10             AN ACT making and concerning appropriations for the fiscal years ending
11             June 30, 2000, and June 30, 2001; authorizing certain transfers and
12             fees, imposing certain restrictions and limitations and directing or au-
13             thorizing certain receipts, disbursements, capital improvements and
14             acts incidental to the foregoing; amending K.S.A. 1999 Supp. 79-
15             34,147, as amended by section 106 of 2000 House Substitute for Sen-
16             ate Bill No. 326, and repealing the existing section.
17      
18       Be it enacted by the Legislature of the State of Kansas:
19        Section 1. (a) For the fiscal years ending June 30, 2000, and June 30,
20       2001, appropriations are hereby made, restrictions and limitations are
21       hereby imposed, and transfers, fees, receipts, disbursements, and acts
22       incidental to the foregoing are hereby directed or authorized as provided
23       in this act.
24        (b) The agencies named in this act are hereby authorized to initiate
25       and complete the capital improvement projects specified and authorized
26       by this act or for which appropriations are made by this act, subject to
27       the restrictions and limitations imposed by this act.
28        (c) This act shall be known and may be cited as the omnibus appro-
29       priation act of 2000 and shall constitute the omnibus reconciliation spend-
30       ing limit bill for the 2000 regular session of the legislature for purposes
31       of subsection (a) of K.S.A. 75-6702 and amendments thereto.
32        (d) The appropriations made by this act shall not be subject to the
33       provisions of K.S.A. 46-155 and amendments thereto.
34        Sec. 2.
35      
STATE TREASURER
36        (a) There is hereby appropriated from the state general fund for the
37       fiscal year or years specified, the following:
38       Operating expenditures
39       For the fiscal year ending June 30, 2000 $10,000
40       Postsecondary education savings program
41       For the fiscal year ending June 30, 2001 $133
42        (b) On July 1, 2000, of the $1,728,882 appropriated for the above
43       agency for the fiscal year ending June 30, 2001, by section 9 (a) of 2000

  1       House Substitute for Senate Bill No. 326 from the state general fund in
  2       the operating expenditures account, the sum of $295,692 is hereby lapsed.
  3        Sec. 3.
  4      
DEPARTMENT OF ADMINISTRATION
  5        (a) There is hereby appropriated from the state general fund for the
  6       fiscal year or years specified, the following:
  7       Budget analysis
8       For the fiscal year ending June 30, 2001 $9,040
  9       Long-term care ombudsman
10       For the fiscal year ending June 30, 2001 $1,071
11       Performance review board
12       For the fiscal year ending June 30, 2001 $1,798
13        (b) On July 1, 2000, of the $16,836,819 appropriated for the above
14       agency for the fiscal year ending June 30, 2001 by section 20 (a) of 2000
15       House Substitute for Senate Bill No. 326 from the state general fund in
16       the department of administration operations account, the sum of $77,371
17       is hereby lapsed.
18        (c) There is appropriated for the above agency from the following spe-
19       cial revenue fund or funds for the fiscal year or years specified, all moneys
20       now or hereafter lawfully credited to and available in such fund or funds,
21       except that expenditures shall not exceed the following:
22       Capitol restoration project revenue fund
23       For the fiscal year ending June 30, 2001 No limit
24       Provided, That the department of administration may make expenditures
25       from the capitol restoration project revenue fund for the capital improve-
26       ment project to construct, equip, furnish, renovate, reconstruct, and re-
27       pair the state capitol: Provided, however, That expenditures from this
28       fund for such capital improvement project shall not exceed $40,000,000,
29       plus all amounts required for costs of bond issuance, costs of interest on
30       the bonds issued for such capital improvement project during the con-
31       struction of the project and any required reserves for the payment of
32       principal and interest on the bonds: Provided further, That such capital
33       improvement project is hereby approved for the department of admin-
34       istration for the purposes of subsection (b) of K.S.A. 74-8905 and amend-
35       ments thereto and the authorization of the issuance of bonds by the Kan-
36       sas development finance authority in accordance with that statute: And
37       provided further, That all moneys received from the issuance of any such
38       bonds shall be deposited in the state treasury to the credit of this fund.
39       Municipal accounting and training services recoveryfund No limit
40       Provided, That expenditures may be made from the municipal accounting
41       and training services recovery fund to provide general ledger, payroll
42       reporting, utilities billing, data processing, and accounting services to mu-

  1       nicipalities and to provide training programs conducted for municipal
  2       government personnel, including official hospitality: Provided further,
  3       That the director of accounts and reports is hereby authorized to fix,
  4       charge and collect fees for such services and programs: And provided
  5       further, That such fees shall be fixed to cover all or part of the operating
  6       expenditures incurred in providing such services and programs, including
  7       official hospitality: And provided further, That all fees received for such
  8       services and programs, including official hospitality, shall be credited to
  9       this fund.
10        (d) On July 15, 2000, the director of accounts and reports shall transfer
11       $50,000 from the state emergency fund to the state general fund.
12        (e) On the effective date of this act, the expenditure limitation estab-
13       lished by section 42(b) of chapter 132 of the 1999 Session Laws of Kansas
14       on the motor pool service fund is hereby increased from $ 2,570,075 to
15       $2,994,357.
16        (f) On July 1, 2000, the expenditure limitation established by section
17       20(b) of 2000 House Substitute for Senate Bill No. 326 on the architec-
18       tural services recovery fund is hereby increased from $1,691,096 to
19       $1,694,540.
20        (g) In addition to the other purposes for which expenditures may be
21       made by the department of administration from the state buildings op-
22       erating fund for fiscal year 2001 as authorized by section 20(b) of 2000
23       House Substitute for Senate Bill No. 326, expenditures may be made by
24       the above agency from the state buildings operating fund for fiscal year
25       2001 for relocation of blind services and the Kansas industries for the
26       blind.
27        (h) On July 1, 2000, the position limitation established by section 69(a)
28       of 2000 House Substitute for Senate Bill No. 326 for the department of
29       administration is hereby decreased from 884.4 to 874.4.
30        (i) The director of accounts and reports shall not make the transfer of
31       all moneys in the municipal accounting and training services recovery
32       fund to the accounting services recovery fund which was directed to be
33       made on July 1, 2000, by section 20(k) of 2000 House Substitute for
34       Senate Bill No. 326. The liabilities of the municipal accounting and train-
35       ing services recovery fund shall not be transferred to and imposed upon
36       the accounting services recovery fund on July 1, 2000, by section 20(k)
37       of 2000 House Substitute for Senate Bill No. 326. The municipal ac-
38       counting and training services recovery fund is hereby specifically contin-
39       ued in existence on and after July 1, 2000, and shall not be abolished by
40       section 20(k) of 2000 House Substitute for Senate Bill No. 326.
41        (j) On July 1, 2000, the director of accounts and reports shall transfer
42       $4,552,000 from the state general fund to the flexible spending fund.

DEPARTMENT OF REVENUE
  3        (a) There is hereby appropriated from the state general fund for the
  4       fiscal year or years specified, the following:
  5       Operating expenditures
6       For the fiscal year ending June 30, 2000 $50,000
7       For the fiscal year ending June 30, 2001 $635,008
  8        (b) On July 1, 2000, the position limitation established by section 69(a)
  9       of 2000 House Substitute for Senate Bill No. 326 for the department of
10       revenue is hereby decreased from 1,157.0 to 1,156.0.
11        (c) On the July 1, 2000, the expenditure limitation established by sec-
12       tion 22(b) of 2000 House Substitute for Senate Bill No. 326 on the di-
13       vision of vehicles operating fund is hereby increased from $30,544,804 to
14       $30,613,887.
15        Sec. 5.

STATE BOARD OF REGENTS
17        (a) There is hereby appropriated from the state general fund for the
18       fiscal year or years specified, the following:
19       Operating expenditures (including official hospitality)
20       For the fiscal year ending June 30, 2001 $150
21        (b) On July 1, 2000, of the $19,507,958 appropriated for the above
22       agency for the fiscal year ending June 30, 2001, by section 50(a) of 2000
23       House Substitute for Senate Bill No. 326 from the state general fund in
24       the postsecondary aid for vocational education account, the sum of
25       $563,900 is hereby lapsed.
26        (c) On July 1, 2000, the expenditure limitation established by section
27       50(b) of 2000 House Substitute for Senate Bill No. 326 on the economic
28       development initiatives fund is hereby increased from $9,566,110 to
29       $10,130,010.
30        (d) On July 1, 2000, the expenditure limitation established by section
31       50(c) of 2000 House Substitute for Senate Bill No. 326 on the postse-
32       condary aid for vocational education account of the economic develop-
33       ment initiatives fund is hereby increased from $6,916,110 to $7,480,010.
34        (e) On July 15, 2000, or as soon thereafter as moneys are available, the
35       director of accounts and reports shall transfer $563,900 from the Kansas
36       economic development endowment account of the state economic de-
37       velopment initiatives fund of the department of commerce and housing
38       to the economic development initiatives fund of the state board of re-
39       gents.
40        Sec. 6.

