11 AN ACT
concerning water districts; relating to release of lands from
12 district; amending
K.S.A. 82a-630 and repealing the existing section.

14 Be it enacted by the Legislature of the
State of Kansas:
15 Section
1. K.S.A. 82a-630 is hereby amended to read as follows:
82a-
16 630. If it becomes apparent that certain
lands included within a district
17 cannot be economically or adequately served
by the facilities of the dis-
18 trict, the owners of such lands may
petition the county commissioners
19 board of directors of the
district to release those lands from the district.
20 The petition shall describe by section or
fraction thereof and by township
21 and range the lands affected and be signed
by at least seventy-five percent
22 (75%) 75% of the
total number of the owners of land desiring release
23 and be endorsed by the board of
directors of the district. After a
finding.
24 If the board of directors of the
district does not grant the petition
25 within 30 days after receipt of the
petition, the petitioners shall
26 submit the petition to the board of
county commissioners. Upon
27 receipt of such petition, the board
of county commissioners shall
28 schedule a hearing on the petition.
The county commission shall
29 give written notice of the time and
place of the hearing to the pe-
30 titioners at least 10 days before the
hearing and shall mail, by cer-
31 tified mail, return receipt
requested, written notice of the time and
32 place of the hearing, together with a
copy of the petition, to the
33 board of directors of the district
not less than 10 days before the
34 hearing. If, upon the hearing, the
board of county commissioners
35 finds that the granting of
the petition is to in the best
interests of the
36 affected landowners and the district, the
board of county commissioners
37 shall issue a certificate stating that the
lands involved are released and
38 separated from the district. Full minutes
of the hearing shall be entered
39 in the journal of the board of county
commissioners and the certificate
40 shall be delivered to the secretary of the
district who shall within thirty
41 (30) 30 days cause
the records of the district to be amended to exclude
42 the lands affected. The secretary of the
district shall transmit a copy of
43 any such certificate to the chief
engineer.

1 Sec. 2. K.S.A. 82a-630 is
hereby repealed.
2 Sec. 3. This act
shall take effect and be in force from and after its
3 publication in the Kansas
register.
