10             AN  ACT concerning retirement and pensions; relating to unclassified
11             employees of the board of regents; benefits; vesting.

13       Be it enacted by the Legislature of the State of Kansas:
14             Section  1. (a) Except as otherwise provided in subsection (d), a mem-
15       ber of the faculty and any other person as provided in K.S.A. 74-4925,
16       and amendments thereto, who is employed by the state board of regents
17       or by any educational institution under its governance and who is in the
18       unclassified service under the Kansas civil service act, who:
19             (1) Has not been granted a vested retirement benefit in the system
20       as provided in K.S.A. 74-4917, and amendments thereto;
21             (2) is participating in the provision of retirement annuities pursuant
22       to K.S.A. 74-4925, and amendments thereto;
23             (3) has reached the early or normal retirement dates as provided in
24       K.S.A. 74-4914, and amendments thereto; shall be eligible to receive a
25       retirement benefit based on such member's years of service notwithstand-
26       ing the vesting requirements as provided in K.S.A. 74-4917, and amend-
27       ments thereto. Receipt of such retirement benefit shall be as otherwise
28       provided by law.
29             (b) Any such member as described in subsection (a) shall be entitled
30       to use such service with a regents institution to be granted a vested re-
31       tirement benefit as provided in K.S.A. 74-4917, and amendments thereto.
32             (c) Notwithstanding any other provision of law, any such member as
33       described in subsection (a), shall be entitled to continued interest cred-
34       iting beyond five years.
35             (d) If any such member as described in subsection (a) terminates
36       service as an employee of the state board of regents and becomes an
37       eligible employee of a participating employer of the Kansas public em-
38       ployees retirement system, such member shall become a member of the
39       Kansas public employees retirement system and shall be subject to all of
40       the provisions of K.S.A. 74-4901 et seq., and amendments thereto, in-
41       cluding the vesting requirements as provided in K.S.A. 74-4917, and
42       amendments thereto.
43             (e) The provisions of this section shall be part of and supplemental

  1       to the provisions of K.S.A. 74-4901 et seq., and amendments thereto.
  2        Sec.  2. This act shall take effect and be in force from and after its
  3       publication in the statute book.