EMPORIA STATE UNIVERSITY
42        (a) On July 1, 2000, of the $29,378,363 appropriated for the above
43       agency for the fiscal year ending June 30, 2001 by section 45(a) of 2000

  1       House Substitute for Senate Bill No. 326 from the state general fund in
  2       the operating expenditures (including official hospitality) account, the
  3       sum of $78,865 is hereby lapsed.
  4        (b) On the effective date of this act, of the $28,701,695 appropriated
  5       for the above agency for the fiscal year ending June 30, 2000 by section
  6       67(a) of chapter 132 of the 1999 Session Laws of Kansas from the state
  7       general fund in the operating expenditures (including official hospitality)
  8       account, the sum of $32,227 is hereby lapsed.
  9        (c) On July 1, 2000, the expenditure limitation established by section
10       45(b) of 2000 House Substitute for Senate Bill No. 326 on the general
11       fees fund is hereby increased from $8,855,138 to $8,888,734.
12        (d) On the effective date of this act, the expenditure limitation estab-
13       lished by section 45(b) of 2000 Senate Bill No. 39 on the general fees
14       fund is hereby increased from $8,317,742 to $8,349,969.
15        Sec. 7.

FORT HAYS STATE UNIVERSITY
17        (a) There is hereby appropriated from the state general fund for the
18       fiscal year or years specified, the following:

22        (b) On the effective date of this act, the expenditure limitation estab-
23       lished by section 42(b) of 2000 Senate Bill No. 39 on the general fees
24       fund is hereby decreased from $8,239,479 to $8,237,616.
25        Sec. 8.

PITTSBURG STATE UNIVERSITY
27        (a) There is hereby appropriated from the state general fund for the
28       fiscal year or years specified, the following:
29       Operating expenditures (including official hospitality)
30       For the fiscal year ending June 30, 2000 $74,765
31       For the fiscal year ending June 30, 2001 $107,448
32        (b) On the effective date of this act, the expenditure limitation estab-
33       lished by section 47(b) of 2000 Senate Bill No. 39 on the general fees
34       fund is hereby decreased from $10,497,103 to $10,422,338.
35        (c) On July 1, 2000, the expenditure limitation established by section
36       46(b) of 2000 House Substitute for Senate Bill No. 326 on the general
37       fees fund is hereby decreased from $11,159,978 to $11,048,357.
38        Sec. 9.

UNIVERSITY OF KANSAS MEDICAL CENTER
40        (a) On July 1, 2000, of the $98,539,396 appropriated for the above
41       agency for the fiscal year ending June 30, 2001 by section 48(a) of 2000
42       House Substitute for Senate Bill No. 326 from the state general fund in
43       the operating expenditures (including official hospitality) account, the

  1       sum of $65,544 is hereby lapsed.
  2        (b) On July 1, 2000, the expenditure limitation established by section
  3       48(b) of 2000 House Substitute for Senate Bill No. 326 on the general
  4       fees fund is hereby increased from $11,033,864 to $11,099,315.
  5        (c) There is appropriated for the above agency from the following spe-
  6       cial revenue fund or funds for the fiscal year or years specified, all moneys
  7       now or hereafter lawfully credited to and available in such fund or funds,
  8       except that expenditures shall not exceed the following:
9       Wahl hall renovation fund No limit
10       Provided, That the university of Kansas medical center may make ex-
11       penditures from the Wahl hall renovation fund for the capital improve-
12       ment project to construct, equip, furnish, renovate, reconstruct, and re-
13       pair Wahl hall.
14        (d) In addition to the other purposes for which expenditures may be
15       made by the above agency from the children's initiatives fund for fiscal
16       year 2001, expenditures may be made by the above agency from the
17       children's initiatives fund for fiscal year 2001 for the following specified
18       purposes subject to the expenditure limitations prescribed therefor:
19       Children's initiatives fund -- Telekid health care link $250,000
20       Provided, That all expenditures by the above agency from the children's
21       initiatives fund for fiscal year 2001 from the children's initiatives fund --
22       Telekid health care link account shall be in addition to any expenditure
23       limitation imposed on the children's initiatives fund for fiscal year 2001.
24       Children's initiatives fund -- pediatric biomedicalresearch $2,000,000
25       Provided, That all expenditures by the above agency from the children's
26       initiatives fund for fiscal year 2001 from the children's initiatives fund --
27       pediatric biomedical research account shall be in addition to any expend-
28       iture limitation imposed on the children's initiatives fund for fiscal year
29       2001.
30        Sec. 10.

STATE OF KANSAS SPORTS HALL OF FAME

BOARD OF TRUSTEES
33        (a) There is appropriated for the above agency from the following spe-
34       cial revenue fund or funds for the fiscal year or years specified, all moneys
35       now or hereafter lawfully credited to and available in such fund or funds,
36       except that expenditures other than refunds authorized by law shall not
37       exceed the following:
38       Kansas all sports hall of fame fund
39       For the fiscal year ending June 30, 2000 No limit
40       For the fiscal year ending June 30, 2001 No limit
41        (b) On the effective date of this act, or as soon thereafter as moneys
42       are available, the director of accounts and reports shall transfer $50,000

  1       from the Kansas economic development endowment account of the state
  2       economic development initiatives fund of the department of commerce
  3       and housing to the Kansas all sports hall of fame fund of the state of
  4       Kansas sports hall of fame board of trustees.
  5        (c) The number of full-time and regular part-time positions equated to
  6       full-time, excluding seasonal and temporary positions, paid from appro-
  7       priations for the fiscal year or years specified, made in this or other ap-
  8       propriation act of the 2000 regular session of the legislature for the fol-
  9       lowing agency shall not exceed the following, except upon approval of the
10       state finance council:
11       State of Kansas Sports Hall of Fame Board of Trustees
12       For the fiscal year ending June 30, 2000 3.0

14        Sec. 11.

KANSAS TECHNOLOGY ENTERPRISE CORPORATION
16        (a) On July 1, 2000, the expenditure limitation established by section
17       27(a) of 2000 House Substitute for Senate Bill No. 326 on the economic
18       development research and development fund is hereby increased from
19       $12,523,562 to $12,773,562.
20        (b) On July 1, 2000, the expenditure limitation established by section
21       27(b) of 2000 House Substitute for Senate Bill No. 326 on the operations,
22       assistance and grants (including official hospitality) account of the eco-
23       nomic development research and development fund is hereby increased
24       from $12,523,562 to $12,773,562.
25        Sec. 12.

DEPARTMENT OF COMMERCE AND HOUSING
27        (a) On July 1, 2000, the expenditure limitation established by section
28       25(b) of 2000 House Substitute for Senate Bill No. 326 on the Kansas
29       economic development account of the state economic development ini-
30       tiatives fund is hereby increased from $16,061,331 to $16,261,331.
31        (b) On July 1, 2000, the expenditure limitation established by section
32       25(c) of 2000 House Substitute for Senate Bill No. 326 on the teachers'
33       hall of fame account of the Kansas economic development endowment
34       account of the state economic development initiatives fund is hereby in-
35       creased from $100,000 to $300,000.
36        Sec. 13.

KANSAS PUBLIC EMPLOYEES RETIREMENT SYSTEM
38        (a) On the effective date of this act, the expenditure limitation estab-
39       lished for the fiscal year ending June 30, 2000, by section 17(a) of 2000
40       Senate Bill No. 39 on the agency operations account of the Kansas public
41       employees retirement fund is hereby increased from $4,918,994 to
42       $4,986,334.
43        (b) On the effective date of this act, the expenditure limitation estab-

  1       lished for the fiscal year ending June 30, 2000, by section 37(b) of chapter
  2       132 of the 1999 Session Laws of Kansas on the bonus awards to unclas-
  3       sified employees subaccount of the agency operations account of the Kan-
  4       sas public employees retirement fund is hereby increased from $75,000
  5       to $91,540.
  6        (c) On the effective date of this act, the expenditure limitation estab-
  7       lished for the fiscal year ending June 30, 2000, by section 17(b) of 2000
  8       Senate Bill No. 39 on the investment related expenses account of the
  9       Kansas public employees retirement fund is hereby decreased from
10       $26,644,408 to $26,011,735.
11        (d) On the effective date of this act, the expenditure limitation estab-
12       lished for the fiscal year ending June 30, 2000, by section 6(b) of chapter
13       160 of the 1999 Session Laws of Kansas on the technology project account
14       of the Kansas public employees retirement fund is hereby decreased from
15       $2,451,255 to $100,000.
16        (e) On July 1, 2000, the expenditure limitation established for the fiscal
17       year ending June 30, 2001, by section 15(b) of 2000 House Substitute for
18       Senate Bill No. 326 on the agency operations account of the Kansas public
19       employees retirement fund is hereby increased from $5,989,105 to
20       $6,100,616.
21        (f) On July 1, 2000, the expenditure limitation established for the fiscal
22       year ending June 30, 2001, by section 15(b) of 2000 House Substitute for
23       Senate Bill No. 326 on the bonus awards to unclassified employees su-
24       baccount of the agency operations account of the Kansas public employ-
25       ees retirement fund is hereby increased from $75,000 to $91,540.
26        (g) On July 1, 2000, the expenditure limitation established for the fiscal
27       year ending June 30, 2001, by section 15(b) of 2000 House Substitute for
28       Senate Bill No. 326 on the investment related expenses account of the
29       Kansas public employees retirement fund is hereby increased from
30       $26,876,393 to $26,909,271.
31        (h) There is appropriated for the above agency from the following spe-
32       cial revenue fund or funds for the fiscal year or years specified, all moneys
33       now or hereafter lawfully credited to and available in such fund or funds,
34       except that expenditures other than refunds authorized by law shall not
35       exceed the following:
36       Senior services trust fund
37       For the fiscal year ending June 30, 2000 No limit
38       For the fiscal year ending June 30, 2001 No limit
39        (i) In addition to the other purposes for which expenditures may be
40       made by the above agency from the agency operations account of the
41       Kansas public employees retirement fund for fiscal year 2000, as author-
42       ized by section 37(b) of chapter 132 of the 1999 Session Laws of Kansas,
43       or for fiscal year 2001, as authorized by section 15(b) of 2000 House

