10             AN ACT making and concerning appropriations for the fiscal years ending
11             June 30, 2000, and June 30, 2001, for the Kansas dental board, state
12             bank commissioner, behavioral sciences regulatory board, legislative
13             coordinating council, legislature, division of post audit, governor's de-
14             partment, lieutenant governor, attorney general, secretary of state,
15             state treasurer, insurance department, judicial council, state board of
16             indigents' defense services, judicial branch, Kansas public employees
17             retirement system, governmental ethics commission, Kansas human
18             rights commission, state corporation commission, citizens' utility rate-
19             payer board, department of administration, state board of tax appeals,

42             authorizing certain receipts and disbursements and acts incidental to
43             the foregoing; amending K.S.A. 1999 Supp. 79-34,147 and repealing

  1             the existing section.

  3       Be it enacted by the Legislature of the State of Kansas:
  4        Section 1. (a) For the fiscal year ending June 30, 2000, appropriations
  5       are hereby made, restrictions and limitations are hereby imposed, and
  6       transfers, capital improvements projects, fees, receipts, disbursements
  7       and acts incidental to the foregoing are hereby directed or authorized as
  8       provided in sections 2 through 74 [75] of this act.
  9        (b) For the fiscal year ending June 30, 2001, appropriations are hereby
10       made, restrictions and limitations are hereby imposed, and transfers, cap-
11       ital improvement projects, fees, receipts, disbursements and acts inciden-
12       tal to the foregoing are hereby directed or authorized as provided in
13       sections 3, 4, 72 and 73 [73 and 74] of this act.
14        (c) This act shall not be subject to the provisions of subsection (a) of
15       K.S.A. 75-6702 and amendments thereto.
16        Sec. 2.
17      
KANSAS DENTAL BOARD
18        (a) On the effective date of this act, the expenditure limitation estab-
19       lished for the fiscal year ending June 30, 2001, by section 10(a) of chapter
20       132 of the 1999 Session Laws of Kansas on the dental board fee fund is
21       hereby increased from $258,179 to $298,179.
22        Sec. 3.

STATE BANK COMMISSIONER
24        (a) On the effective date of this act, the expenditure limitation estab-
25       lished for the fiscal year ending June 30, 2000, by section 4(a) of chapter
26       132 of the 1999 Session Laws of Kansas on the bank commissioner fee
27       fund is hereby decreased from $3,750,515 to $3,728,927.
28        (b) On July 1, 2000, the expenditure limitation established for the fiscal
29       year ending June 30, 2001, by section 4(a) of chapter 132 of the 1999
30       Session Laws of Kansas on the bank commissioner fee fund is hereby
31       decreased from $3,845,899 to $3,784,474.
32        Sec. 4.

BEHAVIORAL SCIENCES REGULATORY BOARD
34        (a) On the effective date of this act, the expenditure limitation estab-
35       lished for the fiscal year ending June 30, 2000, by section 35(a) of chapter
36       160 of the 1999 Session Laws of Kansas on the behavioral sciences reg-
37       ulatory board fee fund is hereby increased from $421,736 to $430,504.
38        (b) On July 1, 2000, the expenditure limitation established for the fiscal
39       year ending June 30, 2001, by section 6(a) of chapter 132 of the 1999
40       Session Laws of Kansas on the behavioral sciences regulatory board fee
41       fund is hereby increased from $399,536 to $424,641.
42        (c) On July 1, 2000, the position limitation established for the fiscal
43       year ending June 30, 2001, by section 22 of chapter 132 of the 1999
44       Session Laws of Kansas for the behavioral sciences regulatory board is

  1       hereby increased from 6.8 to 7.8.
  2        Sec. 5.
  3      
LEGISLATIVE COORDINATING COUNCIL
  4        (a) On the effective date of this act, of the $620,964 appropriated for
  5       the above agency for the fiscal year ending June 30, 2000, by section 24(a)
  6       of chapter 132 of the 1999 Session Laws of Kansas from the state general
  7       fund in the legislative coordinating council -- operations account, the
  8       sum of $106,651 is hereby lapsed.
  9        (b) On the effective date of this act, of the $2,325,509 appropriated for
10       the above agency for the fiscal year ending June 30, 2000, by section 24(a)
11       of chapter 132 of the 1999 Session Laws of Kansas from the state general
12       fund in the legislative research department -- operations account, the
13       sum of $63,744 is hereby lapsed.
14        (c) On the effective date of this act, of the $1,982,995 appropriated for
15       the above agency for the fiscal year ending June 30, 2000, by section 24(a)
16       of chapter 132 of the 1999 Session Laws of Kansas from the state general
17       fund in the office of revisor of statutes -- operations account, the sum of
18       $29,940 is hereby lapsed.
19        Sec. 6.

