  9             AN  ACT concerning certain county attorneys; relating to the duties
10             thereof.

12       Be it enacted by the Legislature of the State of Kansas:
13             Section  1. (a) The board of county commissioners of any county hav-
14       ing a population which is greater than 25,000 but not more than 100,000,
15       by resolution, may require that the county attorney of the county devote
16       full time to official duties and not engage in the civil practice of law,
17       except as required in performing the official duties while serving as county
18       attorney, and that the county attorney shall not refer any client or other
19       person to any designated attorney or firm of attorneys.
20             (b) Such resolution shall be published at least once each week for
21       two consecutive weeks in the official county newspaper. If within 60 days
22       following the date of the last publication, a petition protesting such res-
23       olution signed by electors equal in number to 5% of the qualified electors
24       of the county, such resolution shall not become effective until submitted
25       to and approved by a majority of the qualified electors of the county voting
26       at an election called and held thereon. Such election shall be called and
27       held at the next primary or general election of the county or at a special
28       election called and held in the manner provided by the general bond law.
29             (c) Any resolution adopted pursuant to this section shall provide that
30       the requirement that the county attorney devote full time to official duties
31       shall not become effective until the expiration of the term of office of the
32       county attorney unless such county attorney agrees to a sooner date.
33             Sec.  2. Any county attorney who is required to devote full time to
34       official duties pursuant to a resolution adopted under section 1, and
35       amendments thereto, shall receive an annual salary in an amount which
36       does not exceed, but is not less than 70% of, the amount of the salary
37       provided for district judges in K.S.A. 75-3120g, and amendments
38       thereto. 
39        Sec.  3. This act shall take effect and be in force from and after its
40       publication in the statute book.