  1       Substitute for Senate Bill No. 326, expenditures may be made by the
  2       above agency for fiscal year 2000 and fiscal year 2001 for the purpose of
  3       paying fees and expenses associated with the search for a new executive
  4       secretary pursuant to procedures established by the board of trustees of
  5       the Kansas public employees retirement system: Provided, That any ex-
  6       penditures for such purpose shall be in addition to any expenditure lim-
  7       itation on the agency operations account of such fund for fiscal year 2000
  8       and fiscal year 2001: Provided, however, That the aggregate amount of
  9       expenditures for such fees and expenses for fiscal year 2000 and fiscal
10       year 2001 shall not exceed $50,000 for the two-year period.
11        (j) In addition to the other purposes for which expenditures may be
12       made by the above agency from the agency operations account of the
13       Kansas public employees retirement fund for the fiscal year ending June
14       30, 2001, as authorized by section 15(b) of 2000 House Substitute for
15       Senate Bill No. 326, expenditures may be made by the above agency for
16       fiscal year 2001 for the purpose of paying expenses associated with the
17       technology project as approved by the board of trustees of the Kansas
18       public employees retirement system: Provided, That any expenditures for
19       such purpose shall be in addition to any expenditure limitation on the
20       agency operations account of such fund: Provided, however, That the total
21       amount of expenditures for such expenses for fiscal year 2001 shall not
22       exceed $2,283,913: Provided further, That any contract negotiated for the
23       technology project shall be reviewed and approved by the chief infor-
24       mation technology officer of the executive branch who also shall consider
25       that the technology project is in compliance with the provisions of K.S.A.
26       75-7209 and amendments thereto.
27        (k) In addition to other purposes for which expenditures may be made
28       by the Kansas public employees retirement system from the Kansas pub-
29       lic employees retirement fund for fiscal year 2001 as authorized by this
30       or other appropriation act of the 2000 regular session of the legislature,
31       the board of trustees of the Kansas public employees retirement system
32       is hereby authorized and directed to pay the cost of allowing an active
33       member of the Kansas police and firemen's retirement system who cur-
34       rently serves in the Kansas highway patrol and who has an actuarial lia-
35       bility of $107,290.17 in order to retire under tier 2 rather than tier 1
36       under the Kansas police and firemen's retirement system: Provided, That
37       the board of trustees of the Kansas public employees retirement system
38       is hereby authorized and directed to authorize the retirement of such
39       active member of the Kansas police and firemen's retirement system as
40       a member of tier 2 under such system with all the benefits provided under
41       the provisions of law and policies established by the board of trustees.

  1        Sec. 14.
  2      
KANSAS LOTTERY
  3        (a) On July 1, 2000, the expenditure limitation established by section
  4       23(a) of 2000 House Substitute for Senate Bill No. 326 on the lottery
  5       operating fund is hereby increased from $8,998,099 to $9,010,196.
  6        Sec. 15.
  7      
KANSAS RACING AND GAMING COMMISSION
  8        (a) On the effective date of this act, the position limitation established
  9       by section 90(a) of chapter 132 of the 1999 Session Laws of Kansas for
10       the Kansas racing and gaming commission-- state racing operations is
11       hereby increased from 42.0 to 51.0.
12        (b) On July 1, 2000, the position limitation established by section 69(a)
13       of 2000 House Substitute for Senate Bill No. 326 for the Kansas racing
14       and gaming commission--state racing operations is hereby increased
15       from 43.0 to 52.0.
16        (c) On the effective date of this act, the expenditure limitation estab-
17       lished by section 26(a) of 2000 Senate Bill No. 39 on the state racing fund
18       is hereby increased from $3,283,383 to $3,495,776.
19        (d) On July 1, 2000, the expenditure limitation established by section
20       24(a) of 2000 House Substitute for Senate Bill No. 326 on the state racing
21       fund is hereby increased from $3,217,143 to $3,813,653.
22        (e) Notwithstanding the provisions of subsection (c) of K.S.A. 74-8826
23       and amendments thereto, and notwithstanding any agreements between
24       the director of accounts and reports and the executive director of the
25       state racing and gaming commission that set a $300,000 maximum amount
26       of reserve balance for the state racing fund, the state racing fund may
27       have an amount of not to exceed $440,000 as an unencumbered cash
28       balance on June 30, 2000, and such unencumbered cash balance shall not
29       be subject to transfer to the state gaming revenues fund for the fiscal year
30       ending June 30, 2000.
31        Sec. 16.

DEPARTMENT OF TRANSPORTATION
33        (a) On July 1, 2000, the expenditure limitation established by section
34       68(b) of 2000 House Substitute for Senate Bill No. 326 on the agency
35       operations account of the state highway fund is hereby increased from
36       $209,875,792 to $210,266,469.
37        [(b) In addition to the other purposes for which expenditures
38       may be made by the department of transportation from the state
39       highway fund for the fiscal year 2001, as authorized by this or
40       other appropriation act of the 2000 regular session of the legisla-
41       ture, expenditures shall be made by the department of transpor-
42       tation from the state highway fund for fiscal year 2001 for projects
43       to make improvements to the portion of K-96 between K-17 and

  1       Maize, Kansas, to remedy the concerns raised and to make the
  2       series of improvements recommended in the report ``Design Re-
  3       view and Traffic Study of Highway K-96 -- K-17 to Maize, Kansas,
  4       KDOT Project No.: 96-106K-7834-01'' prepared and submitted in
  5       December, 1999, by the independent consulting engineers, pur-
  6       suant to the provisions of section 4(g) of chapter 160 of the 1999
  7       Session Laws of Kansas, which included review and study of the
  8       accident history of the new section of K-96 from northwest of
  9       Maize, Kansas, to south of Hutchinson, Kansas, and the develop-
10       ment of proposals for improvements to reduce the incidence of
11       highway accidents on such new section of K-96: Provided, That such
12       improvements to the portion of K-96 between K-17 and Maize,
13       Kansas, shall specifically include new or improved lighting at ma-
14       jor intersections, installing new signs and relocating existing signs
15       to clarify destinations, regrading of the backslope of westbound K-
16       96 at Haven (West) in order to increase the sight distance to west-
17       bound Arlington, lengthening of deceleration lanes at Andale and
18       Bentley / Halstead, removing, modifying and relocating guardrails
19       to improve the westbound K-96 right-turn lane area and widening
20       the shoulder to allow for tractor-trailer offtracking at Bentley /
21       Halstead and constructing on-bound lanes for the eastbound di-
22       rection at Haven (East) and Bentley / Halstead: Provided further,
23       That the requirements for the plans and specifications for all such
24       improvements, especially at Haven (West) and Halstead / Bentley,
25       shall not be limited or defined in terms of minimum standards for
26       expressway design, but shall include specifications with design
27       standards requiring more than such minimum standards to satis-
28       factorily address the matters raised as concerns or identified as
29       dilemmas by the independent consulting engineers in this report:
30       And provided further, That such improvements shall be completed
31       or work commenced thereon prior to July 8, 2001, and the secre-
32       tary of transportation shall submit a progress report on such im-
33       provements to the legislature by January 8, 2001.]
34        Sec. 17.
35      
SECRETARY OF STATE
36        (a) There is appropriated for the above agency from the state general
37       fund for the fiscal year or years specified, the following:

41        (b) In addition to the other purposes for which expenditures may be

  2       erating expenditures, including expenditures for 2.0 additional full-time
  3       equivalent positions, for implementation of 2000 Senate Bill No. 366:

  5       fee fund for fiscal year 2001 for such purpose shall be in addition to any
  6       expenditure limitation established for the uniform commercial code fee
  7       fund for fiscal year 2001: Provided, however, That expenditures from the

21        (c) On July 1, 2000, the position limitation established by section 69
22       (a) of 2000 House Substitute for Senate Bill No. 326 for the secretary of
23       state is hereby increased from 54.0 to 55.0.
24        Sec. 18.