LEGISLATURE
21        (a) On the effective date of this act, of the $12,056,411 appropriated
22       for the above agency for the fiscal year ending June 30, 2000, by section
23       25(a) of chapter 132 of the 1999 Session Laws of Kansas from the state
24       general fund in the operations (including official hospitality) account, the
25       sum of $751,441 is hereby lapsed.
26        Sec. 7.

DIVISION OF POST AUDIT
28        (a) On the effective date of this act, of the $1,566,913 appropriated for
29       the above agency for the fiscal year ending June 30, 2000, by section 26(a)
30       of chapter 132 of the 1999 Session Laws of Kansas from the state general
31       fund in the operations (including legislative post audit committee) ac-
32       count, the sum of $44,478 is hereby lapsed.
33        Sec. 8.

GOVERNOR'S DEPARTMENT
35        (a) On the effective date of this act, of the $1,849,391 appropriated for
36       the above agency for the fiscal year ending June 30, 2000, by section 27(a)
37       of chapter 132 of the 1999 Session Laws of Kansas from the state general
38       fund in the governor's department account, the sum of $19,340 is hereby
39       lapsed.
40        Sec. 9.

LIEUTENANT GOVERNOR
42        (a) On the effective date of this act, of the $129,546 appropriated for
43       the above agency for the fiscal year ending June 30, 2000, by section 28(a)

  1       of chapter 132 of the 1999 Session Laws of Kansas from the state general
  2       fund in the operations account, the sum of $50,928 is hereby lapsed.
  3        Sec. 10.

ATTORNEY GENERAL
  5        (a) On the effective date of this act, the director of accounts and reports
  6       shall transfer $475,609 from the operating expenditures relating to inter-
  7       state water rights regarding the Republican river and its tributaries ac-
  8       count of the state general fund of the attorney general to the additional
  9       operating expenditures for investigation and litigation regarding interstate
10       water rights account of the state general fund of the attorney general.
11        (b) On the effective date of this act, of the $1,015,000 appropriated for
12       the above agency for the fiscal year ending June 30, 2000, by section 29(a)
13       of chapter 132 of the 1999 Session Laws of Kansas from the state general
14       fund in the operating expenditures relating to interstate water rights re-
15       garding the Republican river and its tributaries account, the sum of
16       $288,277 is hereby lapsed.
17        Sec. 11.

SECRETARY OF STATE
19        (a) There is appropriated for the above agency from the state general
20       fund the following:
21       Presidential preference primary $1,500,000
22        (b) On the effective date of this act, of the $2,086,754 appropriated for
23       the above agency for the fiscal year ending June 30, 2000, by section 30(a)
24       of chapter 132 of the 1999 Session Laws of Kansas from the state general
25       fund in the operating expenditures account, the sum of $20,596 is hereby
26       lapsed.
27        Sec. 12.

STATE TREASURER
29        (a) On the effective date of this act, of the $1,726,816 appropriated for
30       the above agency for the fiscal year ending June 30, 2000, by section 31(a)
31       of chapter 132 of the 1999 Session Laws of Kansas from the state general
32       fund in the operating expenditures account, the sum of $210,639 is hereby
33       lapsed.
34        (b) On the effective date of this act, of the $340,000 appropriated for
35       the above agency for the fiscal year ending June 30, 2000, by section 31(a)
36       of chapter 132 of the 1999 Session Laws of Kansas from the state general
37       fund in the banking services account, the sum of $25,000 is hereby lapsed.
38        Sec. 13.

INSURANCE DEPARTMENT
40        (a) On the effective date of this act, the expenditure limitation estab-
41       lished for the fiscal year ending June 30, 2000, by section 32(a) of chapter
42       132 of the 1999 Session Laws of Kansas on the insurance department
43       service regulation fund is hereby decreased from $6,846,969 to

  2        Sec. 14.

JUDICIAL COUNCIL
  4        (a) On the effective date of this act, of the $248,199 appropriated for
  5       the above agency for the fiscal year ending June 30, 2000, by section 34(a)
  6       of chapter 132 of the 1999 Session Laws of Kansas from the state general
  7       fund in the operating expenditures account, the sum of $42,157 is hereby
  8       lapsed.
  9        Sec. 15.

STATE BOARD OF INDIGENTS' DEFENSE SERVICES
11        (a) On the effective date of this act, of the $12,256,991 appropriated
12       for the above agency for the fiscal year ending June 30, 2000, by section
13       35(a) of chapter 132 of the 1999 Session Laws of Kansas from the state
14       general fund in the operating expenditures account, the sum of $435,455
15       is hereby lapsed.
16        Sec. 16.

JUDICIAL BRANCH
18        (a) On the effective date of this act, of the $76,179,060 appropriated
19       for the above agency for the fiscal year ending June 30, 2000, by section
20       36(a) of chapter 132 of the 1999 Session Laws of Kansas from the state
21       general fund in the judiciary operations account, the sum of $779,980 is
22       hereby lapsed.
23        Sec. 17.

