commissioner, Commission of
Children and Family Services.

    THE UNIVERSITY OF KANSAS
     Robert E. Hemenway, Chancellor, University of Kansas, submitted the University of
Kansas 1998 Annual Report.

 The President announced the above reports are on file in the office of the Secretary of
the Senate and are available for review at any time.

INTRODUCTION OF ORIGINAL MOTIONS AND SENATE RESOLUTIONS
 Senator Clark introduced the following Senate resolution, which was read:

      SENATE RESOLUTION No. 1830--

    A  RESOLUTION congratulating and commending the Colby Community College
wrestling team.


      WHEREAS,  The Colby Community College wrestling team is the 1999 National Junior
College Athletic Association wrestling champion; and

      WHEREAS,  The wrestling team won its first national title at the national wrestling
tournament held at Rochester, Minnesota, on February 20, 1999. The team scored a total
of 129 points. Perennial junior college wrestling powers North Idaho College and Lassen
College of California scored 88 1/2 and 86 points, respectively. Team members and individual
results are as follows:

Daniel Cormier was the national champion for the second consecutive year; and

      WHEREAS,  The Colby Community College wrestling team is coached by Head Coach
Steve Lampe, who was named the national coach of the year, and Assistant Coach Jason
Reed; and

      WHEREAS,  The Colby Community College wrestling team, in winning its first national
championship, has brought great honor to the team members, the college, community and
state, and the people of the State of Kansas feel great pride in this accomplishment: Now,
therefore,

      Be it resolved by the Senate of the State of Kansas: That we congratulate and commend
Coaches Lampe and Reed and the members of the 1999 Colby Community College
wrestling team upon being the 1999 National Junior College Athletic Association wrestling
champion; and

      Be it further resolved: That the Secretary of the Senate be directed to provide 10
enrolled copies of this resolution to Mikel Ary, President, Colby Community College, 1255
S. Range, Colby, Kansas 67701.

   On emergency motion of Senator Clark SR 1830 was adopted unanimously.

REPORTS OF STANDING COMMITTEES
 Committee on Utilities recommends SB 257 be amended by substituting a new bill as
recommended by the Senate Committee on Utilities as reported in the Journal of the Senate
on February 24, 1999, and the substitute bill be amended by substituting a new bill to be
designated as ``Substitute for Substitute for SENATE BILL No. 257,'' as follows:

    ``Substitute for Substitute for SENATE BILL No. 257
  By Committee on Utilities


``AN  ACT concerning electric transmission lines; amending K.S.A. 66-1,177 and repealing
      the existing section; also repealing K.S.A. 66-1,178, 66-1,179, 66-1,180, 66-1,181 and
      66-1,182.'';

                and the substitute bill be passed.

REPORT ON ENROLLED BILLS
 SB 122 reported correctly enrolled, properly signed and presented to the Governor on
March 5, 1999.

 SR 1829 reported correctly enrolled, properly signed and presented to the Secretary of
the Senate on March 5, 1999.

   On motion of Senator Emert the Senate adjourned until 2:30 p.m., Monday, March 8,
1999.