26        (a) There is appropriated for the above agency from the state general

39        (c) On July 1, 2000, of the $415,796 appropriated for the above agency

42       operating expenditures account, the sum of $17,500 is hereby lapsed:

38        (c) On the effective date of this act, of the $53,328,276 appropriated
39       for the above agency for the fiscal year ending June 30, 2000, by section
40       55(a) of chapter 132 of the 1999 Session Laws of Kansas from the state
41       general fund in the cash assistance account, the sum of $1,010,000 is
42       hereby lapsed.
43        (d) On the effective date of this act, of the $165,360,603 appropriated

  1       for the above agency for the fiscal year ending June 30, 2000, by section
  2       55(a) of chapter 132 of the 1999 Session Laws of Kansas from the state
  3       general fund in the mental health and retardation services aid and assis-
  4       tance and state institutions operations account, the sum of $104,969 is
  5       hereby lapsed.
  6        (e) On July 1, 2000, of the $113,497,604 appropriated for the above
  7       agency for the fiscal year ending June 30, 2001, by section 33(a) of 2000
  8       House Substitute for Senate Bill No. 326 from the state general fund in
  9       the mental health and retardation services aid and assistance account, the
10       sum of $132,441 is hereby lapsed.
11        (f) On July 1, 2000, of the $91,704,036 appropriated for the above
12       agency for the fiscal year ending June 30, 2001, by section 33(a) of 2000
13       House Substitute for Senate Bill No. 326 from the state general fund in
14       the state operations account, the sum of $876,054 is hereby lapsed.
15        (g) There is appropriated for the above agency from the following spe-
16       cial revenue fund or funds for the fiscal year or years specified, all moneys
17       now or hereafter lawfully credited to and available in such fund or funds,
18       except that expenditures other than refunds authorized by law shall not
19       exceed the following:
20       Flexible spending fund -- nursing facilities quality enhancement wage
21       pass-through pursuant to 1999 Senate Bill No.126 (K.S.A. 1999 Supp. 39-
22       971)
23       For the fiscal year ending June 30, 2001 $62,266
24       Provided, That no expenditures shall be made from the flexible spending
25       fund -- nursing facilities quality enhancement wage pass-through pur-
26       suant to 1999 Senate Bill No.126 (K.S.A. 1999 Supp. 39-971), except upon
27       approval of the state finance council acting on this matter which is hereby
28       characterized as a matter of legislative delegation and subject to the
29       guidelines prescribed in subsection (c) of K.S.A. 75-3711c and amend-
30       ments thereto and acting on this matter after receiving the certification
31       of the director of the budget that sufficient moneys are available in the
32       state medicaid match fund -- SRS.
33        (h) On July 1, 2000, the expenditure limitation established by section
34       33(b) of 2000 House Substitute for Senate Bill No. 326 on the HCBS
35       programs fund is hereby increased from $800,000 to $6,000,000.
36        (i) On July 1, 2000, the expenditure limitation established by section
37       33(b) of 2000 House Substitute for Senate Bill No. 326 on the social
38       welfare fund is hereby increased from $54,753,127 to $55,253,127.
39        (j) In addition to the other purposes for which expenditures may be
40       made by the department of social and rehabilitation services from the
41       moneys appropriated from the state general fund or from any special
42       revenue fund for fiscal year 2001 as authorized by this or other appro-
43       priation act of the 2000 regular session of the legislature, expenditures

  1       shall be made by the department of social and rehabilitation services from
  2       the moneys appropriated from the state general fund or from any special
  3       revenue fund for fiscal year 2001 to initiate one or more pilot programs
  4       for crisis stabilization of mentally ill individuals.
  5        (k) During the fiscal year ending June 30, 2001, the secretary of social
  6       and rehabilitation services shall withhold 25% of state aid and consoli-
  7       dated grant payments from this account to the participating mental health
  8       center in Sedgwick County, ComCare, until such time as the secretary of
  9       social and rehabilitation services determines that a settlement has been
10       reached in the dispute between ComCare and the Wichita Guidance Cen-
11       ter and that the issues have been resolved between ComCare and all the
12       unified school districts in Sedgwick County, with outcomes that assure
13       the appropriate provision of services.
14        (l) [(k)] In addition to the other purposes for which expenditures may
15       be made by the department of social and rehabilitation services from the
16       moneys appropriated from the state general fund or from any special
17       revenue fund for fiscal year 2001 as authorized by this or other appro-
18       priation act of the 2000 regular session of the legislature, expenditures
19       shall be made by the department of social and rehabilitation services from
20       the moneys appropriated from the state general fund or from any special
21       revenue fund for fiscal year 2001 to adopt and to implement policies and
22       procedures requiring aggressive use of case management services under
23       the medicaid program for clients with mental illness in order to maximize
24       all funding sources available to community mental health centers for the
25       provision of services for clients with mental illness: Provided, That the
26       secretary of social and rehabilitation services shall incorporate provisions
27       implementing such requirement in all agreements with community men-
28       tal health centers and appropriate service providers in order to maximize
29       all funding sources available to community mental health centers.
30        (m) [(l)] In addition to the other purposes for which expenditures may
31       be made by the department of social and rehabilitation services from any
32       moneys appropriated from the state general fund or any special revenue
33       fund for the fiscal year 2001, as authorized by this or other appropriation
34       act of the 2000 regular session of the legislature, expenditures shall be
35       made by the department of social and rehabilitation services from any
36       such moneys appropriated for fiscal year 2001 for the receipt, crediting
37       and disbursement of moneys received by the department of social and
38       rehabilitation services for payments of support pursuant to a rule or ad-
39       ministrative order issued by the Kansas supreme court, which is hereby
40       authorized to be issued by the Kansas supreme court, directing payments
41       of support, which are made pursuant to any court order entered in this
42       state regardless of the date of the order, to be made to a central unit for
43       the collection and disbursement of support payments, notwithstanding

  1       the provisions of any statute to the contrary.
  2        (n) [(m)] In addition to the other purposes for which expenditures may
  3       be made by the department of social and rehabilitation services from the
  4       youth services aid and assistance account of the state general fund for
  5       fiscal year 2000, as authorized by section 55(a) of chapter 132 or section
  6       2(a) of chapter 160 of the 1999 Session Laws of Kansas, or by this or
  7       other appropriation act of the 2000 regular session of the legislature,
  8       expenditures shall be made by the department of social and rehabilitation
  9       services from the youth services aid and assistance account of the state
10       general fund for fiscal year 2000 for payments to the contracting foster
11       care and adoption services providers to pay for referrals at the average
12       monthly referrals for fiscal year 2000 as of the beginning of June, 2000,
13       and, for any additional referrals above such average, to pay to the re-
14       spective service providers at the end of the month of June, 2000, the
15       amount payable for such additional referrals: Provided, That the secretary
16       of social and rehabilitation services shall require such contracting foster
17       care and adoption service providers to use the accelerated funding to pay
18       subcontractors of such contracting foster care and adoption service pro-
19       viders as their first priority.
20        (o) [(n)] In addition to the other purposes for which expenditures may
21       be made by the department of social and rehabilitation services from the
22       youth services aid and assistance account of the state general fund for
23       fiscal year 2001, as authorized by section 33(a) of 2000 House Substitute
24       for Senate Bill No. 326 or other appropriation act of the 2000 regular
25       session of the legislature, expenditures shall be made by the department
26       of social and rehabilitation services from the youth services aid and assis-
27       tance account of the state general fund for fiscal year 2001 as soon as
28       possible after July 1, 2000, to pay Lutheran Social Services the finalization
29       payments for all children for which such adoption service provider has
30       provided all services contractually required to be performed by such
31       adoption service provider and for which only judicial action or documen-
32       tation of such judicial action, or both, remain to be completed for adop-
33       tion of such children to be finalized, which may be for approximately 450
34       children, more or less, as the case may be.
35        (p) [(o)] On July 1, 2000, or as soon thereafter as moneys are available,
36       the director of accounts and reports shall transfer $62,266 from the flex-
37       ible spending fund of the department of administration to the flexible
38       spending fund -- nursing facilities quality enhancement wage pass-
39       through pursuant to 1999 Senate Bill No.126 (K.S.A. 1999 Supp. 39-971)
40       of the department of social and rehabilitation services: Provided, That no
41       transfer shall be made under this subsection except upon approval of the
42       state finance council acting on this matter which is hereby characterized
43       as a matter of legislative delegation and subject to the guidelines pre-

  1       scribed in subsection (c) of K.S.A. 75-3711c and amendments thereto and
  2       acting on this matter after receiving the certification of the director of
  3       the budget that sufficient moneys are available in the flexible spending
  4       fund pursuant to the intergovernmental transfer program.
  5        (q) [(p)] During the fiscal year ending June 30, 2001, no expenditures
  6       shall be made by the department of social and rehabilitation services from
  7       the moneys appropriated in the state medicaid match fund -- SRS except
  8       upon approval of the state finance council acting on this matter which is
  9       hereby characterized as a matter of legislative delegation and subject to
10       the guidelines prescribed in subsection (c) of K.S.A. 75-3711c and amend-
11       ments thereto and acting on this matter after receiving the certification
12       of the director of the budget that sufficient moneys are available in the
13       state medicaid match fund--SRS pursuant to the intergovernmental
14       transfer program: Provided, That the state finance council may authorize
15       the department of social and rehabilitation services to make expenditures
16       from the state medicaid match fund--SRS for the HCBS/MR waiver
17       program and for the HCBS/PD waiver program: Provided, however, That
18       (1) expenditures from the state medicaid match fund--SRS for the
19       HCBS/MR waiver program shall not exceed $15,300,000, except that,
20       upon certification of the director of the budget that sufficient moneys are
21       available in the state medicaid match fund--SRS pursuant to the inter-
22       governmental transfer program, such expenditures for the HCBS/MR
23       waiver program shall not exceed $18,300,000, (2) expenditures from the
24       state medicaid match fund--SRS for the HCBS/PD waiver program shall
25       not exceed $1,800,000.
26        (r) [(q)] In addition to the other purposes for which expenditures may
27       be made by the department of social and rehabilitation services from the
28       moneys appropriated from the alcohol and drug abuse block grant federal
29       fund for fiscal year 2001 as authorized by this or other appropriation act
30       of the 2000 regular session of the legislature, expenditures shall be made
31       by the department of social and rehabilitation services from the moneys
32       appropriated from the alcohol and drug abuse block grant federal fund
33       for fiscal year 2001 for prevention services to be provided pursuant to
34       contracts entered into by the department of social and rehabilitation serv-
35       ices and the governor's department.
36        (s) [(r)] In addition to the other purposes for which expenditures may
37       be made from the children's initiatives fund for fiscal year 2001, expend-
38       itures may be made by the above agency from the children's initiatives
39       fund for fiscal year 2001 for the following specified purposes subject to
40       the expenditure limitations prescribed therefor:
41       Children's initiatives fund--children's mental healthwaiver $1,000,000
42       Provided, That all expenditures by the above agency from the children's

