9 AN ACT
concerning the issuance of certain distinctive license plates;
10 amending K.S.A. 1999
Supp. 8-1,141 and repealing the existing
11 section.

13 Be it enacted by the Legislature of the
State of Kansas:
14 New Section
1. (a) As used in this section, ``Native American Indian
15 tribe'' or ``tribe'' means the following
resident Kansas Native American
16 Indian tribes:
17 (1) The Iowa
Tribe of Kansas and Nebraska.
18 (2) The Kickapoo
Tribe in Kansas.
19 (3) The Prairie
Band Potawatomi Nation of Kansas.
20 (4) The Sac and
Fox Nation of Missouri in Kansas and Missouri.
21 (b) The owner or
lessee of one or more passenger vehicles or trucks
22 registered for a gross weight of not more
than 20,000 pounds who is an
23 enrolled member of a Native American Indian
tribe and a resident of
24 Kansas may be issued one distinctive
license plate designed for the spec-
25 ified tribe for each such passenger vehicle
or truck. Such license plates
26 shall be issued for the same period of time
as other license plates upon
27 payment of a $5 fee and upon proper
registration as provided in K.S.A.
28 8-143, and amendments thereto. Such fee
shall be in lieu of the regular
29 licensee fee required by K.S.A. 8-143, and
amendments thereto.
30 (c) Any person
who is an enrolled member of a Native American
31 Indian tribe and a resident of Kansas may
make application for a distinc-
32 tive license plate, not less than 60 days
prior to such person's renewal of
33 registration date, on a form prescribed and
furnished by the tribe. Ap-
34 plications approved by the tribe shall be
submitted to the division of
35 motor vehicles for issuance of tags.
36 (d) Each tribe,
with the approval of the director of vehicles and sub-
37 ject to the availability of materials and
equipment, shall design a distinc-
38 tive license plate to be issued under the
provisions of this section.
39 (e) No
registration or distinctive license plate issued under the au-
40 thority of this section shall be
transferable to any other person.
41 (f) Renewals of
registration under this section shall be made annually.
42 No renewal of registration shall be made to
any applicant until such ap-
43 plicant has filed with the division of
motor vehicles a form as provided in

1 subsection (c). If such form is not
filed, the applicant shall be required
2 to comply with K.S.A. 8-143, and
amendments thereto, and return the
3 distinctive license plate to the
division of motor vehicles.
4 (g) Each
Native American Indian tribe shall pay the initial cost of
5 silk-screening distinctive license
plates authorized to be issued pursuant
6 to this section.
7 (h) Each
Native American Indian tribe may impose a fee for the
8 issuance of a distinctive license
plate and registration and for the renewal
9 thereof. Such fee shall be in an
amount determined by each tribe and
10 shall be in addition to any other fee
imposed pursuant to this section.
11 Revenues from such fees shall be used in
the manner determined by the
12 tribe imposing such fee.
13 Sec.
2. K.S.A. 1999 Supp. 8-1,141 is hereby amended to read as
fol-
14 lows: 8-1,141. (a) Any new distinctive
license plate authorized for issuance
15 on and after July 1, 1994, shall be subject
to the personalized license plate
16 fee prescribed by subsection (c) of K.S.A.
8-132, and amendments
17 thereto. This section shall not apply to
any distinctive license plate au-
18 thorized prior to July 1, 1994.
19 (b) The director
of vehicles shall not issue any new distinctive license
20 plate authorized for issuance on and after
July 1, 1995, unless there is a
21 guarantee of an initial issuance of at
least 500 license plates.
22 (c) The
provisions of this section shall not apply to distinctive
license
23 plates issued under the provisions of
K.S.A. 1999 Supp. 8-1,145 or section
24 1, and amendments thereto.
25 (d) The
provisions of subsection (a), shall not apply to distinctive
li-
26 cense plates issued under the provisions of
K.S.A. 1999 Supp. 8-1,146,
27 and amendments thereto, or K.S.A. 1999
Supp. 8-1,148.
28 Sec. 3. K.S.A. 1999 Supp.
8-1,141 is hereby repealed.
29 Sec. 4. This act shall
take effect and be in force from and after its
30 publication in the statute book.