KANSAS PUBLIC EMPLOYEES RETIREMENT SYSTEM
25        (a) On the effective date of this act, the expenditure limitation estab-
26       lished for the fiscal year ending June 30, 2000, by section 37(b) of chapter
27       132 of the 1999 Session Laws of Kansas on the agency operations account
28       of the Kansas public employees retirement fund is hereby decreased from
29       $4,986,334 to $4,918,994.
30        (b) On the effective date of this act, the expenditure limitation estab-
31       lished for the fiscal year ending June 30, 2000, by section 37(b) of chapter
32       132 of the 1999 Session Laws of Kansas on the investment related ex-
33       penses account of the Kansas public employees retirement fund is hereby
34       increased from $24,803,544 to $26,644,408.
35        Sec. 18.

GOVERNMENTAL ETHICS COMMISSION
37        (a) There is appropriated for the above agency from the state general
38       fund the following:
39       Operating expenditures $4,336
40        (b) On the effective date of this act, the expenditure limitation estab-
41       lished by section 38(b) of chapter 132 of the 1999 Session Laws of Kansas
42       on the governmental ethics commission fee fund is hereby increased from
43       $171,956 to $175,297.

KANSAS HUMAN RIGHTS COMMISSION
  3        (a) On the effective date of this act, of the $1,455,796 appropriated for
  4       the above agency for the fiscal year ending June 30, 2000, by section 39(a)
  5       of chapter 132 of the 1999 Session Laws of Kansas from the state general
  6       fund in the operating expenditures account, the sum of $50,311 is hereby
  7       lapsed.
  8        Sec. 20.
  9      
STATE CORPORATION COMMISSION
10        (a) On the effective date of this act, the expenditure limitation estab-
11       lished by section 40(b) of chapter 132 of the 1999 Session Laws of Kansas
12       on the aggregate expenditures from the public service regulation fund,
13       the motor carrier license fees fund and the conservation fee fund is
14       hereby decreased from $12,618,403 to $11,868,452.
15        (b) On the effective date of this act, the director of accounts and reports
16       shall transfer $400,000 from the abandoned oil and gas well fund of the
17       state corporation commission to the state general fund.
18        (c) On the effective date of this act, the position limitation established
19       by section 90(a) of chapter 132 of the 1999 Session Laws of Kansas for
20       the state corporation commission is hereby decreased from 211.0 to
21       209.0.
22        Sec. 21.

CITIZENS' UTILITY RATEPAYER BOARD
24        (a) On the effective date of this act, the expenditure limitation estab-
25       lished by section 41(a) of chapter 132 of the 1999 Session Laws of Kansas
26       on the utility regulatory fee fund is hereby increased from $457,793 to
27       $465,388.
28        (b) On the effective date of this act, the director of accounts and reports
29       shall transfer all moneys in the gifts and donations fund to the utility
30       regulatory fee fund. On the effective date of this act, all liabilities of the
31       gifts and donations fund are hereby transferred to and imposed on the
32       utility regulatory fee fund and the gifts and donations fund is hereby
33       abolished.
34        Sec. 22.
35      
DEPARTMENT OF ADMINISTRATION
36        (a) On the effective date of this act, of the $344,567 appropriated for
37       the above agency for the fiscal year ending June 30, 2000, by section 42(a)
38       of chapter 132 of the 1999 Session Laws of Kansas from the state general
39       fund in the performance review board account, the sum of $151,322 is
40       hereby lapsed.
41        (b) On the effective date of this act, of the $1,323,554 appropriated for
42       the above agency for the fiscal year ending June 30, 2000, by section 42(a)
43       of chapter 132 of the 1999 Session Laws of Kansas from the state general