  1       initiatives fund for fiscal year 2001 from the children's initiatives fund--
  2       children's mental health waiver account shall be in addition to any ex-
  3       penditure limitation imposed on the children's initiatives fund for fiscal
  4       year 2001.
5       Children's initiatives fund--family centered system ofcare $5,000,000
  6       Provided, That all expenditures by the above agency from the children's
  7       initiatives fund for fiscal year 2001 from the children's initiatives fund--
  8       family centered system of care account shall be in addition to any ex-
  9       penditure limitation imposed on the children's initiatives fund for fiscal
10       year 2001.
11       Children's initiatives fund--therapeutic preschool $2,000,000
12       Provided, That all expenditures by the above agency from the children's
13       initiatives fund for fiscal year 2001 from the children's initiatives fund--
14       therapeutic preschool account shall be in addition to any expenditure
15       limitation imposed on the children's initiatives fund for fiscal year 2001:
16       Provided, however, That the secretary of social and rehabilitation services
17       shall adopt and implement policies and procedures requiring community
18       mental health centers to aggressively use the medicaid program for pre-
19       school clients of the program in order to maximize all funding sources
20       available to community mental health centers for the provision of services
21       for preschool clients.
22        (t) [(s)] (1) On July 1, 2000, the director of accounts and reports shall
23       transfer all moneys credited as of June 30, 2000, in the Kansas endowment
24       for youth fund--children's mental health waiver account of the Kansas
25       endowment for youth fund to the children's initiatives fund--children's
26       mental health waiver account in the children's initiatives fund established
27       by subsection (s). On July 1, 2000, and after such transfer, (A) all encum-
28       brances and other liabilities of the Kansas endowment for youth fund--
29       children's mental health waiver account of the Kansas endowment for
30       youth fund are hereby transferred to and imposed upon the children's
31       initiatives fund--children's mental health waiver account in the children's
32       initiatives fund established pursuant to subsection (s), (B) the Kansas
33       endowment for youth fund--children's mental health waiver account of
34       the above agency in the Kansas endowment for youth fund is hereby
35       abolished, and (C) any appropriation of moneys in the Kansas endowment
36       for youth fund--children's mental health waiver account of the Kansas
37       endowment for youth fund for the above agency for the fiscal year ending
38       June 30, 2001, by any provision of chapter 132 or chapter 160 of the 1999
39       Session Laws of Kansas or this or other appropriation act of the 2000
40       regular session of the legislature, is hereby lapsed.
41        (2) On July 1, 2000, the director of accounts and reports shall transfer
42       all moneys credited as of June 30, 2000, in the Kansas endowment for

  1       youth fund--family centered system of care account of the Kansas en-
  2       dowment for youth fund to the children's initiatives fund--family cen-
  3       tered system of care account in the children's initiatives fund established
  4       by subsection (s). On July 1, 2000, and after such transfer, (A) all encum-
  5       brances and other liabilities of the Kansas endowment for youth fund--
  6       family centered system of care account of the Kansas endowment for
  7       youth fund are hereby transferred to and imposed upon the children's
  8       initiatives fund--family centered system of care account in the children's
  9       initiatives fund established pursuant to subsection (s), (B) the Kansas
10       endowment for youth fund--family centered system of care account of
11       the above agency in the Kansas endowment for youth fund is hereby
12       abolished, and (C) any appropriation of moneys in the Kansas endowment
13       for youth fund--family centered system of care account of the Kansas
14       endowment for youth fund for the above agency for the fiscal year ending
15       June 30, 2001, by any provision of chapter 132 or chapter 160 of the 1999
16       Session Laws of Kansas or this or other appropriation act of the 2000
17       regular session of the legislature, is hereby lapsed.
18        (3) On July 1, 2000, the director of accounts and reports shall transfer
19       all moneys credited as of June 30, 2000, in the Kansas endowment for
20       youth fund--CDDO rate reimbursement account of the Kansas endow-
21       ment for youth fund to the children's initiatives fund--children's mental
22       health waiver account in the children's initiatives fund established by sub-
23       section (s). On July 1, 2000, and after such transfer, (A) all encumbrances
24       and other liabilities of the Kansas endowment for youth fund--CDDO
25       rate reimbursement account of the Kansas endowment for youth fund
26       are hereby transferred to and imposed upon the children's initiatives
27       fund--children's mental health waiver account in the children's initiatives
28       fund established pursuant to subsection (s), (B) the Kansas endowment
29       for youth fund--CDDO rate reimbursement account of the above agency
30       in the Kansas endowment for youth fund is hereby abolished, and (C)
31       any appropriation of moneys in the Kansas endowment for youth fund--
32       CDDO rate reimbursement account of the Kansas endowment for youth
33       fund for the above agency for the fiscal year ending June 30, 2001, by
34       any provision of chapter 132 or chapter 160 of the 1999 Session Laws of
35       Kansas or this or other appropriation act of the 2000 regular session of
36       the legislature, is hereby lapsed.
37        (4) On July 1, 2000, the director of accounts and reports shall transfer
38       all moneys credited as of June 30, 2000, in the Kansas endowment for
39       youth fund--home and community based services for physically disabled
40       account of the Kansas endowment for youth fund to the children's initia-
41       tives fund--children's mental health waiver account in the children's in-
42       itiatives fund, which is established by subsection (s). On July 1, 2000, and
43       after such transfer, (A) all encumbrances and other liabilities of the Kan-

  1       sas endowment for youth fund--home and community based services for
  2       physically disabled account of the Kansas endowment for youth fund are
  3       hereby transferred to and imposed upon the children's initiatives fund--
  4       children's mental health waiver account in the children's initiatives fund,
  5       (B) the Kansas endowment for youth fund--home and community based
  6       services for physically disabled account of the above agency in the Kansas
  7       endowment for youth fund is hereby abolished, and (C) any appropriation
  8       of moneys in the Kansas endowment for youth fund--home and com-
  9       munity based services for physically disabled account of the Kansas en-
10       dowment for youth fund for the above agency for the fiscal year ending
11       June 30, 2001, by any provision of chapter 132 or chapter 160 of the 1999
12       Session Laws of Kansas or this or other appropriation act of the 2000
13       regular session of the legislature, is hereby lapsed.
14        (5) On July 1, 2000, the director of accounts and reports shall transfer
15       all moneys credited as of June 30, 2000, in the Kansas endowment for
16       youth fund--home and community based services for mental retardation
17       account of the Kansas endowment for youth fund to the children's initia-
18       tives fund--children's mental health waiver account in the children's in-
19       itiatives fund established by subsection (s). On July 1, 2000, and after
20       such transfer, (A) all encumbrances and other liabilities of the Kansas
21       endowment for youth fund--home and community based services for
22       mental retardation account of the Kansas endowment for youth fund are
23       hereby transferred to and imposed upon the children's initiatives fund--
24       children's mental health waiver account in the children's initiatives fund,
25       (B) the Kansas endowment for youth fund--home and community based
26       services for mental retardation account of the above agency in the Kansas
27       endowment for youth fund is hereby abolished, and (C) any appropriation
28       of moneys in the Kansas endowment for youth fund--home and com-
29       munity based services for mental retardation account of the Kansas en-
30       dowment for youth fund for the above agency for the fiscal year ending
31       June 30, 2001, by any provision of chapter 132 or chapter 160 of the 1999
32       Session Laws of Kansas or this or other appropriation act of the 2000
33       regular session of the legislature, is hereby lapsed.
34        (6) In addition to the other purposes for which expenditures may be
35       made from the children's initiatives fund for fiscal year 2001 as authorized
36       by this or other appropriation act of the 2000 regular session of the leg-
37       islature, expenditures may be made by the above agency from the chil-
38       dren's initiatives fund for fiscal year 2001, from the unencumbered bal-
39       ance as of July 1, 2000, in each account of the children's initiatives fund
40       that is established by subsection (s) and into which moneys are transferred
41       pursuant to this subsection (t) and in each account of the children's ini-
42       tiatives fund that is established by this subsection (t): Provided, That all
43       expenditures from the unencumbered balance of any such account of the

  1       children's initiatives fund shall not exceed the amount of the unencum-
  2       bered balance in such account on July 1, 2000: Provided further, That all
  3       expenditures from the unencumbered balance of any such account shall
  4       be in addition to any expenditure limitation imposed on the children's
  5       initiatives fund for fiscal year 2001.
  6        (u) [(t)] On the effective date of this act, the amounts specified in
  7       section 34(m) of 2000 Senate Bill No. 39 as being included in the mental
  8       health and retardation services aid and assistance and state institutions
  9       operations account of the state general fund for the following institutions
10       are hereby changed to the amounts specified, but expenditures from the
11       mental health and retardation services aid and assistance and state insti-
12       tutions operations account of the state general fund for any such insti-
13       tution shall not be limited to, or be required to be made in, the amount
14       listed for the institution, as follows: (1) The amount for Kansas neurolog-
15       ical institute is hereby decreased from $7,640,245 to $7,633,917; (2) the
16       amount for Larned state hospital is hereby decreased from $11,210,786
17       to $11,199,279; (3) the amount for Osawatomie state hospital is hereby
18       decreased from $5,790,631 to $5,775,055; (4) the amount for Parsons
19       state hospital and training center is hereby decreased from $5,799,369 to
20       $5,782,829; and (5) the amount for Rainbow mental health facility is
21       hereby decreased from $719,111 to $705,996.
22        (v) [(u)] On the effective date of this act, the expenditure limitation
23       established by section 55(b) of chapter 132 of the 1999 Session Laws of
24       Kansas on the Osawatomie state hospital fee fund is hereby decreased
25       from $1,943,508 to $1,927,933.
26        (w) [(v)] On the effective date of this act, the expenditure limitation
27       established by section 55(b) of chapter 132 of the 1999 Session Laws of
28       Kansas on the Parsons state hospital and training center fee fund is hereby
29       decreased from $793,081 to $777,682.
30        (x) [(w)] On July 1, 2000, of the $8,517,075 appropriated for the above
31       agency for the fiscal year ending June 30, 2001, by section 33(a) of 2000
32       House Substitute for Senate Bill No. 326 from the state general fund in
33       the Kansas neurological institute--operating expenditures account, the
34       sum of $24,487 is hereby lapsed.
35        (y) [(x)] On July 1, 2000, of the $1,333,972 appropriated for the above
36       agency for the fiscal year ending June 30, 2001, by section 33(a) of 2000
37       House Substitute for Senate Bill No. 326 from the state general fund in
38       the Rainbow mental health facility--operating expenditures account, the
39       sum of $12,733 is hereby lapsed.

