11             AN ACT making and concerning appropriations for the fiscal years ending
12             June 30, 2000, and June 30, 2001; authorizing certain transfers and
13             fees, imposing certain restrictions and limitations and directing or au-
14             thorizing certain receipts, disbursements, capital improvements and
15             acts incidental to the foregoing; amending K.S.A. 1999 Supp. 79-
16             34,147, as amended by section 106 of 2000 House Substitute for Sen-
17             ate Bill No. 326, and repealing the existing section.

19       Be it enacted by the Legislature of the State of Kansas:
20        Section 1. (a) For the fiscal years ending June 30, 2000, and June 30,
21       2001, appropriations are hereby made, restrictions and limitations are
22       hereby imposed, and transfers, fees, receipts, disbursements, and acts
23       incidental to the foregoing are hereby directed or authorized as provided
24       in this act.
25        (b) The agencies named in this act are hereby authorized to initiate
26       and complete the capital improvement projects specified and authorized
27       by this act or for which appropriations are made by this act, subject to
28       the restrictions and limitations imposed by this act.
29        (c) This act shall be known and may be cited as the omnibus appro-
30       priation act of 2000 and shall constitute the omnibus reconciliation spend-
31       ing limit bill for the 2000 regular session of the legislature for purposes
32       of subsection (a) of K.S.A. 75-6702 and amendments thereto.
33        (d) The appropriations made by this act shall not be subject to the
34       provisions of K.S.A. 46-155 and amendments thereto.
35        Sec. 2.
36      
STATE TREASURER
37        (a) There is appropriated for the above agency from the state general
38       fund for the fiscal year or years specified, the following:
39       Operating expenditures
40       For the fiscal year ending June 30, 2000 $10,000
41       Postsecondary education savings program
42       For the fiscal year ending June 30, 2001 $133
43        (b) On July 1, 2000, the $1,728,882 appropriated for the above agency

  1       for the fiscal year ending June 30, 2001, by section 9(a) of 2000 House
  2       Substitute for Senate Bill No. 326 from the state general fund in the
  3       operating expenditures account, the sum of $295,692 is hereby lapsed.
  4        (c) There is appropriated for the above agency from the following spe-
  5       cial revenue fund or funds for the fiscal year or years specified, all moneys
  6       now or hereafter lawfully credited to and available in such fund or funds,
  7       except that expenditures other than refunds authorized by law shall not
  8       exceed the following:
  9       Postsecondary education savings program expense fund

11        Sec. 3.

DEPARTMENT OF ADMINISTRATION
13        (a) There is appropriated for the above agency from the state general
14       fund for the fiscal year or years specified, the following:

16       For the fiscal year ending June 30, 2001 $9,040
17       Long-term care ombudsman
18       For the fiscal year ending June 30, 2001 $1,071
19       Performance review board
20       For the fiscal year ending June 30, 2001 $1,798
21        (b) On July 1, 2000, of the $16,836,819 appropriated for the above
22       agency for the fiscal year ending June 30, 2001, by section 20(a) of 2000
23       House Substitute for Senate Bill No. 326 from the state general fund in
24       the department of administration operations account, the sum of $77,371
25       is hereby lapsed.
26        (c) There is appropriated for the above agency from the following spe-
27       cial revenue fund or funds for the fiscal year or years specified, all moneys
28       now or hereafter lawfully credited to and available in such fund or funds,
29       except that expenditures other than refunds authorized by law shall not
30       exceed the following:
31       Capitol restoration project revenue fund
32       For the fiscal year ending June 30, 2001 No limit
33       Provided, That the department of administration may make expenditures
34       from the capitol restoration project revenue fund for the capital improve-
35       ment project to construct, equip, furnish, renovate, reconstruct and repair
36       the state capitol: Provided, however, That expenditures from this fund
37       for such capital improvement project shall not exceed $40,000,000, plus
38       all amounts required for costs of bond issuance, costs of interest on the
39       bonds issued for such capital improvement project during the construc-
40       tion of the project and any required reserves for the payment of principal
41       and interest on the bonds: Provided further, That such capital improve-
42       ment project is hereby approved for the department of administration for
43       the purposes of subsection (b) of K.S.A. 74-8905 and amendments thereto

  1       and the authorization of the issuance of bonds by the Kansas development
  2       finance authority in accordance with that statute: And provided further,
  3       That all moneys received from the issuance of any such bonds shall be
  4       deposited in the state treasury to the credit of this fund.
  5       Public broadcasting digital television fund
6       For the fiscal year ending June 30, 2001 No limit
  7       Provided, That the department of administration may make expenditures
  8       from the public broadcasting digital television fund for capital improve-
  9       ment projects and equipment acquisition for the conversion of public
10       television stations to digital broadcasting: Provided, however, That ex-
11       penditures from this fund for such capital improvement projects and
12       equipment acquisition shall not exceed $6,000,000, plus all amounts re-
13       quired for costs of bond issuance, costs of interest on the bonds issued
14       for such capital improvement projects and equipment acquisition during
15       the construction of such projects and acquisitions and any required re-
16       serves for the payment of principal and interest on the bonds: Provided
17       further, That such capital improvement projects and equipment acqui-
18       sition are hereby approved for the department of administration for the
19       purposes of subsection (b) of K.S.A. 74-8905 and amendments thereto
20       and the authorization of the issuance of bonds by the Kansas development
21       finance authority in accordance with that statute: And provided further,
22       That all moneys received from the issuance of any such bonds shall be
23       deposited in the state treasury to the credit of this fund: And provided
24       further, That any expenditures from this fund for capital improvement
25       projects or equipment acquisition for television station KCPT shall not
26       exceed the non-federal share of the estimated project cost multiplied by
27       the sum of Kansas resident viewers of television station KCPT divided by
28       all viewers of television station KCPT[: And provided further, That all
29       expenditures from this fund shall be used to match federal funding
30       for capital improvement projects and equipment acquisition for the
31       conversion of public television stations to digital broadcasting].
32        (d) On July 15, 2000, the director of accounts and reports shall transfer
33       $50,000 from the state emergency fund to the state general fund.
34        (e) On the effective date of this act, the expenditure limitation estab-
35       lished by section 42(b) of chapter 132 of the 1999 Session Laws of Kansas
36       on the motor pool service fund is hereby increased from $2,570,075 to
37       $2,994,357.
38        (f) On July 1, 2000, the expenditure limitation established by section
39       20(b) of 2000 House Substitute for Senate Bill No. 326 on the architec-
40       tural services recovery fund is hereby increased from $1,691,096 to
41       $1,694,540.
42        (g) In addition to the other purposes for which expenditures may be
43       made by the department of administration from the state buildings op-

  1       erating fund for fiscal year 2001 as authorized by section 20(b) of 2000
  2       House Substitute for Senate Bill No. 326, expenditures may be made by
  3       the above agency from the state buildings operating fund for fiscal year
  4       2001 for relocation of blind services and the Kansas industries for the
  5       blind: Provided, however, That such expenditures shall not be made ex-
  6       cept upon approval of the state finance council acting on this matter which
  7       is hereby characterized as a matter of legislative delegation and subject
  8       to the guidelines prescribed by subsection (c) of K.S.A. 75-3711c and
  9       amendments thereto.
10        (h) On July 1, 2000, the position limitation established by section 69(a)
11       of 2000 House Substitute for Senate Bill No. 326 for the department of
12       administration is hereby decreased from 884.4 to 870.4.
13        (i) On July 1, 2000, the director of accounts and reports shall transfer
14       $2,623,428 from the state general fund to the flexible spending fund.
15        Sec. 4.

DEPARTMENT OF REVENUE
17        (a) There is appropriated for the above agency from the state general
18       fund for the fiscal year or years specified, the following:
19       Operating expenditures
20       For the fiscal year ending June 30, 2000 $50,000
21       For the fiscal year ending June 30, 2001 $635,008
22        (b) On July 1, 2000, the position limitation established by section 69(a)
23       of 2000 House Substitute for Senate Bill No. 326 for the department of
24       revenue is hereby decreased from 1,157.0 to 1,156.0.
25        (c) On the effective date of this act, the expenditure limitation estab-
26       lished by section 22(b) of 2000 House Substitute for Senate Bill No. 326
27       on the division of vehicles operating fund is hereby increased from
28       $30,544,804 to $30,613,887.
29        Sec. 5.

FORT HAYS STATE UNIVERSITY
31        (a) There is appropriated for the above agency from the state general
32       fund for the fiscal year or years specified, the following:
33       Operating expenditures (including official hospitality)
34       For the fiscal year ending June 30, 2000 $1,863
35       For the fiscal year ending June 30, 2001 $3,693
36        (b) On the effective date of this act, the expenditure limitation estab-
37       lished by section 42(b) of 2000 Senate Bill No. 39 on the general fees
38       fund is hereby decreased from $8,239,479 to $8,237,616.
39        Sec. 6.

EMPORIA STATE UNIVERSITY
41        (a) On July 1, 2000, of the $29,378,363 appropriated for the above
42       agency for the fiscal year ending June 30, 2001, by section 45(a) of 2000
43       House Substitute for Senate Bill No. 326 from the state general fund in

  1       the operating expenditures (including official hospitality) account, the
  2       sum of $78,865 is hereby lapsed.
  3        (b) On the effective date of this act, of the $28,701,695 appropriated
  4       for the above agency for the fiscal year ending June 30, 2000, by section
  5       67(a) of chapter 132 of the 1999 Session Laws of Kansas from the state
  6       general fund in the operating expenditures (including official hospitality)
  7       account, the sum of $32,227 is hereby lapsed.
  8        (c) On July 1, 2000, the expenditure limitation established by section
  9       45(b) of 2000 House Substitute for Senate Bill No. 326 on the general
10       fees fund is hereby increased from $8,855,138 to $8,888,734.
11        (d) On the effective date of this act, the expenditure limitation estab-
12       lished by section 46(b) of 2000 Senate Bill No. 39 on the general fees
13       fund is hereby increased from $8,317,742 to $8,349,969.
14        Sec. 7.

PITTSBURG STATE UNIVERSITY
16        (a) There is appropriated for the above agency from the state general
17       fund for the fiscal year or years specified, the following:
18       Operating expenditures (including official hospitality)
19       For the fiscal year ending June 30, 2000 $74,765
20       For the fiscal year ending June 30, 2001 $107,448
21        (b) On the effective date of this act, the expenditure limitation estab-
22       lished by section 47(b) of 2000 Senate Bill No. 39 on the general fees
23       fund is hereby decreased from $10,497,103 to $10,422,338.
24        (c) On July 1, 2000, the expenditure limitation established by section
25       46(b) of 2000 House Substitute for Senate Bill No. 326 on the general
26       fees fund is hereby decreased from $11,159,978 to $11,048,357.
27        Sec. 8.

UNIVERSITY OF KANSAS MEDICAL CENTER
29        (a) On July 1, 2000, of the $98,539,396 appropriated for the above
30       agency for the fiscal year ending June 30, 2001, by section 48(a) of 2000
31       House Substitute for Senate Bill No. 326 from the state general fund in
32       the operating expenditures (including official hospitality) account, the
33       sum of $65,544 [$44,509] is hereby lapsed.
34        (b) On July 1, 2000, the expenditure limitation established by section
35       48(b) of 2000 House Substitute for Senate Bill No. 326 on the general
36       fees fund is hereby increased from $11,033,864 to $11,099,315.
37       Wahl hall renovation fund
38       For the fiscal year ending June 30, 2001 No limit
39       Provided, That the university of Kansas medical center may make ex-
40       penditures from the Wahl hall renovation fund for the capital improve-
41       ment project to construct, equip, furnish, renovate, reconstruct and repair
42       Wahl hall.
43        (c) On July 1, 2000, the expenditure limitation established by section

  1       48(b) of 2000 House Substitute for Senate Bill No. 326 on the general
  2       fees fund is hereby increased from $11,033,864 to $11,099,315.
  3        (d) In addition to the purposes for which expenditures may be made
  4       from the children's initiatives fund for fiscal year 2001, expenditures may
  5       be made by the above agency from the children's initiatives fund for fiscal
  6       year 2001 for the following specified purposes subject to the expenditure
  7       limitations prescribed therefor:
8       Children's initiatives fund--Telekid health care link $250,000
  9       Provided, That all expenditures by the above agency from the children's
10       initiatives fund for fiscal year 2001 from the children's initiatives fund--
11       Telekid health care link account shall be in addition to any expenditure
12       limitation imposed on the children's initiatives fund for fiscal year 2001.
13        Sec. 9.