  1       fund in the budget analysis account, the sum of $14,793 is hereby lapsed.
  2        (c) On the effective date of this act, of the $133,375 appropriated for
  3       the above agency for the fiscal year ending June 30, 2000, by section 42(a)
  4       of chapter 132 of the 1999 Session Laws of Kansas from the state general
  5       fund in the policy analysis initiatives account, the sum of $2,713 is hereby
  6       lapsed.
  7        (d) On the effective date of this act, of the $2,075,212 appropriated for
  8       the above agency for the fiscal year ending June 30, 2000, by section 42(a)
  9       of chapter 132 of the 1999 Session Laws of Kansas from the state general
10       fund in the public broadcasting council grants account, the sum of $3,177
11       is hereby lapsed.
12        (e) On the effective date of this act, of the $250,000 appropriated for
13       the above agency for the fiscal year ending June 30, 2000, by section 42(a)
14       of chapter 132 of the 1999 Session Laws of Kansas from the state general
15       fund in the year 2000 readiness reviews account, the sum of $6,373 is
16       hereby lapsed.
17        (f) On the effective date of this act, of the $139,858 appropriated for
18       the above agency for the fiscal year ending June 30, 2000, by section 42(a)
19       of chapter 132 of the 1999 Session Laws of Kansas from the state general
20       fund in the long-term care ombudsman account, the sum of $1,158 is
21       hereby lapsed.
22        (g) On the effective date of this act, of the $18,043,940 appropriated
23       for the above agency for the fiscal year ending June 30, 2000, by section
24       42(a) of chapter 132 of the 1999 Session Laws of Kansas from the state
25       general fund in the department of administration operations account, the
26       sum of $36,928 is hereby lapsed.
27        (h) On June 30, 2000, any unencumbered balance as of June 30, 2000,
28       in each of the following accounts of the state general fund is hereby
29       lapsed: Paint and grounds shop -- debt service.
30        (i) (1) On the effective date of this act, of the amount of the unencum-
31       bered balance appropriated for the above agency for the fiscal year ending
32       June 30, 2000, by section 42(a) of chapter 132 of the 1999 Session Laws
33       of Kansas in the year 2000 computer repair for state agencies account of
34       the state general fund, the sum of $130,831 is hereby lapsed.
35        (2) On the effective date of this act and after the lapse prescribed by
36       subsection (i)(1), the director of accounts and reports shall transfer from
37       the year 2000 computer repair for state agencies account of the state
38       general fund to the department of administration operations account of
39       the state general fund, the amount of $249,509 or the unencumbered
40       balance that remains credited in the year 2000 computer repair for state
41       agencies account of the state general fund if such balance is less than
42       $249,509.
43        (j) On the effective date of this act, of the amount of the unencumbered

  1       balance appropriated for the above agency for the fiscal year ending June
  2       30, 2000, by section 153(a) of chapter 132 of the 1999 Session Laws of
  3       Kansas in the fire and safety alarms -- statehouse account of the state
  4       general fund, the sum of $98,779 is hereby lapsed.
  5        (k) In addition to the other purposes for which expenditures may be
  6       made by the above agency from the state buildings depreciation fund for
  7       the fiscal year ending June 30, 2000, expenditures may be made by the
  8       above agency from the following capital improvement account or accounts
  9       of the state buildings depreciation fund during fiscal year 2000 for the
10       following capital improvement project or projects, subject to the expend-
11       iture limitations prescribed therefor:
12       Landon fail safe power supply $1,050,000
13       Docking heating, ventilation and air condition systemrenovations $275,000
14       Landon security improvements $110,000
15        (l) There is appropriated for the above agency from the following spe-
16       cial revenue fund or funds all moneys now or hereafter lawfully credited
17       to and available in such fund or funds, except that expenditures other
18       than refunds or indirect cost recoveries authorized by law shall not exceed
19       the following:
20       Facilities conservation improvement fund --administration No limit
21       State revolving fund services fee fund No limit
22        (m) In addition to the other purposes for which expenditures may be
23       made from the state budget stabilization fund for fiscal year 2000, ex-
24       penditures may be made by the above agency from the state budget sta-
25       bilization fund for fiscal year 2000 for the following capital improvement
26       project or projects, subject to the expenditure limitation prescribed there-
27       for:
28       Statehouse fire and safety alarms $98,799
29       Provided, That all expenditures from each such capital improvement ac-
30       count shall be in addition to any expenditure limitation imposed on the
31       state budget stabilization fund for fiscal year 2000.
32        (n) On the effective date of this act, the expenditure limitation estab-
33       lished for the fiscal year ending June 30, 2000, by section 12(e) of chapter
34       160 of the 1999 Session Laws of Kansas on the architectural services
35       recovery fund is hereby decreased from $1,497,412 to $1,471,061.
36        (o) On the effective date of this act, the expenditure limitation estab-
37       lished by section 12(j) of chapter 160 of the 1999 Session Laws of Kansas
38       on the salaries and wages and other operating expenditures account of
39       the cafeteria benefits fund is hereby decreased from $2,322,792 to
40       $2,087,251.
41        (p) On the effective date of this act, the position limitation established

  1       by section 12(a) of chapter 160 of the 1999 Session Laws of Kansas for
  2       the department of administration is hereby decreased from 889.4 to
  3       885.4.
  4        Sec. 23.
  5      
STATE BOARD OF TAX APPEALS
  6        (a) On the effective date of this act, of the $2,335,988 appropriated for
  7       the above agency for the fiscal year ending June 30, 2000, by section 43(a)
  8       of chapter 132 of the 1999 Session Laws of Kansas from the state general
  9       fund in the operating expenditures account, the sum of $651,086 is hereby
10       lapsed.
11        (b) On the effective date of this act, the expenditure limitation estab-
12       lished by section 43(b) of chapter 132 of the 1999 Session Laws of Kansas
13       on the duplicating fees fund is hereby decreased from no limit to $14,500.
14        (c) On the effective date of this act, the position limitation established
15       by section 90(a) of chapter 132 of the 1999 Session Laws of Kansas for
16       the state board of tax appeals is hereby decreased from 37.0 to 31.0.
17        Sec. 24.

