 In accordance with the provisions of the Constitution of the State of Kansas and by virtue
of his office as President of the Senate, Senator Dick Bond declared the 1999 Senate to be
in session.

 President Bond welcomed the Reverend Fred S. Hollomon, pastor of Highland Park
Southern Baptist Church, Topeka, Kansas, who is returning as chaplain of the Senate.

 Invocation by Chaplain Hollomon:

     Heavenly Father,

 We are about to embark on a 90 day journey. Two of us are making it for the first time,
the rest of us have taken the trip before  .  .  .  .  some of us many times.

 It's sort of like a long bus ride, O God. You put 40 people on a bus for 90 days and all
kinds of things happen.

 We will travel rather slowly for a couple of weeks, taking in the scenery and studying our
maps. Our destination is a place called sine die. Soon we will realize we are going to have
to speed up if we are to get there on time. Along the way we will have disagreements
concerning the best route to take. Some days we will encounter frustrating detours and dead
end streets, not to mention pot holes and orange barrels.

 Whether or not we arrive at our destination depends on who the driver is. Keep reminding
us, O God, to let You do the driving. If we decide to take turns driving, or argue with the
driver, or forget who the driver is, we will probably get lost or have a wreck.

 Lord, please don't get off the bus and leave the driving to us!

INTRODUCTIONS
 President Bond introduced Dr. Joel Hornung, President of the Kansas Academy of Family
Physicians. Dr. Hornung is in private practice in Council Grove. The Academy sponsors the
doctor of the day program and provides daily assistance for health concerns in the Capitol
during the session.

 Highway Patrol serving the Senate are Second Lieutenant Don Cackler, who is returning
again this year and was recognized, and Trooper Mark Engholm, who was not on the Senate

    SENATE CONCURRENT RESOLUTION No. 1601--

By Special Committee Redistricting Advisory Group
A  PROPOSITION to amend section 1 of article 10 of the constitution of the state of Kansas,
relating to the reapportionment of senatorial and representative districts.
Be it resolved by the Legislature of the State of Kansas, two-thirds of the members elected
(or appointed) and qualified to the Senate and two-thirds of the members elected (or ap-
pointed) and qualified to the House of Representatives concurring therein:

      Section  1. The following proposition to amend the constitution of the state of Kansas
shall be submitted to the qualified electors of the state for their approval or rejection: Section
1 of article 10 of the constitution of the state of Kansas is hereby amended to read as follows:

      ``§  1. Reapportionment of senatorial and representative districts. (a) At its regular
session in 1989, the legislature shall by law reapportion the state representative districts,
the state senatorial districts or both the state representative and senatorial districts upon the
basis of the latest census of the inhabitants of the state taken by authority of chapter 61 of
the 1987 Session Laws of Kansas. At its regular session in 1992, and at its regular session
every tenth year thereafter, the legislature shall, by law, shall reapportion the state senatorial
districts and representative districts on the basis of the population of the state as established
by the most recent census of population taken and published by the United States bureau
of the census. Senatorial and representative districts shall be reapportioned upon the basis
of the population of the state adjusted: (1) To exclude nonresident military personnel sta-
tioned within the state and nonresident students attending colleges and universities within
the state; and (2) to include military personnel stationed within the state who are residents
of the state and students attending colleges and universities within the state who are resi-
dents of the state in the district of their permanent residence. Bills reapportioning legislative
districts shall be published in the Kansas register immediately upon final passage and shall
be effective for the next following election of legislators and thereafter until again
reapportioned.

      (b) Within 15 days after the publication of an act reapportioning the legislative districts
within the time specified in (a), the attorney general shall petition the supreme court of the
state to determine the validity thereof. The supreme court, within 30 days from the filing
of the petition, shall enter its judgment. Should the supreme court determine that the
reapportionment statute is invalid, the legislature shall enact a statute of reapportionment
conforming to the judgment of the supreme court within 15 days.

      (c) Upon enactment of a reapportionment to conform with a judgment under (b), the
attorney general shall apply to the supreme court of the state to determine the validity
thereof. The supreme court, within 10 days from the filing of such application, shall enter
its judgment. Should the supreme court determine that the reapportionment statute is in-
valid, the legislature shall again enact a statute reapportioning the legislative districts in
compliance with the direction of and conforming to the mandate of the supreme court
within 15 days after entry thereof.

      (d) Whenever a petition or application is filed under this section, the supreme court, in
accordance with its rules, shall permit interested persons to present their views.

      (e) A judgment of the supreme court of the state determining a reapportionment to be
valid shall be final until the legislative districts are again reapportioned in accordance
herewith.''

      Sec.  2. The following statement shall be printed on the ballot with the amendment as
a whole:


            ``Explanatory statement. The purpose of this amendment is to eliminate the adjustment
            of census taken by the United States bureau of the census regarding nonresident
            military personnel and nonresident students when reapportioning the Kansas senate
            and house of representatives.

            ``A vote for this proposition would eliminate the adjustment of census taken by the
            United States bureau of the census regarding nonresident military personnel and
            nonresident students when reapportioning the Kansas senate and house of
            representatives.