STATE BOARD OF REGENTS
15        (a) There is appropriated for the above agency from the state general
16       fund for the fiscal year or years specified, the following:
17       Operating expenditures (including official hospitality)
18       For the fiscal year ending June 30, 2001 $150
19        (b) On July 1, 2000, of the $500,000 appropriated for the above agency
20       for the fiscal year ending June 30, 2001, by section 50(a) of 2000 House
21       Substitute for Senate Bill No. 326 from the state general fund in the
22       vocational education capital outlay aid account is hereby lapsed.
23        (c) On July 1, 2000, the expenditure limitation established by section
24       50(b) of 2000 House Substitute for Senate Bill No. 326 on the economic
25       development initiatives fund is hereby increased from $9,566,110 to
26       $10,066,110.
27        (d) On July 1, 2000, the expenditure limitation established by section
28       50(c) of 2000 House Substitute for Senate Bill No. 326 on the vocational
29       education capital outlay aid account of the economic development initia-
30       tives fund is hereby increased from $2,200,000 to $2,700,000.
31        (e) On July 15, 2000, or as soon thereafter as moneys are available, the
32       director of accounts and reports shall transfer $500,000 from the Kansas
33       economic development endowment account of the state economic de-
34       velopment initiatives fund of the department of commerce and housing
35       to the economic development initiatives fund of the state board of re-
36       gents.
37        Sec. 10.
38      
KANSAS, INC.
39        (a) On July 1, 2000, the expenditure limitation established by section
40       26(a) of 2000 House Substitute for Senate Bill No. 326 on the EDIF fund
41       is hereby increased from $377,137 to $377,949.
42        (b) On July 1, 2000, the expenditure limitation established by section
43       26(b) of 2000 House Substitute for Senate Bill No. 326 on the operations

  1       (including official hospitality) account of the EDIF fund is hereby in-
  2       creased from $377,137 to $377,949.
  3        (c) On July 15, 2000, or as soon thereafter as moneys are available, the
  4       director of accounts and reports shall transfer $812 from the Kansas ec-
  5       onomic development endowment account of the state economic devel-
  6       opment initiatives fund of the department of commerce and housing to
  7       the EDIF fund of Kansas, Inc.
  8        Sec. 11.
  9      
DEPARTMENT OF COMMERCE AND HOUSING
10        (a) On July 1, 2000, the expenditure limitation established by section
11       25(b) of 2000 House Substitute for Senate Bill No. 326 on the Kansas
12       economic development endowment account of the state economic de-
13       velopment initiatives fund is hereby increased from $16,061,331 to
14       $16,739,331.
15        (b) On July 1, 2000, the expenditure limitation established by section
16       25(c) of 2000 House Substitute for Senate Bill No. 326 on the Kansas
17       industrial training and Kansas industrial retraining program account of
18       the Kansas economic development endowment account of the state ec-
19       onomic development initiatives fund is hereby increased from $3,300,000
20       to $3,700,000.
21        (c) On July 1, 2000, the expenditure limitation established by section
22       25(c) of 2000 House Substitute for Senate Bill No. 326 on the tourism
23       grants account of the Kansas economic development endowment account
24       of the state economic development initiatives fund is hereby increased
25       from $852,100 to $1,130,100.
26        Sec. 12.

KANSAS TECHNOLOGY ENTERPRISE CORPORATION
28        (a) On July 1, 2000, the expenditure limitation established by section
29       27(a) of 2000 House Substitute for Senate Bill No. 326 on the economic
30       development research and development fund is hereby increased from
31       $12,523,562 to $13,276,926.
32        (b) On July 1, 2000, the expenditure limitation established by section
33       27(b) of 2000 House Substitute for Senate Bill No. 326 on the operations,
34       assistance and grants (including official hospitality) account of the eco-
35       nomic development research and development fund is hereby increased
36       from $12,523,562 to $13,276,926.
37        (c) On January 15, 2001, or as soon thereafter as moneys are available,
38       the director of accounts and reports shall transfer $503,364 from the
39       Kansas economic development endowment account of the state economic
40       development initiatives fund of the department of commerce and housing
41       to the economic development research and development fund of the Kan-
42       sas technology enterprise corporation.

  1        Sec. 13.
  2      
KANSAS PUBLIC EMPLOYEES RETIREMENT SYSTEM
  3        (a) On the effective date of this act, the expenditure limitation estab-
  4       lished for the fiscal year ending June 30, 2000, by section 17(a) of 2000
  5       Senate Bill No. 39 on the agency operations account of the Kansas public
  6       employees retirement fund is hereby increased from $4,918,994 to
  7       $4,986,334.
  8        (b) On the effective date of this act, the expenditure limitation estab-
  9       lished for the fiscal year ending June 30, 2000, by section 37(b) of chapter
10       132 of the 1999 Session Laws of Kansas on the bonus awards to unclas-
11       sified employees subaccount of the agency operations account of the Kan-
12       sas public employees retirement fund is hereby increased from $75,000
13       to $91,540.
14        (c) On the effective date of this act, the expenditure limitation estab-
15       lished for the fiscal year ending June 30, 2000, by section 17(b) of 2000
16       Senate Bill No. 39 on the investment related expenses account of the
17       Kansas public employees retirement fund is hereby decreased from
18       $26,644,408 to $26,011,735.
19        (d) On the effective date of this act, the expenditure limitation estab-
20       lished for the fiscal year ending June 30, 2000, by section 6(b) of chapter
21       160 of the 1999 Session Laws of Kansas on the technology project account
22       of the Kansas public employees retirement fund is hereby decreased from
23       $2,451,255 to $100,000.
24        (e) On July 1, 2000, the expenditure limitation established for the fiscal
25       year ending June 30, 2001, by section 15(b) of 2000 House Substitute for
26       Senate Bill No. 326 on the agency operations account of the Kansas public
27       employees retirement fund is hereby increased from $5,989,105 to
28       $6,100,616.
29        (f) On July 1, 2000, the expenditure limitation established for the fiscal
30       year ending June 30, 2001, by section 15(b) of 2000 House Substitute for
31       Senate Bill No. 326 on the bonus awards to unclassified employees su-
32       baccount of the agency operations account of the Kansas public employ-
33       ees retirement fund is hereby increased from $75,000 to $91,540.
34        (g) On July 1, 2000, the expenditure limitation established for the fiscal
35       year ending June 30, 2001, by section 15(b) of 2000 House Substitute for
36       Senate Bill No. 326 on the investment related expenses account of the
37       Kansas public employees retirement fund is hereby increased from
38       $26,876,393 to $26,909,271.
39        (h) There is appropriated for the above agency from the following spe-
40       cial revenue fund or funds for the fiscal year or years specified, all moneys
41       now or hereafter lawfully credited to and available in such fund or funds,
42       except that expenditures other than refunds authorized by law shall not
43       exceed the following:

  1       Senior services trust fund
2       For the fiscal year ending June 30, 2000 No limit
3       For the fiscal year ending June 30, 2001 No limit
  4        (i) In addition to the other purposes for which expenditures may be
  5       made by the above agency from the agency operations account of the
  6       Kansas public employees retirement fund for fiscal year 2000, as author-
  7       ized by section 37(b) of chapter 132 of the 1999 Session Laws of Kansas,
  8       or for fiscal year 2001, as authorized by section 15(b) of 2000 House
  9       Substitute for Senate Bill No. 326, expenditures may be made by the
10       above agency for fiscal year 2000 and fiscal year 2001 for the purpose of
11       paying fees and expenses associated with the search for a new executive
12       secretary pursuant to procedures established by the board of trustees of
13       the Kansas public employees retirement system: Provided, That any ex-
14       penditures for such purpose shall be in addition to any expenditure lim-
15       itation on the agency operations account of such fund for fiscal year 2000
16       and fiscal year 2001: Provided, however, That the aggregate amount of
17       expenditures for such fees and expenses for fiscal year 2000 and fiscal
18       year 2001 shall not exceed $50,000 for the two-year period.
19        (j) In addition to the other purposes for which expenditures may be
20       made by the above agency from the agency operations account of the
21       Kansas public employees retirement fund for the fiscal year ending June
22       30, 2001, as authorized by section 15(b) of 2000 House Substitute for
23       Senate Bill No. 326, expenditures may be made by the above agency for
24       fiscal year 2001 for the purpose of paying expenses associated with the
25       technology project as approved by the board of trustees of the Kansas
26       public employees retirement system: Provided, That any expenditures for
27       such purpose shall be in addition to any expenditure limitation on the
28       agency operations account of such fund: Provided, however, That the total
29       amount of expenditures for such expenses for fiscal year 2001 shall not
30       exceed $2,283,913: Provided further, That any contract negotiated for the
31       technology project shall be reviewed and approved by the chief infor-
32       mation technology officer of the executive branch who also shall consider
33       that the technology project is in compliance with the provisions of K.S.A.
34       75-7209 and amendments thereto.
35        Sec. 14.
36      
DEPARTMENT OF TRANSPORTATION
37        (a) On the effective date of this act, the expenditure limitation estab-
38       lished by section 69(a) of 2000 Senate Bill No. 39 on the agency opera-
39       tions account of the state highway fund is hereby decreased from
40       $206,946,902 to $206,900,035.
41        (b) On July 1, 2000, the position limitation established by section 69(a)
42       of 2000 House Substitute for Senate Bill No. 326 for the department of
43       transportation is hereby decreased from 3,247.5 to 3,240.5.