DEPARTMENT OF REVENUE
19        (a) On the effective date of this act, of the $31,051,780 appropriated
20       for the above agency by section 44(a) of chapter 132 of the 1999 Session
21       Laws of Kansas from the state general fund in the operating expenditures
22       account, the sum of $631,601 is hereby lapsed.
23        (b) On the effective date of this act, the expenditure limitation estab-
24       lished for the fiscal year ending June 30, 2000, by section 11(d) of chapter
25       160 of the 1999 Session Laws of Kansas on the division of vehicles op-
26       erating fund is hereby decreased from $36,155,674 to $36,148,484.
27        (c) On the effective date of this act, the expenditure limitation estab-
28       lished for the fiscal year ending June 30, 2000, by section 11(e) of chapter
29       160 of the 1999 Session Laws of Kansas on the salaries and wages account
30       of the division of vehicles operating fund is hereby increased from
31       $17,144,750 to $17,798,331.
32        (d) On the effective date of this act, the expenditure limitation estab-
33       lished by section 44(b) of chapter 132 of the 1999 Session Laws of Kansas
34       on the state bingo regulation fund is hereby increased from $332,750 to
35       $345,958.
36        (e) On the effective date of this act, the expenditure limitation estab-
37       lished by section 44(b) of chapter 132 of the 1999 Session Laws of Kansas
38       on the electronic databases fee fund is hereby increased from $4,675,000
39       to $5,125,000.
40        [(f) On and after the effective date of this act, expenditures from
41       moneys appropriated to the department of revenue shall be made
42       by the secretary of revenue during the remainder of fiscal year 2000
43       to provide for corporate income tax audits at least equal in number

  1       to the average monthly number of corporate income tax audits, cal-
  2       culated in a comparable manner, conducted by the department of
  3       revenue for the comparable period from fiscal year 1996 through
  4       fiscal year 1998.]
  5        Sec. 25.
  6      
KANSAS LOTTERY
  7        (a) On the effective date of this act, the expenditure limitation estab-
  8       lished by section 45(a) of chapter 132 of the 1999 Session Laws of Kansas
  9       on the lottery operating fund is hereby decreased from $8,641,218 to
10       $8,616,937.
11        Sec. 26.
12      
KANSAS RACING AND GAMING COMMISSION
13        (a) On the effective date of this act, the expenditure limitation estab-
14       lished for the fiscal year ending June 30, 2000, by section 46(a) of chapter
15       132 of the 1999 Session Laws of Kansas on the state racing fund is hereby
16       decreased from $3,301,917 to $3,283,383.
17        Sec. 27.

DEPARTMENT OF COMMERCE AND HOUSING
19        (a) On the effective date of this act, of the $2,244,177 appropriated for
20       the above agency for the fiscal year ending June 30, 2000, by section 47(a)
21       of chapter 132 of the 1999 Session Laws of Kansas from the state general
22       fund in the state operations account, the sum of $26,382 is hereby lapsed.
23        Sec. 28.
24      
KANSAS, INC.
25        (a) On the effective date of this act, of the $197,659 appropriated for
26       the above agency for the fiscal year ending June 30, 2000, by section 48(a)
27       of chapter 132 of the 1999 Session Laws of Kansas from the state general
28       fund in the Kansas, Inc. account, the sum of $15,097 is hereby lapsed.
29        Sec. 29.
30      
KANSAS TECHNOLOGY ENTERPRISE CORPORATION
31        (a) On the effective date of this act, the amount of $1,119,279 directed
32       by section 49(d) of chapter 132 of the 1999 Session Laws of Kansas to be
33       transferred by the director of accounts and reports on August 15, 1999,
34       and on the 15th day of each month thereafter during the fiscal year ending
35       June 30, 2000, or as soon after each such date as moneys are available,
36       from the Kansas economic development endowment account of the state
37       economic development initiatives fund of the department of commerce
38       and housing to the economic development research and development
39       fund of the Kansas technology enterprise corporation, is hereby decreased
40       to an amount determined by the director of accounts and reports pursuant
41       to this subsection. The amount of each such transfer on and after the
42       effective date of this act during fiscal year 2000 shall be the amount
43       determined by the director of accounts and reports so that the aggregate

  1       of all amounts transferred from the Kansas economic development en-
  2       dowment account of the state economic development initiatives fund of
  3       the department of commerce and housing to the economic development

18       on the children's health care programs -- smoking prevention grants fund
19       is hereby increased from $0 to $500,000.
20        (q) On the effective date of this act, the expenditure limitation estab-

22       on the adult care licensing revolving fund is hereby increased from $0 to
23       no limit.
24        (r) On the effective date of this act, the expenditure limitation estab-

26       on the salaries and wages account of the insurance statistical plan fund is
27       hereby increased from $148,321 to $155,340.
28        (s) On the effective date of this act, the expenditure limitation estab-

