14             A PROPOSITION to amend article 11 of the constitution of the state of
15             Kansas by adding a new section thereto, prohibiting the increase of
16             the rate of certain taxes [exempting from property taxation a por-
17             tion of the valuation of property used for certain purposes].

20       Be it resolved by the Legislature of the State of Kansas, two-thirds of the
21             members elected (or appointed) and qualified to the House of Repre-
22             sentatives and two-thirds of the members elected (or appointed) and
23             qualified to the Senate concurring therein:
24                   Section  1. The following proposition to amend the constitution of the
25       state of Kansas shall be submitted to the qualified electors of the state
26       for their approval or rejection: Article 11 of the constitution of the state
27       of Kansas is hereby amended by adding a new section thereto to read as
28       follows:
29              ``§  14. Prohibition against tax rate increases. No enactment
30             of the legislature shall: (a) Increase the rate of any tax imposed prior
31             to November 7, 2000; (b) impose a new tax after November 7, 2000;
32             or (c) increase the rate of any tax described by clause (b), without
33             the affirmative vote of two-thirds of the members of the House of
34             Representatives and the Senate [Exemption of property used for
35             certain purposes. For all taxable years commencing after De-
36             cember 31, 2000, property used for residential purposes, real
37             property used for commercial and industrial purposes and
38             buildings and other improvements located upon land devoted
39             to agricultural use to the extent of $20,000 of its appraised
40             valuation shall be and is hereby exempt from property taxa-
41             tion. Such exemption amount may be increased by law.]
42             Sec.  2. The following statement shall be printed on the ballot with
43       the amendment as a whole:
44              ``Explanatory statement. This amendment would establish a pro-
45             hibition against general tax rate increases.

  1              ``A vote for this proposition would establish a prohibition against
  2             increases of the rate of any tax which was imposed prior to Novem-
  3             ber 7, 2000, or the imposition or the increase of the rate of a tax
  4             newly imposed after November 7, 2000, without a two-thirds affir-
  5             mative vote of the members of the House of Representatives and
  6             the Senate.
  7              ``A vote against this proposition would maintain the absence of
  8             any tax levy rate increase limitation in the constitution.'' [an ex-
  9             emption from property taxation of a portion of the appraised
10             valuation of property used for residential purposes, real
11             property used for commercial and industrial purposes and
12             buildings and other improvements located upon land devoted
13             to agricultural use.
14                   [``A vote for the proposition would exempt from property
15             taxation property used for residential purposes, real property
16             used for commercial and industrial purposes and buildings
17             and other improvements located upon land devoted to agri-
18             cultural use to the extent of $20,000 of its appraised valua-
19             tion. The legislature could provide by law for an increase in
20             such exemption amount.
21                   [``A vote against this proposition would maintain the ab-
22             sence of a constitutional exemption for property used for res-
23             idential purposes, real property used for commercial and in-
24             dustrial purposes and buildings and other improvements
25             located upon land devoted to agricultural use.'']
26             Sec.  3. This resolution, if approved by two-thirds of the members
27       elected (or appointed) and qualified to the House of Representatives and
28       two-thirds of the members elected (or appointed) and qualified to the
29       Senate, shall be entered on the journals, together with the yeas and nays.
30       The secretary of state shall cause this resolution to be published as pro-
31       vided by law and shall cause the proposed amendment to be submitted
32       to the electors of the state at the general election to be held on November
33       7, 2000.