  1        (c) On July 1, 2000, the expenditure limitation established by section
  2       68(b) of 2000 House Substitute for Senate Bill No. 326 on the agency
  3       operations account of the state highway fund is hereby increased from
  4       $209,875,792 to $209,954,798.
  5        [(d) In addition to the other purposes for which expenditures may
  6       be made by the department of transportation from the state highway
  7       fund for the fiscal year 2001, as authorized by this or other appro-
  8       priation act of the 2000 regular session of the legislature, expendi-
  9       tures shall be made by the department of transportation from the
10       state highway fund for fiscal year 2001 for loans or grants to qual-
11       ified entities pursuant to the provisions of K.S.A. 75-5048, and
12       amendments thereto, in addition to such other terms and conditions,
13       the secretary of transportation shall require any qualified entity
14       receiving such loans or grants to maintain or to improve services
15       on such railroad line: Provided, That such qualified entity shall pro-
16       vide to the secretary of transportation demonstrable evidence of
17       improvements of services on such railroad line: Provided further,
18       That improvements in services shall include but shall not be limited
19       to, the rehabilitation of the track including rail, ties and roadbed,
20       the use of heavier weight rail, increased service to shippers, and any
21       other maintenance that improves services on such railroad line.]
22        Sec. 15.
23      
KANSAS RACING AND GAMING COMMISSION
24        (a) On the effective date of this act, the position limitation established
25       by section 90(a) of chapter 132 of the 1999 Session Laws of Kansas on
26       the Kansas racing and gaming commission--state racing operations is
27       hereby increased from 42.0 to 51.0.
28        (b) On July 1, 2000, the position limitation established by section 69(a)
29       of 2000 House Substitute for Senate Bill No. 326 for the Kansas racing
30       and gaming commission--state racing operations is hereby increased
31       from 43.0 to 52.0.
32        (c) On the effective date of this act, the expenditure limitation estab-
33       lished by section 26(a) of 2000 Senate Bill No. 39 on the state racing fund
34       is hereby increased from $3,283,383 to $3,423,383.
35        (d) On July 1, 2000, the expenditure limitation established by section
36       24(a) of 2000 House Substitute for Senate Bill No. 326 on the state racing
37       fund is hereby increased from $3,217,143 to $3,813,653.
38        (e) Notwithstanding the provisions of subsection (c) of K.S.A. 74-8826
39       and amendments thereto, and notwithstanding any agreements between
40       the director of accounts and reports and the executive director of the
41       state racing and gaming commission that set a $300,000 maximum amount
42       of reserve balance for the state racing fund, the state racing fund may
43       have an amount of not to exceed $440,000 as an unencumbered cash

  1       balance on June 30, 2000, and such unencumbered cash balance shall not
  2       be subject to transfer to the state gaming revenues fund for the fiscal year
  3       ending June 30, 2000.
  4        [(f) That notwithstanding the provisions of K.S.A. 74-8826 and
  5       amendments thereto, or any other provision of law to the contrary,
  6       no expenditures shall be made for a period of more than 90 days
  7       after the date of the start of simulcasting at the Camptown race
  8       track from the state racing fund for the fiscal years ending June 30,
  9       2000, and June 30, 2001, for the purpose of regulating simulcasting
10       at the Camptown race track located in Frontenac, Kansas, unless
11       revenues derived from live racing at the Camptown race track are
12       deposited in the state racing fund within 100 days of the start of
13       simulcasting.]
14        Sec. 16.
15      
KANSAS LOTTERY
16        (a) On July 1, 2000, the expenditure limitation established by section
17       23(a) of 2000 House Substitute for Senate Bill No. 326 on the lottery
18       operating fund is hereby increased from $8,998,099 to $9,010,196.
19        (b) On July 1, 2000, the provisions of section 23(b) of 2000 House
20       Substitute for Senate Bill No. 326 are hereby declared to be null and void
21       and shall have no force and effect.
22        (c) Notwithstanding the provisions of K.S.A. 74-8711 and amendments
23       thereto, each monthly transfer credited for the fiscal year ending June
24       30, 2001, from the lottery operating fund to the state gaming revenue
25       fund pursuant to subsection (d) of K.S.A. 74-8711 and amendments
26       thereto shall be an amount equal to not less than 30.00% of total monthly
27       revenues from the sales of lottery tickets and shares less estimated re-
28       turned tickets.
29        Sec. 17.

SECRETARY OF STATE
31        (a) There is appropriated for the above agency from the state general
32       fund for the fiscal year or years specified, the following:

21       general fund in the mental health and retardation services aid and assis-
22       tance and state institutions operations account, the sum of $104,969 is
23       hereby lapsed.
24        (e) On July 1, 2000, of the $113,497,604 appropriated for the above
25       agency for the fiscal year ending June 30, 2001, by section 33(a) of 2000

14       Grant to Horizon health plan fund
15       For the fiscal year ending June 30, 2001 $1,000,000
16       Provided, That all expenditures from the grant to Horizon health plan
17       fund shall be for a grant to Horizon Health Plan, Inc., a Kansas domestic
18       health maintenance organization, to provide a donation of financial aid to
19       assist the grantee in satisfying the claims of Kansas hospitals and other
20       health care providers which provided health care services under title XIX
21       or title XXI of the federal social security act to Kansans through Horizon
22       Health Plan, Inc., in accordance with the plan for liquidation approved
23       and entered as an final order of the district court in the case entitled IN
24       THE MATTER OF THE LIQUIDATION OF HORIZON HEALTH
25       PLAN, INC., Case No. 99-C-1802: Provided further, That the grant to
26       Horizon Health Plan, Inc., shall not constitute the assumption by the state
27       of Kansas of any liability or responsibility for the liabilities, activities or
28       operations of Horizon Health Plan, Inc., or any other claims or possible
29       causes of action against Horizon Health Plan, Inc., whatsoever.
30        (g) On July 1, 2000, the expenditure limitation established by section
31       33(b) of 2000 House Substitute for Senate Bill No. 326 on the HCBS
32       programs fund is hereby increased from $800,000 to $6,000,000.
33        (h) On July 1, 2000, or as soon thereafter as moneys are available, the
34       director of accounts and reports shall transfer $2,600,000 from the flexible
35       spending fund of the department of administration to the flexible spend-
36       ing fund--HCBS/PD waiver of the department of social and rehabilita-
37       tion services: Provided, That no transfer shall be made under this sub-
38       section except upon approval of the state finance council acting on this
39       matter which is hereby characterized as a matter of legislative delegation
40       and subject to the guidelines prescribed in subsection (c) of K.S.A. 75-
41       3711c and amendments thereto and acting on this matter after receiving
42       the certification of the director of the budget that sufficient moneys are
43       not available in the flexible spending fund pursuant to the intergovern-

  1       mental transfer program.
  2        (i) On July 1, 2000, or as soon thereafter as moneys are available, the
  3       director of accounts and reports shall transfer $17,790 from the flexible
  4       spending fund of the department of administration to the flexible spend-
  5       ing fund--nursing facilities quality enhancement wage pass- through pur-
  6       suant to 1999 Senate Bill No.126 (K.S.A. 1999 Supp. 39-971) of the de-
  7       partment of social and rehabilitation services: Provided, That no transfer
  8       shall be made under this subsection except upon approval of the state
  9       finance council acting on this matter which is hereby characterized as a
10       matter of legislative delegation and subject to the guidelines prescribed
11       in subsection (c) of K.S.A. 75-3711c and amendments thereto and acting
12       on this matter after receiving the certification of the director of the budget
13       that sufficient moneys are available in the flexible spending fund pursuant
14       to the intergovernmental transfer program.
15        (j) (1) In addition to the other purposes for which expenditures may
16       be made by the department of social and rehabilitation services from the
17       youth services aid and assistance account of the state general fund for the
18       fiscal year ending June 30, 2000, and June 30, 2001, by this or other
19       appropriation act of the 2000 regular session of the legislature, expendi-
20       tures shall be made from the youth services aid and assistance account of
21       the state general fund for fiscal years 2000 and 2001 for the secretary of
22       social and rehabilitation services (SRS) to provide assistance to contrac-
23       tors by accelerating contractual payments which are owed or will be owed
24       by SRS under the terms of fiscal year 2000 contracts: Provided, That the
25       secretary of SRS shall work with each contractor to assure that such ac-
26       celerated payments are used to pay any existing delinquent accounts con-
27       tractors have with the subcontractors: Provided further, That the secre-
28       tary of SRS shall assure that payments by SRS to such contractors for
29       foster care and adoption contractors are paid in the time period pre-
30       scribed by subsection (b) of K.S.A. 75-6403, and amendments thereto, to
31       facilitate steady cash flow for the contractors and their ability to maintain
32       timely payments to their subcontractors: And provided further, That SRS
33       shall maintain regular monitoring of their contractors' business activities,
34       including but not limited to, the status of their payments to their subcon-
35       tractors: And provided further, That should any SRS contractor regularly
36       fail to maintain timely reimbursement to their subcontractors, SRS shall
37       require the development of a corrective action plan by such contractor:
38       And provided further, That continued failure by an SRS contractor to
39       make timely payments to subcontractors after the implementation of a
40       corrective action plan may be the basis for SRS seeking new bids for that
41       contractor's area of responsibility.
42        (2) As used in this subsection:
43        (A) ``Subcontractor'' means a qualified entity providing adoption or

  1       foster care services pursuant to a contract with a contractor.
  2        (B) ``Contractor'' means an entity providing adoption or foster care
  3       service pursuant to a contract with the department of social and rehabil-
  4       itation services.
  5        (k) On the effective date of this act, of the amounts specified in section
  6       34(m) of 2000 Senate Bill No. 39 as being included in the mental health
  7       and retardation services aid and assistance and state institutions opera-
  8       tions account of the state general fund for the following institutions for
  9       the fiscal year ending June 30, 2000, are hereby changed to the amounts
10       specified, but expenditures from the mental health and retardation serv-
11       ices aid and assistance and state institutions operations account of the
12       state general fund for any such institution shall not be limited to, or be
13       required to be made in, the amount listed for the institution, as follows:
14       (1) The amount for Kansas neurological institute is hereby decreased from
15       $7,640,245 to $7,633,917; (2) the amount for Larned state hospital is
16       hereby decreased from $11,210,786 to $11,199,279; (3) the amount for
17       Osawatomie state hospital is hereby decreased from $5,790,631 to
18       $5,775,055; (4) the amount for Parsons state hospital and training center
19       is hereby decreased from $5,799,369 to $5,782,829; and (5) the amount
20       for Rainbow mental health facility is hereby decreased from $719,111 to
21       $705,996.
22        (l) On the effective date of this act, the expenditure limitation estab-
23       lished by section 55(b) of chapter 132 of the 1999 Session Laws of Kansas
24       on the Osawatomie state hospital fee fund is hereby decreased from
25       $1,943,508 to $1,927,933.
26        (m) On the effective date of this act, the expenditure limitation estab-
27       lished by section 55(b) of chapter 132 of the 1999 Session Laws of Kansas
28       on the Parsons state hospital and training center fee fund is hereby de-
29       creased from $793,081 to $777,682.
30        (n) On July 1, 2000, of the $8,517,075 appropriated for the above
31       agency for the fiscal year ending June 30, 2001, by section 33(a) of 2000
32       House Substitute for Senate Bill No. 326 from the state general fund in
33       the Kansas neurological institute--operating expenditures account, the
34       sum of $24,487 is hereby lapsed.
35        (o) On July 1, 2000, of the $1,333,972 appropriated for the above
36       agency for the fiscal year ending June 30, 2001, by section 33(a) of 2000
37       House Substitute for Senate Bill No. 326 from the state general fund in
38       the Rainbow mental health facility--operating expenditures account, the
39       sum of $12,733 is hereby lapsed.
40        (p) On July 1, 2000, the expenditure limitation established by section
41       33(b) of 2000 House Substitute for Senate Bill No. 326 on the Larned
42       state hospital fee fund is hereby decreased from $3,293,118 to $3,224,006.
43        (q) On July 1, 2000, the expenditure limitation established by section

10       institute is hereby decreased from 662.5 to 655.5.
11        (t) On July 1, 2000, the position limitation established by section 69(a)
12       of 2000 House Substitute for Senate Bill No. 326 for Larned state hospital
13       is hereby decreased from 760.6 to 741.8.
14        (u) On July 1, 2000, the position limitation established by section 69(a)
15       of 2000 House Substitute for Senate Bill No. 326 for Osawatomie state
16       hospital is hereby decreased from 481.4 to 477.4.
17        (v) On July 1, 2000, the position limitation established by section 69(a)
18       of 2000 House Substitute for Senate Bill No. 326 for Parsons state hos-
19       pital and training center is hereby decreased from 516.0 to 513.0.
20        (w) In addition to the other purposes for which expenditures may be
21       made by the department of social and rehabilitation services from any
22       moneys appropriated from the state general fund or any special revenue
23       fund for the fiscal year ending June 30, 2000, as authorized by any ap-
24       propriation act of the 1999 regular session of the legislature or by this or
25       other appropriation act of the 2000 regular session of the legislature,
26       expenditures shall be made by the department of social and rehabilitation
27       services from any such moneys appropriated for fiscal year 2000 for the
28       receipt, crediting and disbursement of moneys received by the depart-
29       ment of social and rehabilitation services for payments of support pur-
30       suant to a rule or administrative order issued by the Kansas supreme
31       court, which is hereby authorized to be issued by the Kansas supreme
32       court, directing payments of support, which are made pursuant to any
33       court order entered in this state regardless of the date of the order, to be
34       made to a central unit for the collection and disbursement of support
35       payments, notwithstanding the provisions of any statute to the contrary.
36        (x) In addition to the other purposes for which expenditures may be
37       made from the children's initiatives fund for fiscal year 2001, expenditures
38       may be made by the above agency from the children's initiatives fund for
39       fiscal year 2001 for the following specified purposes subject to the ex-
40       penditure limitations prescribed therefor:
41       Children's initiatives fund--children's mental healthwaiver $1,000,000
42       Provided, That all expenditures by the above agency from the children's