41        (v) (1) On the effective date of this act, the director of accounts and
42       reports shall transfer from the air quality fee fund of the department of
43       health and environment to the state general fund the amount equal to

  1       the aggregate of all amounts of interest credited to the air quality fee fund
  2       pursuant to K.S.A. 1999 Supp. 65-3024 and amendments thereto during
  3       the fiscal year ending June 30, 2000, prior to the effective date of this
  4       act.
  5        (2) On and after the effective date of this act, during the fiscal year
  6       ending June 30, 2000, the director of accounts and reports shall not make
  7       the transfers of amounts of interest earnings from the state general fund
  8       to the air quality fee fund of the department of health and environment
  9       which are directed to be made on or before the 10th day of each month
10       by K.S.A. 1999 Supp. 65-3024 and amendments thereto.
11        (w) On the effective date of this act and on the first day of each month
12       thereafter, the director of accounts and reports shall transfer from the
13       food inspection fee fund to the food service inspection reimbursement
14       fund an amount equal to 80% of all fees received during the fiscal year
15       ending June 30, 2000, and credited to the food inspection fee fund for
16       food service inspection services that are provided by a local agency under
17       contract with the secretary of health and environment to inspect food
18       service establishments located in a municipality.

23       shall transfer all moneys in the EDIF cyclical maintenance projects fund
24       of the state historical society to the state economic development initiatives
25       fund of the department of commerce and housing. On the effective date
26       of this act, all liabilities of the EDIF cyclical maintenance projects fund
27       of the state historical society are hereby transferred to and imposed on
28       the state economic development initiatives fund of the department of
29       commerce and housing and the EDIF cyclical maintenance projects fund
30       of the state historical society is hereby abolished.

22       shall transfer all moneys in the Jetmore Lake EDIF grant fund of the
23       state conservation commission to the state economic development initia-
24       tives fund of the department of commerce and housing. On the effective
25       date of this act, all liabilities of the Jetmore Lake EDIF grant fund of the
26       state conservation commission are hereby transferred to and imposed on
27       the state economic development initiatives fund of the department of
28       commerce and housing and the Jetmore Lake EDIF grant fund of the
29       state conservation commission is hereby abolished.
30        (c) On the effective date of this act, the director of accounts and reports
31       shall transfer all moneys in the Centralia site 50 fund of the state con-
32       servation commission to the state conservation storage water supply fund
33       of the Kansas water office. On the effective date of this act, all liabilities
34       of the Centralia site 50 fund of the state conservation commission are
35       hereby transferred to and imposed on the state conservation storage water
36       supply fund of the Kansas water office and the Centralia site 50 fund of
37       the state conservation commission is hereby abolished.
38        (d) On the effective date of this act, the director of accounts and reports
39       shall transfer $103,755 in the Wellington Lake fund of the state conser-
40       vation commission to the state conservation storage water supply fund of
41       the Kansas water office and shall transfer $19,196 in the Wellington Lake
42       fund of the state conservation commission to the state water plan fund of
43       the Kansas water office. On the effective date of this act, all liabilities of

  1       the Wellington Lake fund of the state conservation commission are
  2       hereby transferred to and imposed on the state conservation storage water
  3       supply fund of the Kansas water office and the Wellington Lake fund of
  4       the state conservation commission is hereby abolished.
  5        Sec. 67.
  6      
KANSAS WATER OFFICE
  7        (a) On the effective date of this act, of the $1,450,321 appropriated for
  8       the above agency for the fiscal year ending June 30, 2000, by section 87(a)
  9       of chapter 132 of the 1999 Session Laws of Kansas from the state general
10       fund in the water resources operating expenditures account, the sum of
11       $43,599 is hereby lapsed.
12        (b) On the effective date of this act, the expenditure limitation estab-
13       lished by section 87(b) of chapter 132 of the 1999 Session Laws of Kansas
14       on the state water plan fund is hereby increased from $2,626,418 to
15       $2,769,857.
16        (c) On the effective date of this act, the director of accounts and reports
17       shall transfer $60,000 from the state water plan fund to the state general
18       fund.
19        Sec. 68.

DEPARTMENT OF WILDLIFE AND PARKS
21        (a) On the effective date of this act, of the $4,159,932 appropriated for
22       the above agency for the fiscal year ending June 30, 2000, by section 88(a)
23       of chapter 132 of the 1999 Session Laws of Kansas from the state general
24       fund in the operating expenditures account, the sum of $669,641 is hereby
25       lapsed.
26        (b) On the effective date of this act, the position limitation established
27       by section 90(a) of chapter 132 of the 1999 Session Laws of Kansas for
28       the department of wildlife and parks is hereby decreased from 395.5 to
29       393.5.
30        (c) On the effective date of this act, the expenditure limitation estab-
31       lished by section 88(b) of chapter 132 of the 1999 Session Laws of Kansas
32       on the wildlife fee fund is hereby decreased from $20,326,400 to
33       $19,678,834.
34        (d) [c] On the effective date of this act, the expenditure limitation
35       established by section 88(b) of chapter 132 of the 1999 Session Laws of
36       Kansas on the parks fee fund is hereby increased from $3,631,814 to
37       $4,134,661.
38        (e) [d] On the effective date of this act, any unencumbered balance in
39       each of the following capital improvement accounts of the state general
40       fund is hereby lapsed: Flood damage repair.
41        (f) [e] On the effective date of this act, of the $101,500 appropriated
42       for the above agency for the fiscal year ending June 30, 2000, by section
43       169(a) of chapter 132 of the 1999 Session Laws of Kansas from the state