            ``A vote against this proposition would continue in effect the requirement for the ad-
            justment of census taken by the United States bureau of the census regarding non-
            resident military personnel and nonresident students when reapportioning the Kan-
            sas senate and house of representatives.''

            Sec.  3. This resolution, if approved by two-thirds of the members elected (or appointed)
and qualified to the Senate, and two-thirds of the members elected (or appointed) and
qualified to the House of Representatives shall be entered on the journals, together with
the yeas and nays. The secretary of state shall cause this resolution to be published as
provided by law and shall cause the proposed amendment to be submitted to the electors
of the state at the general election in April in the year 1999 unless a special election is called
at a sooner date by concurrent resolution of the legislature, in which case it shall be sub-
mitted to the electors of the state at the special election.

SENATE CONCURRENT RESOLUTION No. 1602--

By Special Committee on Rail Transportation


      A  CONCURRENT  RESOLUTION urging the secretary of the United States department
      of agriculture to provide greater opportunities to the farmers of the United States by
      taking greater advantage of the export enhancement program.

            WHEREAS,  If the Kansas farmer is to have the opportunity to prosper and grow, the
agricultural products produced by the farmer must be able to reach foreign markets; and

      WHEREAS,  the export enhancement program is one tool which can expand foreign
market opportunities; and

      WHEREAS,  the stockpiling of grain is just one example of where the lack of access to
foreign markets hurts not only the Kansas farmer but all American farmers and the economy
of the United States in general: Now, therefore,

      Be it resolved by the Senate of the State of Kansas, the House of Representatives concurring
therein: That the secretary of the United States department of agriculture is urged to take
greater advantage of the export enhancement program; and

      Be it further resolved: That the Secretary of State be directed to send enrolled copies
of this resolution to the Secretary of the United States Department of Agriculture and to
each member of the Kansas Congressional Delegation.

SENATE CONCURRENT RESOLUTION No. 1603--

By Special Committee on Information Management
A  CONCURRENT  RESOLUTION urging Congress to pass the Freedom and Privacy
Restoration Act of 1998.
      WHEREAS,  The Federal Illegal Immigration Reform and Immigration Responsibility
Act requires that state issued drivers' licenses and nondriver identification cards must con-
tain the holder's social security number or that the state must verify with the Social Security
Administration the social security number of each applicant for a license or identification
card; and

      WHEREAS,  This requirement violates the rights protected by the Tenth Amendment
to the Constitution of the United States and violates Section 7 of the Privacy Act of 1974
(P.L. 93-579); and

      WHEREAS,  The costs to the states to implement this requirement is an unfunded fed-
eral mandate; and

      WHEREAS,  This requirement of the Federal Illegal Immigration Reform and Immi-
gration Responsibility Act raises serious concerns regarding establishment of a system of
national identification numbers and national identification cards; and

      WHEREAS,  The Freedom and Privacy Restoration Act of 1998 would prohibit this griev-
ous and onerous requirement: Now, therefore,

      Be it resolved by the Senate of the State of Kansas, the House of Representatives concurring
therein: That the Legislature of the State of Kansas strongly urges the Congress of the
United States to enact the Freedom and Privacy Restoration Act of 1998; and

      Be it further resolved: That the Secretary of State is directed to send enrolled copies of
this resolution to each member of the Kansas Congressional Delegation.

SENATE CONCURRENT RESOLUTION No. 1604--

A CONCURRENT RESOLUTION relating to a committee to inform the governor that
      the two houses of the legislature are duly organized and ready to receive
      communications.

     

 Be it resolved by the Senate of the State of Kansas, the House of Representatives concurring
therein: That a committee of two members from the Senate and three members from the
House of Representatives be appointed to wait upon the governor, and inform the governor
that the two houses of the legislature are duly organized and are ready to receive any
communications the governor may have to present.

 On emergency motion of Senator Emert, SCR 1604 was adopted by voice vote.

 In compliance with SCR 1604, President Bond appointed Senator Hardenburger and
Senator Steineger as Senate members of the committee to notify the Governor the Senate
is organized.

INTRODUCTION OF ORIGINAL MOTIONS AND SENATE RESOLUTION

The Special Committee on Information Management introduced the following Senate
resolution, which was read:

SENATE RESOLUTION No. 1803--

By Special Committee on Information Management
A RESOLUTION requiring the Attorney General to bring suit challenging
      the provisions of Section 656(b) of P.L. 104-208.

 WHEREAS, Section 656(b) of the federal Illegal Immegration Reform and Immigrant
Responsibility Act of 1996 (P.L. 104-208) requires that state issued drivers' licenses and
nondriver identification cards must contain the holder's social security number or that the
state must verify with the Social Security Administration the social security number of each
applicant for a license or identification card: and
 WHEREAS, This requirement violates the rights protected by the Tenth Amendment to
the Constitution of the United States and violates Section 7 of the Privacy Act of 1974 (P.L.
93-579(: Now, therefore,  Be it resolved by the Senate of the State of Kansas: That, in accordance with K.S.A. 75-
702, the Attorney General of the State of Kansas is hereby required to file and prosecute
an action challenging the legality of the provisions of Section 656(b) of P.L. 104-208.