  1       initiatives fund for fiscal year 2001 from the children's initiatives fund--
  2       children's mental health waiver account shall be in addition to any ex-
  3       penditure limitation imposed on the children's initiatives fund for fiscal
  4       year 2001.
5       Children's initiatives fund--family centered system ofcare $5,000,000
  6       Provided, That all expenditures by the above agency from the children's
  7       initiatives fund for fiscal year 2001 from the children's initiatives fund--
  8       family centered system of care account shall be in addition to any ex-
  9       penditure limitation imposed on the children's initiatives fund for fiscal
10       year 2001.
11       Children's initiatives fund--HCBS/MR waiver $3,000,000
12       Provided, That all expenditures by the above agency from the children's
13       initiatives fund for fiscal year 2001 from the children's initiatives fund--
14       HCBS/MR waiver account shall be in addition to any expenditure limi-
15       tation imposed on the children's initiatives fund for fiscal year 2001.
16       Children's initiatives fund--HCBS/PD waiver $1,800,000
17       Provided, That all expenditures by the above agency from the children's
18       initiatives fund for fiscal year 2001 from the children's initiatives fund--
19       HCBS/PD waiver account shall be in addition to any expenditure limi-
20       tation imposed on the children's initiatives fund for fiscal year 2001.
21        (y) (1) On July 1, 2000, the director of accounts and reports shall trans-
22       fer all moneys credited as of June 30, 2000, in the Kansas endowment for
23       youth fund--children's mental health waiver account of the Kansas en-
24       dowment for youth fund to the children's initiatives fund. On July 1, 2000,
25       and after such transfer, (A) all encumbrances and other liabilities of the
26       Kansas endowment for youth fund--children's mental health waiver ac-
27       count of the Kansas endowment for youth fund are hereby transferred to
28       and imposed upon the children's initiatives fund, (B) the Kansas endow-
29       ment for youth fund--children's mental health waiver account of the
30       above agency in the Kansas endowment for youth fund is hereby abol-
31       ished, and (C) any appropriation of moneys in the Kansas endowment for
32       youth fund--children's mental health waiver account of the Kansas en-
33       dowment for youth fund for the above agency for the fiscal year ending

21       any appropriation of moneys in the Kansas endowment for youth fund--
22       CDDO rate reimbursement account of the Kansas endowment for youth
23       fund for the above agency for the fiscal year ending June 30, 2001, by

23        (aa) On the effective date of this act, of the $30,937,751 appropriated
24       for the above agency for the fiscal year ending June 30, 2000, by section
25       55(a) of chapter 132 of the 1999 Session Laws of Kansas from the state
26       general fund in the community based services account, the sum of
27       $2,600,000 is hereby lapsed.
28        (bb) In addition to the other purposes for which expenditures may be
29       made by the department of social and rehabilitation services from the
30       moneys appropriated from the state general fund or from any special
31       revenue fund for fiscal year 2001 as authorized by this or other appro-
32       priation act of the 2000 regular session of the legislature, expenditures
33       shall be made by the department of social and rehabilitation services from
34       the moneys appropriated from the state general fund or from any special
35       revenue fund for fiscal year 2001 to adopt and to implement policies and
36       procedures requiring that of the moneys appropriated in the social wel-
37       fare fund for fiscal year 2001, the amount of $600,000 shall used exclu-
38       sively for matching federal medicaid program funds for clients with men-
39       tal illness in order to maximize all funding sources available to community
40       mental health centers for the provision of services for clients with mental
41       illness: Provided, That the secretary of social and rehabilitation services
42       shall prepare and submit a report to the legislature at the beginning of
43       the regular session in 2001 setting forth the number if individuals served

  1       with such $600,000 and the amount of enhanced funding generated by
  2       the expenditure of such $600,000.
  3        (cc) In addition to the other purposes for which expenditures may be
  4       made by the department of social and rehabilitation services from any
  5       moneys appropriated from the state general fund or any special revenue
  6       fund for the fiscal year ending June 30, 2000, as authorized by any ap-
  7       propriation act of the1999 regular session of the legislature or by this or
  8       other appropriation act of the 2000 regular session of the legislature,
  9       expenditures shall be made by the department of social and rehabilitation
10       services from any such moneys appropriated for fiscal year 2001 for the
11       receipt, crediting and disbursement of moneys received by the depart-
12       ment of social and rehabilitation services for payments of support pur-
13       suant to a rule or administrative order issued by the Kansas supreme
14       court, which is hereby authorized to be issued by the Kansas supreme
15       court, directing payments of support, which are made pursuant to any
16       court order entered in this state regardless of the date of the order, to be
17       made to a central unit for the collection and disbursement of support
18       payments, notwithstanding the provisions of any statute to the contrary.
19        (dd) During the fiscal year ending June 30, 2001, no expenditures shall
20       be made by the department of social and rehabilitation services from the
21       moneys appropriated in the state medicaid match fund--SRS except
22       upon approval of the state finance council acting on this matter which is
23       hereby characterized as a matter of legislative delegation and subject to
24       the guidelines prescribed in subsection (c) of K.S.A. 75-3711c and amend-
25       ments thereto and acting on this matter after receiving the certification
26       of the director of the budget that sufficient moneys are available in the
27       state medicaid match fund--SRS pursuant to the intergovernmental
28       transfer program: Provided further, That the state finance council may
29       authorize the department of social and rehabilitation services to make
30       expenditures from the state medicaid match fund--SRS for the HCBS/
31       MR waiver program and for the HCBS/PD waiver program: Provided,
32       however, That (1) expenditures from the state medicaid match fund--
33       SRS for the HCBS/MR waiver program shall not exceed $15,300,000,
34       and (2) expenditures from the state medicaid match fund--SRS for the
35       HCBS/PD waiver program shall not exceed $800,000.
36        (ee) On the effective date of this act, or as soon thereafter as any
37       moneys are credited to the long-term care loan and grant fund, the di-
38       rector of accounts and reports shall transfer amounts which equal in the
39       aggregate $1,000,000 from the long-term care loan and grant fund of the
40       department on aging to the grant to Horizon health plan fund of the
41       department of social and rehabilitation services: Provided, That the first
42       $1,000,000 that is credited to the long-term care loan and grant fund
43       under the intergovernmental transfer program shall be transferred from

  1       the long-term care loan and grant fund of the department on aging to the
  2       grant to Horizon health plan fund of the department of social and reha-
  3       bilitation services in accordance to this subsection.
  4        [(ff) In the event that the department of social and rehabilitation
  5       services issues a request for proposal for the title XXI program chil-
  6       drens health insurance program, the secretary shall consider the
  7       following factors in developing the request for proposal: (1) The
  8       combination of title XIX and title XXI programs as such programs
  9       relate to children, and (2) the inclusion of all marketing and out-
10       reach efforts relating to the childrens health insurance program:
11       Provided, That the department of social and rehabilitation services
12       shall consider all options to initiate a medicaid managed care pro-
13       gram in Sedgwick county: Provided further, That the department of
14       social and rehabilitation services shall work in support with the
15       Kansas business health partnership.]
16        Sec. 21.

18        (a) There is appropriated for the above agency from the state general

  9       with the approval of the director of the budget, may transfer any part of
10       any item of appropriation for the fiscal year ending June 30, 2000, from
11       the state general fund for the department on aging to another item of
12       appropriation for fiscal year 2000 from the state general fund for the
13       department on aging. The secretary of aging shall certify each such trans-
14       fer to the director of accounts and reports and shall transmit a copy of
15       each such certification to the legislative research department.
16        (e) On July 1, 2000, or as soon thereafter as moneys are available, the
17       director of accounts and reports shall transfer $2,637,734 from the flexible
18       spending fund of the department of administration to the flexible spend-
19       ing fund--nursing facilities quality enhancement wage pass-through pur-
20       suant to 1999 Senate Bill No.126 (K.S.A. 1999 Supp. 39-971) of the de-
21       partment on aging: Provided, That no transfer shall be made under this
22       subsection except upon approval of the state finance council acting on
23       this matter which is hereby characterized as a matter of legislative dele-
24       gation and subject to the guidelines prescribed in subsection (c) of K.S.A.
25       75-3711c and amendments thereto and acting on this matter after re-
26       ceiving the certification of the director of the budget that sufficient mon-
27       eys are available in the flexible spending fund pursuant to the intergov-
28       ernmental transfer program.
29        (f) On July 1, 2000, or as soon thereafter as moneys are available, the

27       hereby decreased from $75,000 to $0: Provided, That, in addition to the
28       other purposes for which expenditures may be made by the Kansas sen-
29       tencing commission from the reappropriated balance in the state match-
30       ing funds account of the state general fund for fiscal year 2000 and within
31       the expenditure limitation of $75,000 on expenditures from such reap-
32       propriated balance established by section 80(a) of chapter 132 of the 1999
33       Session Laws of Kansas, the Kansas sentencing commission may make
34       expenditures from such reappropriated balance for fiscal year 2000 for
35       operating expenditures: Provided, however, That expenditures from such
36       reappropriated balance for fiscal year 2000 for operating expenditures
37       shall not exceed $56,706: Provided further, That, in addition to the other
38       purposes for which expenditures may be made by the Kansas sentencing

CITIZENS' UTILITY RATEPAYER BOARD
  5        (a) On July 1, 2000, the expenditure limitation established for the fiscal
  6       year ending June 30, 2001, by section 19(a) of 2000 House Substitute for
  7       Senate Bill No. 326 on the utility regulatory fee fund is hereby increased
  8       from $470,195 to $471,003.
  9        (b) On July 1, 2000, October 1, 2000, January 1, 2001, and April 1,
10       2001, or as soon after each such date as moneys are available, and upon
11       receipt of certification by the state corporation commission of the amount
12       to be transferred, the director of accounts and reports shall transfer from
13       the public service regulation fund of the state corporation commission to
14       the utility regulatory fee fund of the citizens' utility ratepayer board all
15       moneys assessed by the state corporation commission for the citizens'
16       utility ratepayer board under K.S.A. 66-1502 or 66-1503 and amendments
17       thereto and deposited in the state treasury to the credit of the public
18       service regulation fund.
19        Sec. 29.

STATE CORPORATION COMMISSION
21        (a) On July 1, 2000, the expenditure limitation established for the fiscal
22       year ending June 30, 2001, by section 18(b) of 2000 House Substitute for
23       Senate Bill No. 326 on the public service regulation fund, the motor
24       carrier license fees fund and the conservation fee fund, in the aggregate,
25       is hereby increased from $12,169,603 to $12,277,211.

22       $897,146.

25        (a) On July 1, 2000, the expenditure limitation established for the fiscal
26       year ending June 30, 2001, by section 72(a) of 2000 House Substitute for
27       Senate Bill No. 326 on the bank commissioner fee fund is hereby in-
28       creased from $4,000,720 to $4,012,919.
29        Sec. 34.