38       ernor and to the legislature for an emergency supplemental appropriation

29       partment on aging: Provided, That no transfer shall be made under this

22        (c) In addition to the other purposes for which expenditures may be
23       made by the Kansas sentencing commission from moneys appropriated
24       in the sentencing commission forfeiture fund for fiscal year 2000 as au-
25       thorized by chapter 132 or chapter 160 of the 1999 Session Laws of
26       Kansas, expenditures may be made by the Kansas sentencing commission
27       for fiscal year 2000 from the moneys appropriated in the sentencing com-
28       mission forfeiture fund for all purposes for which expenditures may be
29       made for operating expenditures.
30        (d) In addition to the other purposes for which expenditures may be
31       made by the Kansas sentencing commission from moneys appropriated
32       from the state general fund or any special revenue fund for fiscal year
33       2001, expenditures shall be made by the Kansas sentencing commission
34       for fiscal year 2001 from moneys appropriated from the state general fund
35       or any special revenue fund for the position of project manager for the
36       criminal justice information system, which position is hereby created for
37       the Kansas sentencing commission and which shall be the project man-
38       ager for the consolidated criminal justice information system: Provided,
39       That the project manager shall report directly to the director of the Kan-
40       sas sentencing commission on the implementation, completion, mainte-
41       nance and funding of the criminal justice information system: Provided
42       further, That all expenditures and revenues related and effecting the im-
43       plementation, completion, and continued maintenance of the criminal

  1       justice information system and those agencies in which those revenues
  2       and expenditures are budgeted within, shall submit all fiscal information
  3       relating to the criminal justice information system to the project manager
  4       thus creating a unified consolidated criminal justice information system

  7       of 2000 House Substitute for Senate Bill No. 326 for the Kansas sen-

36       grants from this account is not an entitlement to communities, but a grant

38       outcomes.
39       Children's initiatives fund--intervention and graduatedsanctions community grants $2,000,000
40       Provided, That all expenditures by the above agency from the children's
41       initiatives fund for fiscal year 2001 from the children's initiatives fund--
42       intervention and graduated sanctions community grants account shall be

  1       in addition to any expenditure limitation imposed on the children's ini-
  2       tiatives fund for fiscal year 2001.
  3        (b) (1) On July 1, 2000, the director of accounts and reports shall trans-
  4       fer all moneys credited as of June 30, 2000, in the Kansas endowment for
  5       youth fund--prevention program grants account of the Kansas endow-
  6       ment for youth fund to the children's initiatives fund--prevention pro-
  7       gram grants account in the children's initiatives fund established by sub-
  8       section (a). On July 1, 2000, and after such transfer, (A) all encumbrances
  9       and other liabilities of the Kansas endowment for youth fund-- preven-
10       tion program grants account of the Kansas endowment for youth fund are
11       hereby transferred to and imposed upon the children's initiatives fund--
12       prevention program grants account in the children's initiatives fund, (B)
13       the Kansas endowment for youth fund--prevention program grants ac-
14       count of the above agency in the Kansas endowment for youth fund is
15       hereby abolished, and (C) any appropriation of moneys in the Kansas
16       endowment for youth fund-- prevention program grants account of the
17       Kansas endowment for youth fund for the above agency for the fiscal year
18       ending June 30, 2001, by any provision of chapter 132 or chapter 160 of
19       the 1999 Session Laws of Kansas or this or other appropriation act of the
20       2000 regular session of the legislature, is hereby lapsed.
21        (2) On July 1, 2000, the director of accounts and reports shall transfer
22       all moneys credited as of June 30, 2000, in the Kansas endowment for
23       youth fund--intervention and graduated sanctions community grants ac-
24       count of the Kansas endowment for youth fund to the children's initiatives
25       fund--intervention and graduated sanctions community grants account

34       of the above agency in the Kansas endowment for youth fund is hereby
35       abolished, and (C) any appropriation of moneys in the Kansas endowment

37       account of the Kansas endowment for youth fund for the above agency
38       for the fiscal year ending June 30, 2001, by any provision of chapter 132

42        (3) On July 1, 2000, the director of accounts and reports shall establish

  2       all moneys credited as of June 30, 2000, in the Kansas endowment for
  3       youth fund--community management information systems projects ac-
  4       count of the Kansas endowment for youth fund to the children's initiatives
  5       fund--community management information systems projects account in
  6       the children's initiatives fund, which is hereby established. On July 1,
  7       2000, and after such transfer, (A) all encumbrances and other liabilities
  8       of the Kansas endowment for youth fund--community management in-
  9       formation systems projects account of the Kansas endowment for youth
10       fund are hereby transferred to and imposed upon the children's initiatives
11       fund--community management information systems projects account in
12       the children's initiatives fund, (B) the Kansas endowment for youth
13       fund--community management information systems projects account of
14       the above agency in the Kansas endowment for youth fund is hereby
15       abolished, and (C) any appropriation of moneys in the Kansas endowment
16       for youth fund--community management information systems projects
17       account of the Kansas endowment for youth fund for the above agency
18       for the fiscal year ending June 30, 2001, by any provision of chapter 132
19       or chapter 160 of the 1999 Session Laws of Kansas or this or other ap-
20       propriation act of the 2000 regular session of the legislature, is hereby

22        (4) In addition to the other purposes for which expenditures may be
23       made from the children's initiatives fund for fiscal year 2001 as authorized
24       by this or other appropriation act of the 2000 regular session of the leg-
25       islature, expenditures may be made by the above agency from the chil-
26       dren's initiatives fund for fiscal year 2001, from the unencumbered bal-
27       ance as of July 1, 2000, in each account of the children's initiatives fund
28       that is established by subsection (a) and into which account moneys are
29       transferred pursuant to this subsection (b) and in each account of the
30       children's initiatives fund that is established by this subsection (b): Pro-
31       vided, That all expenditures from the unencumbered balance of any such
32       account of the children's initiatives fund shall not exceed the amount of
33       the unencumbered balance in such account on July 1, 2000: Provided
34       further, That all expenditures from the unencumbered balance of any
35       such account shall be in addition to any expenditure limitation imposed
36       on the children's initiatives fund for fiscal year 2001.
37        (c) There is appropriated for the above agency from the state institu-
38       tions building fund for the fiscal year or years specified, for the capital
39       improvement project or projects specified as follows:
40       Construction/remodeling of juvenile correctional facilities--SIBF
41       For the fiscal year ending June 30, 2001 $4,500,000
42       Provided, That the juvenile justice authority may make expenditures from
43       the construction/remodeling of juvenile correctional facilities--SIBF ac-

  1       count to renovate or replace existing deficient space in existing facilities,
  2       specifically including space at the Larned juvenile correctional facility and
  3       at the Topeka juvenile correctional facility, and to construct new juvenile
  4       correctional space.
  5        (d) There is appropriated for the above agency from the following spe-
  6       cial revenue fund or funds for the fiscal year or years specified, all moneys
  7       now or hereafter lawfully credited to and available in such fund or funds,
  8       except that expenditures other than refunds authorized by law shall not
  9       exceed the following:
10       Construction/remodeling of juvenile correctional facilities fund
11       For the fiscal year ending June 30, 2001 No limit
12       Provided, That the juvenile justice authority may make expenditures from
13       the construction/remodeling of juvenile correctional facilities fund for
14       capital improvement projects to remodel a living unit at Beloit juvenile
15       correctional facility, construct a medium security juvenile correctional
16       facility at Larned juvenile correctional facility, raze and reconstruct living
17       units at Topeka juvenile correctional facility, and construct new maximum
18       security buildings at Topeka juvenile correctional facility: Provided fur-
19       ther, That the capital improvement project to construct new maximum
20       security buildings at Topeka juvenile correctional facility shall include (1)
21       a secured commons area which shall be constructed on the east end of
22       the campus for institutional services which shall include, but not limited
23       to, food and medical services, and a visitors center, and (2) on the east
24       side of the commons area of the campus, facilities for (A) up to 150
25       maximum security beds, (B) up to 60 beds for system-wide and facility
26       classification and diagnostic purposes, and (C) up to 15 medical beds:
27       And provided further, That one superintendent shall be the chief admin-
28       istrative officer over all existing, renovated, or new buildings and facilities
29       of the Topeka juvenile correctional facility: And provided further, That
30       the capital improvement projects to construct new maximum security
31       buildings at the Topeka juvenile correctional facility, construct a medium
32       security juvenile correctional facility at Larned juvenile correctional fa-
33       cility, raze and reconstruct living units at Topeka juvenile correctional
34       facility, and remodel a living unit at Beloit juvenile correctional facility
35       are hereby approved for the juvenile justice authority for the purposes of
36       subsection (b) of K.S.A. 74-8905 and amendments thereto and the au-
37       thorization of the issuance of bonds by the Kansas development finance
38       authority in accordance with that statute: Provided, however, That total
39       expenditures from this fund for such capital improvement projects shall
40       not exceed $50,000,000, plus all amounts required for cost of bond is-
41       suance, cost of interest on the bonds during the construction of the pro-
42       jects and required reserves for the payment of principal and interest on
43       the bonds: And provided further, That all moneys received from the is-

