9 AN ACT
concerning crimes, criminal procedure and punishment; relat-
10 ing to arson; amending
K.S.A. 21-3718 and repealing the existing
11 section.

13 Be it enacted by the Legislature of the
State of Kansas:
14 Section
1. K.S.A. 21-3718 is hereby amended to read as follows:
21-
15 3718. (a) Arson is knowingly, by means of
fire or explosive:
16 (1) Damaging any
building or property which is a dwelling in which
17 another person has any interest without the
consent of such other person;
18 or
19 (2) damaging any
building or property which is a dwelling with intent
20 to injure or defraud an insurer or
lienholder.;
21 (3) damaging
any building or property which is not a dwelling in
22 which another person has any interest
without the consent of such other
23 person; or
24 (4) damaging
any building or property which is not a dwelling with
25 intent to injure or defraud an insurer
or lienholder.
26 (b)
(1) Arson, as described in subsections (a)(1) or (2),
is a severity
27 level 5, nonperson
person felony if the property is damaged to the
extent
28 of $50,000 or more.
29 (2) Arson, as
described in subsections (a)(3) or (4), is a severity level
30 6, nonperson felony if the property
is damaged to the extent of at least
31 $25,000 but less than
$50,000.
32 (3) Arson
is a severity level 7, nonperson felony if the property
is
33 damaged to the extent of less than
$25,000.
34 Sec. 2. K.S.A. 21-3718 is hereby
repealed.
35 Sec. 3. This act shall
take effect and be in force from and after its
36 publication in the statute book.