JUVENILE JUSTICE AUTHORITY
31        (a) In addition to the other purposes for which expenditures may be
32       made from the children's initiatives fund for fiscal year 2001, expenditures
33       may be made by the above agency from the children's initiatives fund for
34       fiscal year 2001 for the following specified purposes subject to the ex-
35       penditure limitations prescribed therefor:
36       Children's initiatives fund--prevention program grants $5,000,000
37       Provided, That all expenditures by the above agency from the children's
38       initiatives fund for fiscal year 2001 from the children's initiatives fund--
39       prevention program grants account shall be in addition to any expenditure
40       limitation imposed on the children's initiatives fund for fiscal year 2001:
41       Provided further, That money awarded as grants from this account shall
42       be distributed according to the percentage distribution of a judicial dis-
43       trict's high school graduation failure rate, averaged over a period of three

2       Children's initiatives fund--intervention and graduatedsanctions community grants $2,000,000
  3       Provided, That all expenditures by the above agency from the children's
  4       initiatives fund for fiscal year 2001 from the children's initiatives fund--

  6       in addition to any expenditure limitation imposed on the children's ini-
  7       tiatives fund for fiscal year 2001.
  8        (b) (1) On July 1, 2000, the director of accounts and reports shall trans-
  9       fer all moneys credited as of June 30, 2000, in the Kansas endowment for
10       youth fund--prevention program grants account of the Kansas endow-
11       ment for youth fund to the children's initiatives fund--prevention pro-
12       gram grants account in the children's initiatives fund established by sub-
13       section (a). On July 1, 2000, and after such transfer, (A) all encumbrances
14       and other liabilities of the Kansas endowment for youth fund--prevention
15       program grants account of the Kansas endowment for youth fund are
16       hereby transferred to and imposed upon the children's initiatives fund--
17       prevention program grants account in the children's initiatives fund, (B)
18       the Kansas endowment for youth--prevention program grants account of
19       the above agency in the Kansas endowment for youth fund is hereby
20       abolished, and (C) any appropriation of moneys in the Kansas endowment
21       for youth fund--prevention program grants account of the Kansas en-
22       dowment for youth fund for the above agency for the fiscal year ending
23       June 30, 2001, by any provision of chapter 132 or chapter 160 of the 1999
24       Session Laws of Kansas or this or other appropriation act of the 2000
25       regular session of the legislature, is hereby lapsed.
26        (2) On July 1, 2000, the director of accounts and reports shall transfer
27       all moneys credited as of June 30, 2000, in the Kansas endowment for
28       youth fund--intervention and graduated sanctions community grants ac-
29       count of the Kansas endowment for youth fund to the children's initiatives
30       fund--intervention and graduated sanctions community grants account
31       in the children's initiatives fund established by subsection (a). On July 1,
32       2000, and after such transfer, (A) all encumbrances and other liabilities
33       of the Kansas endowment for youth fund--intervention and graduated
34       sanctions community grants account of the Kansas endowment for youth
35       fund are hereby transferred to and imposed upon the children's initiatives
36       fund--intervention and graduated sanctions community grants account
37       in the children's initiatives fund, (B) the Kansas endowment for youth--

20       ished, and (C) any appropriation of moneys in the Kansas endowment for

28       by this or other appropriation act of the 2000 regular session of the leg-
29       islature, expenditures may be made by the above agency from the chil-
30       dren's initiatives fund for fiscal year 2001, from the unencumbered bal-
31       ance as of July 1, 2000, in each account of the children's initiatives fund
32       that is established by subsection (a) and into which account moneys are
33       transferred pursuant to this subsection (b) and in each account of the
34       children's initiatives fund that is established by this subsection (b): Pro-
35       vided, That all expenditures from the unencumbered balance of any such
36       account of the children's initiatives fund shall not exceed the amount of
37       the unencumbered balance in such account on July 1, 2000: Provided
38       further, That all expenditures from the unencumbered balance of any
39       such account shall be in addition to any expenditure limitation imposed
40       on the children's initiatives fund for fiscal year 2001.
41         (c) There is appropriated for the above agency from the state insti-
42       tutions building fund for the fiscal year ending June 30, 2001, for the
43       capital improvement project or projects specified as follows:

1       Construction/remodeling of juvenile correctional facilities--SIBF $4,500,000
  2       Provided, That the juvenile justice authority may make expenditures from
  3       the construction/remodeling of juvenile correctional facilities--SIBF ac-
  4       count to renovate or replace existing deficient space in existing facilities,
  5       specifically including space at the Larned juvenile correctional facility and
  6       at the Topeka juvenile correctional facility, and to construct new juvenile
  7       correctional space.
  8        (d) There is appropriated for the above agency from the following spe-
  9       cial revenue fund or funds for the fiscal year ending June 30, 2001, all
10       moneys now or hereafter lawfully credited to and available in such fund
11       or funds, except that expenditures other than refunds authorized by law
12       shall not exceed the following:
13       Construction/remodeling of juvenile correctional facilitiesfund No limit
14       Provided, That the juvenile justice authority may make expenditures from
15       the construction/remodeling of juvenile correctional facilities fund for
16       capital improvement projects to remodel a living unit at Beloit juvenile
17       correctional facility, to construct a medium security juvenile correctional
18       facility of 154 beds, which shall include an additional 32-bed pod, at Lar-
19       ned juvenile correctional facility, raze and reconstruct living units at To-
20       peka juvenile correctional facility, and construct maximum security build-
21       ings at Topeka juvenile correctional facility: Provided further, That a
22       secured commons area be built on the east end of the campus for services
23       including, but not limited to, food and medical services and a visitors
24       center, and, on the east side of the commons area, up to 150 maximum
25       security beds, up to 60 beds for system-wide and facility classification and
26       diagnostic purposes, and up to 15 medical beds: And provided further,
27       That the commissioner of juvenile justice shall make every effort to pro-
28       vide that one superintendent shall govern all existing, renovated, or new
29       buildings at Topeka juvenile correctional facility: And provided further,
30       That the commissioner of juvenile justice shall make every effort to com-
31       bine staff of the existing, renovated and new buildings at the Topeka
32       juvenile correctional facility into a unified staff under the supervision of
33       one administrator: And provided further, That the commissioner of ju-
34       venile justice is directed to share educational programming between the
35       existing, renovated and new program space at Topeka correctional juve-
36       nile facility: And provided further, That the juvenile justice authority is
37       directed to use both wings of the Meyer building on the Larned state
38       hospital grounds for overflow or overcrowding space at the proposed Lar-
39       ned juvenile correctional facility of 154 beds: And provided further, That
40       the capital improvement projects to construct maximum buildings at To-
41       peka, construct a medium security juvenile correctional facility at Larned

  1       juvenile correctional facility, raze and reconstruct living units at Topeka
  2       juvenile correctional facility, and remodel a living unit at Beloit juvenile
  3       correctional facility are hereby approved for the juvenile justice authority
  4       for the purposes of subsection (b) of K.S.A. 74-8905 and amendments
  5       thereto and the authorization of the issuance of bonds by the Kansas
  6       development finance authority in accordance with that statute: Provided,
  7       however, That total expenditures from this fund for such capital improve-
  8       ment projects shall not exceed $50,000,000, plus all amounts required for
  9       cost of bond issuance, cost of interest on the bonds during the construc-
10       tion of the projects and required reserves for the payment of principal
11       and interest on the bonds: And provided further, That all moneys received
12       from the issuance of any such bonds shall be deposited in the state treas-
13       ury to the credit of this fund [And provided further, That expenditures
14       shall be made for the capital improvement project to construct a
15       medium security juvenile facility of 154 beds, which shall include
16       an additional 32-bed pod at Larned juvenile correctional facility or
17       the capital improvement to utilize Meyer building on the Larned
18       state hospital grounds that accommodates an additional 32-beds:
19       Provided, however, the aggregate amount of costs for capital im-
20       provement projects authorized by this act shall not to exceed
21       $60,000,000].

Construction of juvenile correctional facilities

24       Provided, That the juvenile justice authority may make expenditures from

30        Sec. 35.

32        (a) There is appropriated for the above agency from the following spe-

34       now or hereafter lawfully credited to and available in such fund or funds,

19       hereby increased from $1,654,921 to $1,655,771.

  6        (g) On July 1, 2000, the director of accounts and reports shall transfer
  7       $1,854 from the state water plan fund of the Kansas water office to the
  8       water plan special revenue fund of the Kansas department of agriculture.
  9        (h) On July 1, 2000, the expenditure limitation established by section
10       61(b) of 2000 House Substitute for Senate Bill No. 326 on expenditures
11       from the water plan special revenue fund for salaries and wages is hereby
12       increased from $577,677 to $579,531.
13        (i) On July 1, 2000, the appropriation of all moneys credited to and
14       available in the Kansas corn commission fund for the fiscal year ending
15       June 30, 2001, by section 61(b) of 2000 House Substitute for Senate Bill
16       No. 326 is hereby lapsed and the Kansas corn commission fund in the
17       state treasury is hereby abolished.
18        (j) On July 1, 2000, the appropriation of all moneys credited to and
19       available in the Kansas grain sorghum commission fund for the fiscal year
20       ending June 30, 2001, by section 61(b) of 2000 House Substitute for
21       Senate Bill No. 326 is hereby lapsed and the Kansas grain sorghum com-
22       mission fund in the state treasury is hereby abolished.
23        (k) On July 1, 2000, the appropriation of all moneys credited to and
24       available in the soybean promotion and research fund for the fiscal year
25       ending June 30, 2001, by section 61(b) of 2000 House Substitute for
26       Senate Bill No. 326 is hereby lapsed and the soybean promotion and
27       research fund in the state treasury is hereby abolished.
28        (l) On July 1, 2000, the director of accounts and reports shall transfer
29       $426,223 from the grain inspection fee fund of the Kansas department
30       of agriculture to the Kansas agricultural remediation board fund of the
31       Kansas department of agriculture.
32        (m) On July 1, 2001, the position limitation established by section 69(a)
33       of 2000 House Substitute for Senate Bill No. 326 for the Kansas depart-
34       ment of agriculture is hereby decreased from 105.5 to 103.2.
35        (n) In addition to the other purposes for which expenditures may be
36       made by the Kansas department of agriculture from moneys appropriated
37       from the state general fund or from any special revenue fund for the fiscal
38       year ending June 30, 2001, from which expenditures may be made for
39       salaries and wages, as authorized by this or other appropriation act of the
40       2000 regular session of the legislature, expenditures may be made by the
41       Kansas department of agriculture from such moneys appropriated from
42       the state general fund or from any special revenue fund for fiscal year
43       2001 for four full-time equivalent positions in the unclassified service

  1       under the Kansas civil service act: Provided, That all such additional full-
  2       time equivalent positions in the unclassified service under the Kansas civil
  3       service act shall be in addition to other positions within the department
  4       agriculture in the unclassified service as prescribed by law and shall be
  5       established by the secretary of agriculture within any position limitation
  6       established for the Kansas department of agriculture on the number of
  7       full-time and regular part-time positions equated to full-time, excluding
  8       seasonal and temporary positions, paid from appropriations for fiscal year
  9       2001 made by this or other appropriation act of the 2000 regular session
10       of the legislature: Provided, however, That the authority to establish such
11       additional positions in the unclassified service shall not affect the classified
12       service status of any person who is an employee of the Kansas department
13       of agriculture and who is in a position in the classified service under the
14       Kansas civil service act on June 30, 2000.
15        Sec. 39.