  1       suance of any such bonds shall be deposited in the state treasury to the
  2       credit of this fund.
  3       Construction of juvenile correctional facilities fund-- VOI/TIS

  5       Provided, That the juvenile justice authority may make expenditures from
  6       the construction of juvenile correctional facilities fund--VOI/TIS to con-

13        (f) On July 1, 2000, the expenditure limitation established by section
14       61(b) of 2000 House Substitute for Senate Bill No. 326 on the warehouse
15       fee fund is hereby increased from $616,480 to $618,169.
16        (g) On July 1, 2000, the director of accounts and reports shall transfer
17       $1,854 from the state water plan fund of the Kansas water office to the
18       water plan special revenue fund of the Kansas department of agriculture.
19        (h) On July 1, 2000, the expenditure limitation established by section
20       61(b) of 2000 House Substitute for Senate Bill No. 326 on expenditures
21       from the water plan special revenue fund for salaries and wages is hereby
22       increased from $577,677 to $579,531.
23        (i) On July 1, 2000, the appropriation of all moneys credited to and
24       available in the Kansas corn commission fund for the fiscal year ending
25       June 30, 2001, by section 61(b) of 2000 House Substitute for Senate Bill
26       No. 326 is hereby lapsed and the Kansas corn commission fund in the
27       state treasury is hereby abolished.
28        (j) On July 1, 2000, the appropriation of all moneys credited to and
29       available in the Kansas grain sorghum commission fund for the fiscal year
30       ending June 30, 2001, by section 61(b) of 2000 House Substitute for
31       Senate Bill No. 326 is hereby lapsed and the Kansas grain sorghum com-
32       mission fund in the state treasury is hereby abolished.
33        (k) On July 1, 2000, the appropriation of all moneys credited to and
34       available in the soybean promotion and research fund for the fiscal year
35       ending June 30, 2001, by section 61(b) of 2000 House Substitute for
36       Senate Bill No. 326 is hereby lapsed and the soybean promotion and
37       research fund in the state treasury is hereby abolished.
38        (l) On July 1, 2000, the director of accounts and reports shall transfer
39       $426,223 from the grain inspection fee fund of the Kansas department
40       of agriculture to the Kansas agricultural remediation board fund of the
41       Kansas department of agriculture.
42        (m) On July 1, 2001, the position limitation established by section 69(a)
43       of 2000 House Substitute for Senate Bill No. 326 for the Kansas depart-

  1       ment of agriculture is hereby decreased from 105.5 to 103.2.
  2        (n) In addition to the other purposes for which expenditures may be
  3       made by the Kansas department of agriculture from moneys appropriated
  4       from the state general fund or from any special revenue fund for the fiscal
  5       year ending June 30, 2001, from which expenditures may be made for
  6       salaries and wages, as authorized by this or other appropriation act of the
  7       2000 regular session of the legislature, expenditures may be made by the
  8       Kansas department of agriculture from such moneys appropriated from
  9       the state general fund or from any special revenue fund for fiscal year
10       2001 for four full-time equivalent positions in the unclassified service
11       under the Kansas civil service act: Provided, That all such additional full-
12       time equivalent positions in the unclassified service under the Kansas civil
13       service act shall be in addition to other positions within the Kansas de-
14       partment of agriculture in the unclassified service as prescribed by law
15       and shall be established by the secretary of agriculture within any position
16       limitation established for the Kansas department of agriculture on the
17       number of full-time and regular part-time positions equated to full-time,
18       excluding seasonal and temporary positions, paid from appropriations for
19       fiscal year 2001 made by this or other appropriation act of the 2000 reg-
20       ular session of the legislature: Provided, however, That the authority to
21       establish such additional positions in the unclassified service shall not
22       affect the classified service status of any person who is an employee of
23       the Kansas department of agriculture and who is in a position in the
24       classified service under the Kansas civil service act on June 30, 2000.
25        Sec. 39.

KANSAS WHEAT COMMISSION
27        (a) Notwithstanding the provisions of any other statute to the contrary,
28       during the fiscal year ending June 30, 2000, the aggregate amount of
29       expenditures from the Kansas wheat commission fund by the Kansas
30       wheat commission for the new market plan for the Kansas wheat com-
31       mission shall not exceed $463,000: Provided, That all expenditures from
32       the Kansas wheat commission fund by the Kansas wheat commission for
33       the new market plan for the Kansas wheat commission shall be within
34       the overall expenditure limitation established for the Kansas wheat com-
35       mission fund for fiscal year 2000: Provided, however, That the expendi-
36       ture limitation established by this subsection on the aggregate amount of
37       expenditures from the Kansas wheat commission fund by the Kansas
38       wheat commission for the new market plan for the Kansas wheat com-
39       mission for fiscal year 2000 shall not be increased except upon specific
40       authorization by act of the legislature and shall not be increased by the
41       state finance council: Provided further, That, on and after the effective
42       date of this act, the provisions of subsection (b) of section 65 of 2000
43       Senate Bill No. 39 are hereby declared to be null and void and of no

  1       force and effect.
  2        (b) On July 1, 2000, the appropriation of all moneys credited to and
  3       available in the Kansas wheat commission fund for the fiscal year ending
  4       June 30, 2001, by section 64(b) of 2000 House Substitute for Senate Bill
  5       No. 326 is hereby lapsed and the Kansas wheat commission fund in the
  6       state treasury is hereby abolished.
  7        (c) On July 1, 2000, the appropriation of all moneys credited to and
  8       available in the wheat research reserve fund for the fiscal year ending

16       which is hereby characterized as a matter of legislative delegation and
17       subject to the guidelines prescribed in subsection (c) of K.S.A. 75-3711c
18       and amendments thereto: Provided further, That the net proceeds from
19       the sale of any of the real estate of the department of human resources
20       shall be deposited in the state treasury to the credit of the property sale
21       account of the employment security administration fund of the depart-
22       ment of human resources: And provided further, That the secretary of
23       human resources, in consultation with the secretary of administration, is
24       hereby authorized to make expenditures for fiscal year 2000 and fiscal

31       the supplemental general state aid account, the sum of $4,052,365 is
32       hereby lapsed.
33        (d) On July 1, 2000, the expenditure limitation established by section
34       35(a) of 2000 House Substitute for Senate Bill No. 326 on expenditures
35       from the reappropriated balance in the KPERS--employer contributions
36       account of the state general fund is hereby increased from $504,371 to
37       $2,092,433.
38        (e) (1) Notwithstanding the provisions of the proviso to the appropri-
39       ation of moneys from the state general fund in the general state aid ac-
40       count that was included in section 35(a) of 2000 House Substitute for
41       Senate Bill No. 326 and that directed any unencumbered balance in the
42       general state aid account shall be transferred to the inservice education
43       aid account of the state general fund of the department of education to

  1       be used to fund approved inservice education programs as authorized by
  2       K.S.A. 72-9601 et seq., and amendments thereto, such unencumbered
  3       balance in the general state aid account shall not be transferred to the
  4       inservice education aid account as prescribed by such proviso and such
  5       proviso is hereby declared to be void and of no force and effect.
  6        (2) Any unencumbered balance in the general state aid account of the
  7       state general fund of the department of education in excess of $100 as of
  8       June 30, 2000, is hereby reappropriated in the general state aid account
  9       of the state general fund of the department of education for fiscal year
10       2001: Provided, That the amount reappropriated from such unencum-
11       bered balance shall not exceed $13,841,896 and any additional remaining
12       amount in such unencumbered balance for general state aid shall not be
13       reappropriated and is hereby lapsed: Provided, however, That expendi-
14       tures from such reappropriated balance shall not exceed $11,841,896 ex-
15       cept upon approval of the state finance council: Provided, further, That
16       any portion of the amount of such reappropriated balance in excess of
17       $11,841,896 shall be transferred to the inservice education aid account
18       of the state general fund of the department of education to be used to
19       fund approved inservice education programs as authorized by K.S.A. 72-
20       9601 et seq., and amendments thereto: And provided further, That the
21       amount transferred to the inservice education aid account from such
22       unencumbered balance under this subsection (e)(2) shall not exceed
23       $2,000,000.
24        (f) (1) On the effective date of this act, the appropriation of all moneys
25       credited to and available in the flexible spending fund--general state aid
26       of the above agency for the fiscal year ending June 30, 2001, by section
27       35(a) of 2000 House Substitute for Senate Bill No. 326 is hereby lapsed.
28      
29        (2) The director of accounts and reports shall not make the transfer on
30       July 1, 2000, or as soon thereafter as moneys are available, of $7,761,000
31       from the flexible spending fund of the department of administration to
32       the flexible spending fund--general state aid of the department of edu-
33       cation pursuant to section 35(e) of 2000 House Substitute for Senate Bill
34       No. 326 and the provisions of section 35(e) of 2000 House Substitute for
35       Senate Bill No. 326 are hereby declared to be void and of no force and
36       effect.