  1       general fund in the handicapped accessibility renovation account, the sum
  2       of $58,313 is hereby lapsed.
  3        (g) [f] On the effective date of this act, the amount of the unencum-
  4       bered balance appropriated for the above agency for the fiscal year ending
  5       June 30, 2000, by section 169(g) of chapter 132 of the 1999 Session Laws
  6       of Kansas from the state budget stabilization fund in each of the following
  7       accounts is hereby lapsed: State budget stabilization fund ADA capital
  8       improvements; state budget stabilization fund ADA accessibility.
  9        Sec. 69.

DEPARTMENT OF TRANSPORTATION
11        (a) On the effective date of this act, the expenditure limitation estab-
12       lished by section 4(c) of chapter 160 of the 1999 Session Laws of Kansas
13       on the agency operations account of the state highway fund is hereby
14       decreased from $212,487,075 to $206,946,902.
15        (b) On the effective date of this act, if the aggregate of the amounts
16       transferred from the state general fund to the state highway fund prior
17       to the effective date of this act during the fiscal year ending June 30,
18       2000, pursuant to K.S.A. 79-34,147 and amendments thereto, exceeds
19       $62,240,428, then the director of accounts and reports shall transfer from
20       the state highway fund to the state general fund the amount equal to the
21       difference between such aggregate of the amounts transferred to the state
22       highway fund and $62,240,428.
23        Sec. 70. (a) Notwithstanding the provisions of subsection (4) of K.S.A.
24       74-4927 and amendments thereto, no participating employer under the
25       Kansas public employees retirement system shall pay any amount to the
26       system for the cost of the plan of death and long-term disability benefits
27       under subsection (4) of K.S.A. 74-4927 and amendments thereto for the
28       period from April 1, 2000, through June 30, 2000.
29        (b) On the effective date of this act, the amount in each account of the
30       state general fund of each state agency that is appropriated for the fiscal
31       year ending June 20, 2000, by chapter 132 or chapter 160 of the 1999
32       Session Laws of Kansas or by this act and that is budgeted for payment
33       of the cost of the plan of death and long-term disability benefits under
34       subsection (4) of K.S.A. 74-4927 and amendments thereto, as certified
35       by the director of the budget to the director of accounts and reports, for
36       the period from April 1, 2000, through June 30, 2000, is hereby lapsed.
37        [Sec. 71. (a) Notwithstanding the provisions of K.S.A. 25-4501
38       through 25-4508 and amendments thereto or any other statute, no
39       presidential preference primary election shall be held on the first
40       Tuesday in April of the year 2000 and no actions shall be taken or
41       expenses incurred by the secretary of state, by any county election
42       officer or by any other state or local governmental officer or em-
43       ployee for a presidential preference primary election on the first

  1       Tuesday in April of the year 2000. The secretary of state shall re-
  2       fund any fees received from candidates for political party nomina-
  3       tions for president of the United States prior to the effective date of
  4       this act.
  5        [(b) On the effective date of this act, the provisions of K.S.A. 25-
  6       4501 through 25-4508 and amendments thereto are hereby sus-
  7       pended and shall have no force and effect during the period com-
  8       mencing on the effective date of this act and ending on June 30,
  9       2000.
10        [(c) The secretary of state is hereby directed to undertake to de-
11       velop, in cooperation with at least six other states in the mid-western
12       region of the United States, a regional presidential primary election
13       by having a presidential primary election scheduled on a common
14       date by each such state. The secretary of state shall report to the
15       2001 regular session of the legislature progress made toward such
16       a regional presidential primary election and any recommendations
17       relating to such regional presidential primary election which the
18       secretary of state may deem appropriate.
19        [Sec. 72. (a) On the effective date of this act, all positions of of-
20       ficers or employees of each state agency named in chapter 132 of
21       the 1999 Session Laws of Kansas that are vacant as of January 1,
22       2000, and that have been vacant for a continuous period of 60
23       months or more, as determined by the director of the budget in
24       consultation with the director of personnel services, are hereby
25       abolished and no moneys appropriated for any such state agency
26       for the fiscal year ending June 30, 2000, from the state general fund
27       or any special revenue fund by chapter 132 or 160 of the 1999
28       Session Laws of Kansas or by this or other appropriation act of the
29       2000 regular session of the legislature, shall be expended for any
30       such abolished position.
31        [(b) On the effective date of this act, the position limitations es-
32       tablished by sections 22 and 90(a) of chapter 132 of the 1999 Ses-
33       sion Laws of Kansas, as amended by chapter 160 of the 1999 Session
34       Laws of Kansas or by this act or other appropriation act of the 2000
35       regular session of the legislature or as established by the state fi-
36       nance council on the number of full-time and regular part-time po-
37       sitions equated to full-time for the fiscal year ending June 30, 2000,
38       for the state agencies for which such position limitations are estab-
39       lished and for which positions are abolished under subsection (a),
40       are hereby decreased accordingly for each such agency by the full-
41       time equivalent number of such abolished positions.]
42        Sec. 71. [73.] K.S.A. 1999 Supp. 79-34,147 is hereby amended to
43       read as follows: 79-34,147. (a) (1) On July 1, 1999, and quarterly thereafter