KANSAS WHEAT COMMISSION
17        (a) Notwithstanding the provisions of any other statute to the contrary,
18       during the fiscal year ending June 30, 2000, the aggregate amount of
19       expenditures from the Kansas wheat commission fund by the Kansas
20       wheat commission for the new market plan for the Kansas wheat com-
21       mission shall not exceed $463,000: Provided, That all expenditures from
22       the Kansas wheat commission fund by the Kansas wheat commission for
23       the new market plan for the Kansas wheat commission shall be within
24       the overall expenditure limitation established for the Kansas wheat com-
25       mission fund for fiscal year 2000: Provided, however, That the expendi-
26       ture limitation established by this subsection on the aggregate amount of
27       expenditures from the Kansas wheat commission fund by the Kansas
28       wheat commission for the new market plan for the Kansas wheat com-
29       mission for fiscal year 2000 shall not be increased except upon specific
30       authorization by act of the legislature and shall not be increased by the
31       state finance council: Provided further, That, on and after the effective
32       date of this act, the provisions of subsection (b) of section 65 of 2000
33       Senate Bill No. 39 are hereby declared to be null and void and of no
34       force and effect.
35        (b) On July 1, 2000, the appropriation of all moneys credited to and
36       available in the Kansas wheat commission fund for the fiscal year ending
37       June 30, 2001, by section 64(b) of 2000 House Substitute for Senate Bill
38       No. 326 is hereby lapsed and the Kansas wheat commission fund in the
39       state treasury is hereby abolished.
40        (c) On July 1, 2000, the appropriation of all moneys credited to and
41       available in the wheat research reserve fund for the fiscal year ending
42       June 30, 2001, by section 64(b) of 2000 House Substitute for Senate Bill
43       No. 326 is hereby lapsed and the wheat research reserve fund in the state

33        (a) There is appropriated for the above agency from the state general

37        (b) On July 1, 2000, the expenditure limitation established by section
38       66(b) of 2000 House Substitute for Senate Bill No. 326 on the state water
39       plan fund is hereby increased from $2,826,474 to $2,896,500.
40        (c) On July 1, 2000, the director of accounts and reports shall transfer
41       $395,000 from the state water plan fund of the Kansas water office to the
42       state general fund.
43        [(d)(1) Subject to the limitations of this section, whenever it ap-

  1       pears that the resources in the fiscal year ending June 30, 2001, are
  2       insufficient to meet in full the estimated expenditures as they be-
  3       come due to meet duties imposed by law on the water marketing
  4       fund of the Kansas water office as a result of increases in water
  5       rates, fees or charges imposed by the federal government, the pooled
  6       money investment board is authorized and directed to loan to the
  7       director of the Kansas water office sufficient funds to reimburse the
  8       water marketing fund for increases in water rates, fees or charges
  9       imposed by the federal government, and to allow the Kansas water
10       office to spread such increases to consumers over a longer period,
11       except that no such loan shall be made unless the terms thereof have
12       been approved by the director of the budget. The pooled money
13       investment board is authorized and directed to use any moneys in
14       the operating accounts, investment accounts or other investments
15       of the state of Kansas to provide the funds for such loan. Each such
16       loan shall bear interest at a rate equal to the interest rate being
17       paid on state inactive account moneys at the time of the making of
18       such loan. Such loan shall not be deemed to be an indebtedness or
19       debt of the state of Kansas within the meaning of section 6 of article
20       11 of the constitution of the state of Kansas.
21        [(2) Upon certification by the pooled money investment board by
22       the director of the Kansas water office of the amount of each loan
23       authorized pursuant to subsection (d)(1), the pooled money invest-
24       ment board shall transfer each such amount certified by the director
25       of the Kansas water office from the state bank account or accounts
26       prescribed in subsection (d)(1) to the water marketing fund of the
27       Kansas water office.
28        [(3) The principal and interest of each loan authorized pursuant
29       to subsection (d)(1) shall be repaid in payments payable at least
30       annually for a period of not more than five years.
31        [(4) The aggregate outstanding balance of all loans pursuant to
32       this subsection (d) shall not exceed $1,000,000 at any one time.]
33        Sec. 43.

KANSAS STATE SCHOOL FOR THE BLIND
35        (a) On the effective date of this act, of the $4,287,704 appropriated for
36       the above agency for the fiscal year ending June 30, 2000, by section 60(a)
37       of chapter 132 of the 1999 Session Laws of Kansas from the state general
38       fund in the operating expenditures account, the sum of $1,676 is hereby
39       lapsed.
40        (b) On the effective date of this act, the expenditure limitation estab-
41       lished by section 60(b) of chapter 132 of the 1999 Session Laws of Kansas
42       on the general fees fund is hereby increased from $9,349 to $19,349.
43        (c) There is appropriated for the above agency from the state general

  8       House Substitute for Senate Bill No. 326 from the state general fund in
  9       the operating expenditures account, the sum of $7,283 is hereby lapsed.
10        (b) On July 1, 2001, the position limitation established by section 69(a)
11       of 2000 House Substitute for Senate Bill No. 326 for the Kansas state
12       school for the deaf is hereby decreased from 174.5 to 173.5.
13        Sec. 45.

DEPARTMENT OF HUMAN RESOURCES
15        (a) In addition to the other purposes for which expenditures may be
16       made by the department of human resources from moneys appropriated
17       from any special revenue fund for fiscal year 2000 or fiscal year 2001 as
18       authorized by this or other appropriation act of the 2000 regular session
19       of the legislature, expenditures may be made by the department of human
20       resources for fiscal year 2000 and fiscal year 2001 from the moneys ap-
21       propriated from any special revenue fund for the expenses of the sale,
22       exchange or other disposition conveying title for any portion or all of the
23       real estate of the department of human resources: Provided, That such
24       expenditures may be made and such sale, exchange or other disposition
25       conveying title for any portion or all of the real estate of the department
26       of human resources may be executed or otherwise effectuated only upon
27       specific authorization by the state finance council acting on this matter,
28       which is hereby characterized as a matter of legislative delegation and
29       subject to the guidelines prescribed in subsection (c) of K.S.A. 75-3711c
30       and amendments thereto and acting after receiving the recommendations
31       of the joint committee on state building construction: Provided, however,
32       That no such sale, exchange or other disposition conveying title for any
33       portion of the real estate of the department of human resources until the
34       proposed sale, exchange or other disposition conveying title for such real
35       estate has been reviewed by the joint committee on state building con-
36       struction: Provided further, That the net proceeds from the sale of any
37       of the real estate of the department of human resources shall be deposited
38       in the state treasury to the credit of the employment security administra-
39       tion property sale fund of the department of human resources.
40        (b) There is appropriated for the above agency from the following spe-
41       cial revenue fund or funds for the fiscal year or years specified, all moneys
42       now or hereafter lawfully credited to and available in such fund or funds,
43       except that expenditures other than refunds authorized by law shall not

14       additional real estate to provide space for the job service and unemploy-
15       ment insurance programs of the department of human resources until
16       such proposed purchase or other acquisition, including the preliminary
17       plans and program statement for any capital improvement project that is
18       proposed to be initiated and completed by or for the department of hu-
19       man resources on such real estate for such purposes, have been reviewed
20       by the joint committee on state building construction.
21        (c) There is appropriated for the above agency from the following spe-
22       cial revenue fund or funds for the fiscal year or years specified, all moneys
23       now or hereafter lawfully credited to and available in such fund or funds,
24       except that expenditures other than refunds authorized by law shall not
25       exceed the following:

  8        (a) In addition to the other purposes for which expenditures may be
  9       made by the state historical society from moneys appropriated from the
10       state general fund or any special revenue fund for fiscal year 2000 or fiscal
11       year 2001 as authorized by this or other appropriation act of the 2000
12       regular session of the legislature, expenditures shall be made by the state
13       historical society for fiscal year 2000 and fiscal year 2001 from the moneys
14       appropriated from the state general fund or any special revenue fund for
15       the following capital improvement projects, in the following order of pri-
16       ority from the highest to the lowest priority, subject to the aggregate
17       expenditure limitations prescribed therefor:
18       First territorial capitol $71,000

28       not exceed, in the aggregate during fiscal years 2000 and 2001, the
29       amount prescribed by this subsection for such project: And provided fur-
30       ther, That, if expenditures are necessary for emergency repair projects
31       for the fiscal year 2000 or 2001, expenditures may be made by the state
32       historical society for the purpose of initiating and completing such emer-
33       gency repair projects at any time and notwithstanding the other provisions
34       of this subsection and the priorities for capital improvement projects pre-
35       scribed by this subsection for the state historical society.

  6        (f) (1) Notwithstanding the provisions of the proviso to the appropri-
  7       ation of moneys from the state general fund in the general state aid ac-
  8       count that was included in section 35(a) of 2000 House Substitute for
  9       Senate Bill No. 326 and that directed any unencumbered balance in the
10       general state aid account shall be transferred to the inservice education
11       aid account of the state general fund of the department of education to
12       be used to fund approved inservice education programs as authorized by
13       K.S.A. 72-9601 et seq., and amendments thereto, such unencumbered
14       balance in the general state aid account shall not be transferred to the
15       inservice education aid account as prescribed by such proviso and such
16       proviso is hereby declared to be void and of no force and effect.
17        (2) Any unencumbered balance in the general state aid account of the
18       state general fund of the department of education in excess of $100 as of
19       June 30, 2000, is hereby reappropriated in the general state aid account
20       of the state general fund of the department of education for fiscal year
21       2001: Provided, That the amount reappropriated from such unencum-
22       bered balance shall not exceed $13,841,896 [$11,841,896] and any ad-
23       ditional remaining amount in such unencumbered balance shall not be
24       reappropriated and is hereby lapsed. Provided, however, That expendi-
25       tures from such reappropriated balance for general state aid shall not
26       exceed $11,841,896 except upon approval of the state finance council:
27       Provided further, That, any portion of the amount of such reappropriated
28       balance in excess of $11,841,896 shall be transferred to the inservice ed-
29       ucation aid account of the state general fund of the department of edu-
30       cation to be used to fund approved inservice education programs as au-
31       thorized by K.S.A. 72-9601 et seq., and amendments thereto: And
32       provided further, That the amount transferred to the inservice education
33       aid account from such unencumbered balance under this subsection
34       (e)(2) shall not exceed $2,000,000.
35        (g) In addition to the directives provided in section 35(a) of 2000 House
36       Substitute for Senate Bill No. 326 for expenditures from the special ed-
37       ucation services aid account of the above agency, expenditures shall be
38       made from such account, after deduction of expenditures made in ac-
39       cordance with the provisions of K.S.A. 1999 Supp. 72-983 and amend-
40       ments thereto, for a grant of $250,000 to the Kansas optometric associ-
41       ation to conduct a pilot study of vision problems known as convergence
42       insufficiency and convergence excess, accommodative insufficiency, and
43       ocular motor dysfunction and their relationship to academic performance

  1       and special education referral for students in early elementary grades:
  2       Provided, That the Kansas optometric association shall make a progress
  3       report to the legislature during the 2001 session and a final report to the
  4       legislative budget committee and the governor on or before September
  5       1, 2001: Provided further, That in determining amounts of payments to
  6       school districts to be made in accordance with the provisions of K.S.A.
  7       72- 978 and amendments thereto from the amount remaining in the spe-
  8       cial education services aid account, after deduction of expenditures made
  9       in accordance with the provisions of K.S.A. 1999 Supp. 72-893 and
10       amendments thereto and deduction of the expenditures specified in this
11       subsection for a grant to the Kansas optometric association, fully-trained
12       reading recovery teacher leaders and elementary school structured men-
13       toring reading program coordinator/teachers, selected by the state de-
14       partment of education in accordance with established criteria, shall be
15       considered to be special teachers as defined in subsection (j)(1) of K.S.A.
16       72-962 and amendments thereto: Provided, however, That expenditures
17       for fully-trained reading recovery teacher leaders considered to be special
18       teachers shall not exceed $160,000 and expenditures for elementary
19       school structured mentoring reading program coordinator/teachers con-
20       sidered to be special teachers shall not exceed $1,000,000: And provided
21       further, That consideration of reading recovery teacher leaders and ele-
22       mentary school structured mentoring reading program coordinator/teach-
23       ers as special teachers for determination of the amount of the special
24       education services aid of a school district shall be conditioned upon the
25       school district providing the legislature by the end of the 2001 session
26       with longitudinal data as the state department of education requires, in-
27       cluding special education enrollment as a percentage of district-wide en-
28       rollment for at least five years prior to implementation of a reading re-
29       covery program or a structured mentoring reading program, or both such
30       programs, and the effect, if any, of implementation of the program or
31       programs on the percentage of special education enrollment to district-
32       wide enrollment.
33        (h) On the effective date of this act, the appropriation of all moneys
34       credited to and available in the flexible spending fund--general state aid
35       account of the above agency for the fiscal year ending June 30, 2001, by
36       section 35(a) of 2000 House Substitute for Senate Bill No. 326 is hereby
37       lapsed.
38        (i) In addition to the other purposes for which expenditures may be
39       made from the children's initiatives fund for fiscal year 2001, expenditures
40       may be made by the above agency from the children's initiatives fund for
41       fiscal year 2001 for the following specified purposes subject to the ex-
42       penditure limitations prescribed therefor:
43       Children's initiatives fund--parent education program $1,277,833

  1       Provided, That all expenditures by the above agency from the children's

  6       hereby transferred to and imposed upon the children's initiatives fund--
  7       parent education program account in the children's initiatives fund, (B)
  8       the Kansas endowment for youth fund--parent education program ac-

10       hereby abolished, and (C) any appropriation of moneys in the Kansas

15       75-721 and amendments thereto: Provided, That such expenditures
16       for salary and wages and other operating expenditures for the state-
17       wide DARE (Drug Resistance Education) coordinator and staff pro-
18       vided for in K.S.A. 1999 Supp. 75-721 and amendments thereto shall
19       not exceed $159,956: Provided further, That such expenditures may
20       include expenditures for official hospitality for training session.]
21        (c) On July 1, 2000, the director of accounts and reports shall transfer
22       all moneys credited as of June 30, 2000, in the Kansas endowment for
23       youth fund--DARE (Drug Abuse Resistance Education) coordinator,
24       support staff, training and program expenditures account of the Kansas
25       endowment for youth fund to the children's health care programs fund--
26       DARE (Drug Abuse Resistance Education) coordinator, support staff,
27       training and program expenditures account in the children's initiatives
28       fund, which is hereby established. On July 1, 2000, and after such transfer,
29       (A) all encumbrances and other liabilities of the Kansas endowment for
30       youth fund--DARE (Drug Abuse Resistance Education) coordinator,
31       support staff, training and program expenditures account of the Kansas
32       endowment for youth fund are hereby transferred to and imposed upon
33       the children's initiatives fund--DARE (Drug Abuse Resistance Educa-
34       tion) coordinator, support staff, training and program expenditures ac-
35       count in the children's initiatives fund, (B) the Kansas endowment for
36       youth--DARE (Drug Abuse Resistance Education) coordinator, support
37       staff, training and program expenditures account of the above agency in
38       the Kansas endowment for youth fund is hereby abolished, and (C) any

16       expenditures account, any unencumbered balance in excess of $100 as of
17       June 30, 2000, in the adult care homes criminal record checks operating
18       expenditures account, and any unencumbered balance in excess of $100
19       as of June 30, 2000, in the operating expenditures--implementation of
20       Substitute for 1999 House Bill No. 2469 account are hereby reappro-
21       priated to the operating expenditures (including official hospitality) ac-
22       count for fiscal year 2001.
23       Any unencumbered balance in excess of $100 as of June 30, 2000, in each
24       of the following accounts is hereby reappropriated for fiscal year 2001:
25       Vaccine purchases; infant and toddler program; aid to local units; aid to
26       local units--primary health projects; teen pregnancy prevention activities;
27       immunization programs.
28        (b) There is appropriated for the above agency from the following spe-
29       cial revenue fund or funds for the fiscal year or years specified, all moneys
30       now or hereafter lawfully credited to and available in such fund or funds,
31       except that expenditures other than refunds authorized by law shall not
32       exceed the following:
33       Sunflower army ammunition plant remediation trust fund
34       For the fiscal year ending June 30, 2001 No limit
35        (c) On July 1, 2000, the expenditure limitation established by section
36       31(b) of 2000 House Substitute for Senate Bill No. 326 on the water plan
37       special revenue fund is hereby increased from $4,136,452 to $4,137,270.
38        (d) On July 1, 2000, of the $2,492,000 appropriated for the above
39       agency for the fiscal year ending June 30, 2001, by section 31(a) of 2000
40       House Substitute for Senate Bill No. 326 from the state general fund in
41       the infant and toddler program account, the sum of $500,000 is hereby
42       lapsed.
43        (e) On July 1, 2000, the director of accounts and reports shall transfer

  1       $818 from the state water plan fund of the Kansas water office to the
  2       water plan special revenue fund of the department of health and envi-
  3       ronment.
  4        (f) In addition to the other purposes for which expenditures may be
  5       made by the department of health and environment from the health and
  6       environment publication fee fund for the fiscal year ending June 30, 2001,
  7       as authorized by section 31(b) of 2000 House Substitute for Senate Bill
  8       No. 326 or other appropriation act of the 2000 regular session of the
  9       legislature, and notwithstanding the provisions of section 31 (b) of 2000
10       House Substitute for Senate Bill No. 326 or K.S.A. 75-5662 and amend-
11       ments thereto, to the contrary, expenditures may be made by the de-
12       partment of health and environment from the health and environment
13       publication fee fund for fiscal year 2001 for development, publication and
14       distribution of brochures containing information about infection control
15       techniques which are appropriate for hair braiding outside the salon set-
16       ting, as prescribed by section 2 of 2000 Senate Bill No. 513: Provided,
17       That all moneys received for fees charged and collected under section 2
18       of 2000 Senate Bill No. 513 shall be deposited in the state treasury to the
19       credit of the health and environment publication fee fund.
20        (g) On July 1, 2000, the position limitation established by section 69(a)
21       of 2000 House Substitute for Senate Bill No. 326 on the department of
22       health and environment is hereby decreased from 842.5 to 839.5.
23        (h) In addition to the other purposes for which expenditures may be
24       made from the children's initiatives fund for fiscal year 2001, expenditures
25       may be made by the above agency from the children's health care pro-
26       grams fund for fiscal year 2001 for the following specified purposes sub-
27       ject to the expenditure limitations prescribed therefor:
28       Children's initiatives fund--healthy start $250,000
29       Provided, That all expenditures by the above agency from the children's
30       initiatives fund for fiscal year 2001 from the children's initiatives fund--
31       healthy start account shall be in addition to any expenditure limitation
32       imposed on the children's initiatives fund for fiscal year 2001.
33       Children's initiatives fund--smoking prevention grantsfund $1,000,000
34       Provided, That expenditures shall be made from the children's initiatives
35       fund--smoking prevention grants fund for the purpose of matching fed-
36       eral funds for programs that have proven outcomes. Provided further,
37       That all expenditures by the above agency from the children's initiatives
38       fund for fiscal year 2001 from the children's initiatives fund--smoking
39       prevention grants fund shall be in addition to any expenditure limitation
40       imposed on the children's initiatives fund for fiscal year 2001.

10       prevention services with demonstrated favorable outcomes: Provided fur-
11       ther, That all expenditures by the above agency from the children's ini-
12       tiatives fund for fiscal year 2001 from the children's initiatives fund--
13       Kansas health foundation grants account shall be in addition to any
14       expenditure limitation imposed on the children's initiatives fund for fiscal
15       year 2001.
16        (i) (1) On July 1, 2000, the director of accounts and reports shall trans-
17       fer all moneys credited as of June 30, 2000, in the Kansas endowment for
18       youth fund--healthy start account of the Kansas endowment for youth
19       fund to the children's initiatives fund--healthy start program account in
20       the children's initiatives fund established by subsection (h). On July 1,
21       2000, and after such transfer, (A) all encumbrances and other liabilities
22       of the Kansas endowment for youth fund--healthy start account of the
23       Kansas endowment for youth fund are hereby transferred to and imposed
24       upon the children's initiatives fund--healthy start account in the chil-
25       dren's initiatives fund, (B) the Kansas endowment for youth fund--
26       healthy start account of the above agency in the Kansas endowment for
27       youth fund is hereby abolished, and (C) any appropriation of moneys in
28       the Kansas endowment for youth fund--healthy start account of the Kan-
29       sas endowment for youth fund for the above agency for the fiscal year
30       ending June 30, 2001, by any provision of chapter 132 or chapter 160 of
31       the 1999 Session Laws of Kansas or this or other appropriation act of the
32       2000 regular session of the legislature, is hereby lapsed.
33        (2) On July 1, 2000, the director of accounts and reports shall transfer
34       all moneys credited as of June 30, 2000, in the Kansas endowment for
35       youth fund--infants and toddlers program account of the Kansas endow-
36       ment for youth fund to the children's initiatives fund--infants and tod-
37       dlers program account in the children's initiatives fund established by
38       subsection (h). On July 1, 2000, and after such transfer, (A) all encum-

21       of moneys in the Kansas endowment for youth fund--neonatal screening
22       account of the Kansas endowment for youth fund for the above agency
23       for the fiscal year ending June 30, 2001, by any provision of chapter 132

27        (4) On July 1, 2000, the director of accounts and reports shall transfer
28       all moneys credited as of June 30, 2000, in the Kansas endowment for
29       youth fund--vaccine purchases account of the Kansas endowment for
30       youth fund to the children's initiatives fund--vaccine purchases account
31       in the children's initiatives fund, which is hereby established. On July 1,
32       2000, and after such transfer, (A) all encumbrances and other liabilities
33       of the Kansas endowment for youth fund--vaccine purchases account of
34       the Kansas endowment for youth fund are hereby transferred to and
35       imposed upon the children's initiatives fund--vaccine purchases account
36       in the children's initiatives fund, (B) the Kansas endowment for youth
37       fund--vaccine purchases account of the above agency in the Kansas en-
38       dowment for youth fund is hereby abolished, and (C) any appropriation
39       of moneys in the Kansas endowment for youth fund--vaccine purchases
40       account of the Kansas endowment for youth fund for the above agency
41       for the fiscal year ending June 30, 2001, by any provision of chapter 132
42       or chapter 160 of the 1999 Session Laws of Kansas or this or other ap-
43       propriation act of the 2000 regular session of the legislature, is hereby

  2        (5) In addition to the other purposes for which expenditures may be
  3       made from the children's initiatives fund for fiscal year 2001 as authorized
  4       by this or other appropriation act of the 2000 regular session of the leg-
  5       islature, expenditures may be made by the above agency from the chil-
  6       dren's initiatives fund for fiscal year 2001, from the unencumbered bal-
  7       ance as of July 1, 2000, in each account of the children's initiatives fund
  8       that is established by subsection (h) and into which moneys are trans-
  9       ferred pursuant to this subsection (i) and in each account of the children's
10       initiatives fund that is established by this subsection (i): Provided, That
11       all expenditures from the unencumbered balance of any such account of
12       the children's initiatives fund shall not exceed the amount of the unen-
13       cumbered balance in such account on July 1, 2000: Provided further, That
14       all expenditures from the unencumbered balance of any such account
15       shall be in addition to any expenditure limitation imposed on the chil-
16       dren's initiatives fund for fiscal year 2001.
17        (j) On the effective date of this act, of the $2,492,000 appropriated for
18       the above agency for the fiscal year ending June 30, 2000, by section 53(a)
19       of chapter 132 of the 1999 Session Laws of Kansas from the state general
20       fund in the infant and toddler account, the sum of $500,000 is hereby
21       lapsed.