  1       the secretary of revenue shall certify to the director of accounts and re-
  2       ports the amount equal to 7.628% of the total revenues received by the
  3       secretary from the taxes imposed under the Kansas retailers' sales tax act
  4       and deposited in the state treasury and credited to the state general fund
  5       during the preceding three calendar months.
  6        [(2) On July 1, 2001, and quarterly thereafter, the secretary of revenue
  7       shall certify to the director of accounts and reports the amount equal to
  8       9.5% of the total revenues received by the secretary from the taxes im-
  9       posed under the Kansas retailers' sales tax act and deposited in the state
10       treasury and credited to the state general fund during the preceding three
11       calendar months.
12        (3) On July 1, 2002, and quarterly thereafter, the secretary of revenue
13       shall certify to the director of accounts and reports the amount equal to
14       11% of the total revenues received by the secretary from the taxes im-
15       posed under the Kansas retailers' sales tax act and deposited in the state
16       treasury and credited to the state general fund during the preceding three
17       calendar months.
18        (4) On July 1, 2003, and quarterly thereafter, the secretary of revenue
19       shall certify to the director of accounts and reports the amount equal to
20       11.25% of the total revenues received by the secretary from the taxes
21       imposed under the Kansas retailers' sales tax act and deposited in the
22       state treasury and credited to the state general fund during the preceding
23       three calendar months.
24        (5) On July 1, 2004, and quarterly thereafter, the secretary of revenue
25       shall certify to the director of accounts and reports the amount equal to
26       12% of the total revenues received by the secretary from the taxes im-
27       posed under the Kansas retailers' sales tax act and deposited in the state
28       treasury and credited to the state general fund during the preceding three
29       calendar months.
30        (b) Upon receipt of each certification under subsection (a), the director
31       of accounts and reports shall transfer from the state general fund to the
32       state highway fund an amount equal to the amount so certified, on each
33       July 1, October 1, January 1 and April 1, except that (1)(A) the amount
34       of the transfer on each such date during state fiscal year 2000 shall not
35       exceed the amount equal to 101.7% of the amount of the transfer on each
36       such date during state fiscal year 1999 and (B) the aggregate amount of
37       all such transfers during state fiscal year 2000 shall not exceed
38       $62,240,428; and (2) the amount of the transfer on each such date during
39       state fiscal year 2001 shall not exceed the amount equal to 101.7% of the
40       amount transferred on the same date during state fiscal year 2000. All
41       transfers made pursuant to this section are subject to reduction under
42       K.S.A. 75-6704, and amendments thereto.
43        (c) All transfers made in accordance with the provisions of this section

  1       shall be considered to be demand transfers from the state general fund.
  2        Sec. 72. [74.] Appeals to exceed position limitations. (a) The limita-
  3       tions imposed by this act on the number of full-time and regular part-
  4       time positions equated to full-time, excluding seasonal and temporary po-
  5       sitions, paid from appropriations for the fiscal year ending June 30, 2000,
  6       made in this act or in any appropriation act of the 1999 regular session
  7       of the legislature or in any other appropriation act of the 2000 regular
  8       session of the legislature may be exceeded upon approval of the state
  9       finance council.
10        (b) The limitations imposed by this act on the number of full-time and
11       regular part-time positions equated to full-time, excluding seasonal and
12       temporary positions, paid from appropriations for the fiscal year ending
13       June 30, 2001, made in this act or in any other appropriation act of the
14       2000 regular session of the legislature may be exceeded upon approval of
15       the state finance council.
16        Sec. 73. [75.] Appeals to exceed limitations. Upon written application
17       to the governor and approval of the state finance council, expenditures
18       from special revenue funds may exceed the amounts specified in this act.
19        Sec. 74. [76.] K.S.A. 1999 Supp. 79-34,147 is hereby repealed.
20        Sec. 75. [77.] This act shall take effect and be in force from and after
21       its publication in the Kansas register.