  2       the Hutchinson correctional facility--facility operations account, the sum
  3       of $384,414 is hereby lapsed.
  4        (d) On July 1, 2000, of the $17,290,354 appropriated for the above
  5       agency for the fiscal year ending June 30, 2001, by section 51(a) of 2000
  6       House Substitute for Senate Bill No. 326 from the state general fund in
  7       the El Dorado correctional facility--facility operations account, the sum
  8       of $326,258 is hereby lapsed.
  9        (e) On July 1, 2000, of the $13,658,283 appropriated for the above
10       agency for the fiscal year ending June 30, 2001, by section 51(a) of 2000
11       House Substitute for Senate Bill No. 326 from the state general fund in
12       the Topeka correctional facility--facility operations account, the sum of
13       $41,577 is hereby lapsed.
14        (f) In addition to other purposes for which expenditures may be made
15       by the department of corrections from the State of Kansas--department
16       of corrections inmate benefit fund for fiscal year 2001, as authorized by
17       section 51(b) of 2000 House Substitute for Senate Bill No. 326, expend-
18       itures may be made by the above agency from the State of Kansas--
19       department of corrections inmate benefit fund for operating the thera-
20       peutic community program at Lansing correctional facility: Provided,
21       That expenditures for such purposes from the State of Kansas--depart-
22       ment of corrections inmate benefit fund for fiscal year 2001 shall not
23       exceed $495,000: Provided further, That all such expenditures for such
24       purposes from the State of Kansas--department of corrections inmate
25       benefit fund for fiscal year 2001 shall be made from the projected ending
26       cash balance in the State of Kansas--department of corrections inmate
27       benefit fund as of June 30, 2000, and shall not result in any reduction of
28       funding from the State of Kansas--department of corrections inmate
29       benefit fund for other projects within the approved budget of expendi-
30       tures from such fund as authorized by section 51(b) of 2000 House Sub-
31       stitute for Senate Bill No. 326.
32        (g) On the effective date of this act, the amounts specified in section
33       73(c) of chapter 132 of the 1999 Session Laws of Kansas as being included
34       in the facilities operations account of the state general fund for the fol-
35       lowing correctional facilities for the fiscal year ending June 30, 2000, are
36       hereby changed to the amounts specified, but expenditures from the fa-
37       cilities operations account of the state general fund for such correctional
38       facilities shall not be limited to, or be required to be made in, the amounts
39       listed for the correctional facilities, as follows: (1) The amount for Larned
40       correctional mental health facility is hereby increased from $6,875,937 to
41       $6,877,925; (2) the amount for Hutchinson correctional facility is hereby
42       decreased from $22,487,669 to $22,476,313; and (3) the amount for To-
43       peka correctional facility is hereby decreased from $13,198,883 to

  1       $13,189,787.
  2        (h) On the effective date of this act, of the $12,361,004 appropriated
  3       for the above agency for the fiscal year ending June 30, 2000, by section
  4       73(a) of chapter 132 of the 1999 Session Laws of Kansas from the state
  5       general fund in the central administration operations and parole and post-
  6       release supervision operations account, the sum of $4,037 is hereby
  7       lapsed.
  8        (i) On July 1, 2000, the position limitation established by section 69(a)
  9       of 2000 House Substitute for Senate Bill No. 326 for the department of
10       corrections is hereby decreased from 3,063.0 to 3,059.0.

23        (b) On July 1, 2000, the expenditure limitation established by section
24       67(b) of 2000 House Substitute for Senate Bill No. 326, on the wildlife
25       fee fund is hereby decreased from $22,139,970 to $21,803,043.
26        (c) On July 1, 2000, the expenditure limitation established by section
27       67(b) of 2000 House Substitute for Senate Bill No. 326, on the EDIF--
28       local government outdoor recreation grants fund is hereby increased from
29       $250,000 to $500,000.
30        (d) On July 1, 2000, or as soon thereafter as moneys are available, the
31       director of accounts and reports shall transfer $250,000 from the Kansas
32       economic development endowment account of the state economic de-
33       velopment initiatives fund of the department of commerce and housing
34       to the EDIF--local government outdoor recreation grants fund of the
35       department of wildlife and parks.
36        (e) On July 1, 2000, the expenditure limitation established by section
37       67(b) of 2000 House Substitute for Senate Bill No. 326, on the parks fee
38       fund is hereby increased from $4,460,870 to $4,468,010.
39        Sec. 69. On July 1, 2000, K.S.A. 1999 Supp. 79-34,147, as amended by
40       section 106 of 2000 House Substitute for Senate Bill No. 326, is hereby
41       amended to read as follows: 79-34,147. (a) (1) On July 1, 1999, and quar-
42       terly thereafter the secretary of revenue shall certify to the director of
43       accounts and reports the amount equal to 7.628% of the total revenues

  1       received by the secretary from the taxes imposed under the Kansas re-
  2       tailers' sales tax act and deposited in the state treasury and credited to
  3       the state general fund during the preceding three calendar months.
  4        (2) On July 1, 2001, and quarterly thereafter, the secretary of revenue
  5       shall certify to the director of accounts and reports the amount equal to
  6       9.5% of the total revenues received by the secretary from the taxes im-
  7       posed under the Kansas retailers' sales tax act and deposited in the state
  8       treasury and credited to the state general fund during the preceding three
  9       calendar months.
10        (3) On July 1, 2002, and quarterly thereafter, the secretary of revenue
11       shall certify to the director of accounts and reports the amount equal to
12       11% of the total revenues received by the secretary from the taxes im-
13       posed under the Kansas retailers' sales tax act and deposited in the state
14       treasury and credited to the state general fund during the preceding three
15       calendar months.
16        (4) On July 1, 2003, and quarterly thereafter, the secretary of revenue
17       shall certify to the director of accounts and reports the amount equal to
18       11.25% of the total revenues received by the secretary from the taxes
19       imposed under the Kansas retailers' sales tax act and deposited in the
20       state treasury and credited to the state general fund during the preceding
21       three calendar months.
22        (5) On July 1, 2004, and quarterly thereafter, the secretary of revenue
23       shall certify to the director of accounts and reports the amount equal to
24       12% of the total revenues received by the secretary from the taxes im-
25       posed under the Kansas retailers' sales tax act and deposited in the state
26       treasury and credited to the state general fund during the preceding three
27       calendar months.
28        (b) Upon receipt of each certification under subsection (a), the director
29       of accounts and reports shall transfer from the state general fund to the
30       state highway fund an amount equal to the amount so certified, on each
31       July 1, October 1, January 1 and April 1, except that (1)(A) the amount
32       of the transfer on each such date during state fiscal year 2000 shall not
33       exceed the amount equal to 101.7% of the amount of the transfer on each
34       such date during state fiscal year 1999 and (B) the aggregate amount of
35       all such transfers during state fiscal year 2000 shall not exceed
36       $62,240,428; and (2) the amount of the transfer on each such date during
37       state fiscal year 2001 shall not exceed $12,829,480.50 $12,927,149.75. All
38       transfers made pursuant to this section are subject to reduction under
39       K.S.A. 75-6704, and amendments thereto.
40        (c) All transfers made in accordance with the provisions of this section
41       shall be considered to be demand transfers from the state general fund.
42        Sec. 70. On July 1, 2000, K.S.A. 1999 Supp. 79-34,147, as amended by
43       section 106 of 2000 House Substitute for Senate Bill No. 326, is hereby

  1       repealed.
  2        Sec. 71. Appeals to exceed position limitations. (a) The limitations im-
  3       posed by this act on the number of full-time and regular part-time posi-
  4       tions equated to full-time, excluding seasonal and temporary positions,
  5       paid from appropriations for the fiscal year ending June 30, 2000, made
  6       in chapter 132 or 160 of the 1999 Session Laws of Kansas or in or in any
  7       other appropriation act of the 2000 regular session of the legislature may
  8       be exceeded upon approval of the state finance council.
  9        (b) The limitations imposed by this act on the number of full-time and
10       regular part-time positions equated to full-time, excluding seasonal and
11       temporary positions, paid from appropriations for the fiscal year ending
12       June 30, 2001, made in chapter 132 or 160 of the 1999 Session Laws of
13       Kansas or in this or in any other appropriation act of the 2000 regular
14       session of the legislature may be exceeded upon approval of the state
15       finance council.
16        Sec. 72. Appeals to exceed expenditure limitations. Upon written ap-
17       plication to the governor and approval of the state finance council, ex-
18       penditures from special revenue funds may exceed the amounts specified
19       in this act.
20        Sec. 73. Savings. (a) Any unencumbered balance as of June 30, 2000,
21       in any special revenue fund, or account thereof, of any state agency named
22       in this act which is not otherwise specifically appropriated or limited by
23       this or other appropriation act of the 2000 regular session of the legisla-
24       ture, is hereby appropriated for the fiscal year ending June 30, 2001, for
25       the same use and purpose as the same was heretofore appropriated.
26        (b) Any unencumbered balance in any special revenue fund, or account
27       thereof, of any state agency named in section 22 of chapter 132 of the
28       1999 Session Laws of Kansas which is not otherwise specifically appro-
29       priated or limited for fiscal year 2001 by this or other appropriation act
30       of the 1999 or 2000 regular session of the legislature, is hereby appro-
31       priated for fiscal year 2001 for the same use and purpose as the same was
32       heretofore appropriated.
33        Sec. 74. Federal grants. (a) Each federal grant or other federal receipt
34       which is received by a state agency named in this act and which is not
35       otherwise appropriated to that state agency by this or other appropriation
36       act of the 2000 regular session of the legislature, is hereby appropriated
37       for the fiscal year ending June 30, 2001, for that state agency for the
38       purpose set forth in such federal grant or receipt, except that no expend-
39       iture shall be made from and no obligation shall be incurred against any
40       such federal grant or other federal receipt, which has not been previously
41       appropriated or reappropriated or approved for expenditure by the gov-
42       ernor for fiscal year 2001, until the governor has authorized the state
43       agency to make expenditures from such federal grant or other federal

  1       receipt for fiscal year 2001.
  2        (b) Each federal grant or other federal receipt which is received by a
  3       state agency named in section 22 of chapter 132 of the 1999 Session Laws
  4       of Kansas and which is not otherwise appropriated to that state agency
  5       for fiscal year 2001 by this or other appropriation act of the 1999 or 2000
  6       regular session of the legislature, is hereby appropriated for fiscal year
  7       2001 for that state agency for the purpose set forth in such federal grant
  8       or receipt, except that no expenditure shall be made from and no obli-
  9       gation shall be incurred against any such federal grant or other federal
10       receipt, which has not been previously appropriated or reappropriated or
11       approved for expenditure by the governor for fiscal year 2001, until the
12       governor has authorized the state agency to make expenditures from such
13       federal grant or other federal receipt for fiscal year 2001.
14        Sec. 75. Any transfers of money during the fiscal year ending June 30,
15       2001, from any special revenue fund of any state agency named in this
16       act to the audit services fund of the division of post audit under K.S.A.
17       46-1121 and amendments thereto shall be in addition to any expenditure
18       limitation imposed on any such fund for the fiscal year ending June 30,
19       2001.
20        Sec. 76. Any correctional institutions building fund appropriation here-
21       tofore appropriated to any state agency named in this or other appropri-
22       ation act of the 2000 regular session of the legislature, and having an
23       unencumbered balance as of June 30, 2000, in excess of $100 is hereby
24       reappropriated for the fiscal year ending June 30, 2001, for the same uses
25       and purposes as originally appropriated unless specific provision is made
26       for lapsing such appropriation.
27        Sec. 77. Any Kansas educational building fund appropriation heretofore
28       appropriated to any institution named in this or other appropriation act
29       of the 2000 regular session of the legislature and having an unencumbered
30       balance as of June 30, 2000, in excess of $100 is hereby reappropriated
31       for the fiscal year ending June 30, 2001, for the same use and purpose as
32       originally appropriated, unless specific provision is made for lapsing such
33       appropriation.
34        Sec. 78. Any state institutions building fund appropriation heretofore
35       appropriated to any state agency named in this or other appropriation act
36       of the 2000 regular session of the legislature and having an unencumbered
37       balance as of June 30, 2000, in excess of $100 is hereby reappropriated
38       for the fiscal year ending June 30, 2001, for the same use and purpose as
39       originally appropriated, unless specific provision is made for lapsing such
40       appropriation.
41        Sec. 79. This act shall take effect and be in force from and after its
42       publication in the Kansas register.
43