18        (h) On July 1, 2000, or as soon after such date as moneys are available,
19       the director of accounts and reports shall transfer $390,000 from the
20       Kansas economic development endowment account of the state economic
21       development initiatives fund of the department of commerce and housing
22       to the economic development initiatives fund of the department of edu-
23       cation.
24        (i) In addition to the other purposes for which expenditures may be
25       made from the children's initiatives fund for fiscal year 2001, expenditures
26       may be made by the above agency from the children's initiatives fund for
27       fiscal year 2001 for the following specified purposes subject to the ex-
28       penditure limitations prescribed therefor:
29       Children's initiatives fund--grant to the Kansas optometric association for vision study $250,000
30       Provided, That all expenditures by the above agency from the children's

30       program account in the children's initiatives fund established by subsec-
31       tion (i). On July 1, 2000, and after such transfer, (A) all encumbrances
32       and other liabilities of the Kansas endowment for youth fund--parent
33       education program account of the Kansas endowment for youth fund are
34       hereby transferred to and imposed upon the children's initiatives fund--
35       parent education program account in the children's initiatives fund, (B)
36       the Kansas endowment for youth fund--parent education program ac-
37       count of the above agency in the Kansas endowment for youth fund is
38       hereby abolished, and (C) any appropriation of moneys in the Kansas
39       endowment for youth fund--parent education program account of the
40       Kansas endowment for youth fund for the above agency for the fiscal year
41       ending June 30, 2001, by any provision of chapter 132 or chapter 160 of
42       the 1999 Session Laws of Kansas or this or other appropriation act of the

  2        (2) On July 1, 2000, the director of accounts and shall transfer all mon-

24       training and program expenditures account in the children's initiatives
25       fund, which is hereby established. On July 1, 2000, and after such transfer,
26       (A) all encumbrances and other liabilities of the Kansas endowment for
27       youth fund--DARE (Drug Abuse Resistance Education) coordinator,
28       support staff, training and program expenditures account of the Kansas
29       endowment for youth fund are hereby transferred to and imposed upon
30       the children's initiatives fund--DARE (Drug Abuse Resistance Educa-
31       tion) coordinator, support staff, training and program expenditures ac-
32       count in the children's initiatives fund, (B) the Kansas endowment for

21       priated to the operating expenditures (including official hospitality) ac-
22       count for fiscal year 2001.
23       Any unencumbered balance in excess of $100 as of June 30, 2000, in each
24       of the following accounts is hereby reappropriated for FY 2001: Vaccine
25       purchases; infant and toddler program; aid to local units; aid to local
26       units--primary health projects; teen pregnancy prevention activities; im-
27       munization programs.
28        (b) There is appropriated for the above agency from the following spe-
29       cial revenue fund or funds for the fiscal year or years specified, all moneys
30       now or hereafter lawfully credited to and available in such fund or funds,
31       except that expenditures other than refunds authorized by law and trans-
32       fers to other state agencies shall not exceed the following:
33       Sunflower army ammunition plant remediation trust fund
34       For the fiscal year ending June 30, 2001 No limit
35        (c) On July 1, 2000, the expenditure limitation established by section
36       31(b) of 2000 House Substitute for Senate Bill No. 326 on the water plan

38        (d) On July 1, 2000, of the $2,492,000 appropriated for the above
39       agency for the fiscal year ending June 30, 2001, by section 31(a) of 2000
40       House Substitute for Senate Bill No. 326 from the state general fund in
41       the infant and toddler program account, the sum of $500,000 is hereby
42       lapsed.
43        (e) On July 1, 2000, the director of accounts and reports shall transfer

  1       $818 from the state water plan fund of the Kansas water office to the
  2       water plan special revenue fund of the department of health and envi-
  3       ronment.
  4        (f) In addition to the other purposes for which expenditures may be
  5       made by the department of health and environment from the health and
  6       environment publication fee fund for fiscal year 2001, as authorized by
  7       section 31(b) of 2000 House Substitute for Senate Bill No. 326 or other
  8       appropriation act of the 2000 regular session of the legislature, and not-
  9       withstanding the provisions of section 31(b) of 2000 House Substitute for
10       Senate Bill No. 326 or K.S.A. 75-5662 and amendments thereto to the
11       contrary, expenditures may be made by the department of health and
12       environment from the health and environment publication fee fund for
13       fiscal year 2001 for development, publication and distribution of bro-
14       chures containing information about infection control techniques which
15       are appropriate for hair braiding outside the salon setting, as prescribed
16       by section 2 of 2000 Senate Bill No. 513: Provided, That all moneys
17       received for fees charged and collected under section 2 of 2000 Senate
18       Bill No. 513 shall be deposited in the state treasury to the credit of the
19       health and environment publication fee fund.
20        (g) On July 1, 2000, the position limitation established by section 69(a)
21       of 2000 House Substitute for Senate Bill No. 326 on the department of
22       health and environment is hereby decreased from 842.5 to 839.5.
23        (h) In addition to the other purposes for which expenditures may be
24       made from the children's initiatives fund for fiscal year 2001, expenditures
25       may be made by the above agency from the children's health care pro-
26       grams fund for fiscal year 2001 for the following specified purposes sub-
27       ject to the expenditure limitations prescribed therefor:
28       Children's initiatives fund--healthy start $250,000
29       Provided, That all expenditures by the above agency from the children's
30       initiatives fund for fiscal year 2001 from the children's initiatives fund--
31       healthy start account shall be in addition to any expenditure limitation
32       imposed on the children's initiatives fund for fiscal year 2001.
33       Children's initiatives fund--infants and toddlersprogram $500,000
34       Provided, That all expenditures by the above agency from the children's
35       initiatives fund for fiscal year 2001 from the children's initiatives fund--
36       infants and toddlers program account shall be in addition to any expend-
37       iture limitation imposed on the children's initiatives fund for fiscal year
38       2001.
39        (i) (1) On July 1, 2000, the director of accounts and reports shall trans-
40       fer all moneys credited as of June 30, 2000, in the Kansas endowment for
41       youth fund--healthy start account of the Kansas endowment for youth
42       fund to the children's initiatives fund--healthy start program account in

  1       the children's initiatives fund established by subsection (h). On July 1,
  2       2000, and after such transfer, (A) all encumbrances and other liabilities
  3       of the Kansas endowment for youth fund--healthy start account of the
  4       Kansas endowment for youth fund are hereby transferred to and imposed
  5       upon the children's initiatives fund--healthy start account in the chil-
  6       dren's initiatives fund, (B) the Kansas endowment for youth fund--
  7       healthy start account of the above agency in the Kansas endowment for
  8       youth fund is hereby abolished, and (C) any appropriation of moneys in
  9       the Kansas endowment for youth fund--healthy start account of the Kan-
10       sas endowment for youth fund for the above agency for the fiscal year
11       ending June 30, 2001, by any provision of chapter 132 or chapter 160 of
12       the 1999 Session Laws of Kansas or this or other appropriation act of the
13       2000 regular session of the legislature, is hereby lapsed.
14        (2) On July 1, 2000, the director of accounts and reports shall transfer
15       all moneys credited as of June 30, 2000, in the Kansas endowment for
16       youth fund--infants and toddlers program account of the Kansas endow-
17       ment for youth fund to the children's initiatives fund--infants and tod-
18       dlers program account in the children's initiatives fund established by
19       subsection (h). On July 1, 2000, and after such transfer, (A) all encum-

22       fund are hereby transferred to and imposed upon the children's initiatives
23       fund--infants and toddlers program account in the children's initiatives

26       fund is hereby abolished, and (C) any appropriation of moneys in the
27       Kansas endowment for youth fund--infants and toddlers program ac-
28       count of the Kansas endowment for youth fund for the above agency for
29       the fiscal year ending June 30, 2001, by any provision of chapter 132 or
30       chapter 160 of the 1999 Session Laws of Kansas or this or other appro-
31       priation act of the 2000 regular session of the legislature, is hereby lapsed.
32        (3) On July 1, 2000, the director of accounts and reports shall transfer
33       all moneys credited as of June 30, 2000, in the Kansas endowment for
34       youth fund--neonatal screening account of the Kansas endowment for
35       youth fund to the children's initiatives fund--neonatal screening account
36       in the children's initiatives fund, which is hereby established. On July 1,
37       2000, and after such transfer, (A) all encumbrances and other liabilities
38       of the Kansas endowment for youth fund--neonatal screening account of

28       islature, expenditures may be made by the above agency from the chil-
29       dren's initiatives fund for fiscal year 2001, from the unencumbered bal-
30       ance as of July 1, 2000, in each account of the children's initiatives fund
31       that is established by subsection (h) and into which moneys are trans-
32       ferred pursuant to this subsection (i) and in each account of the children's
33       initiatives fund that is established by this subsection (i): Provided, That
34       all expenditures from the unencumbered balance of any such account of
35       the children's initiatives fund shall not exceed the amount of the unen-
36       cumbered balance in such account on July 1, 2000: Provided further, That
37       all expenditures from the unencumbered balance of any such account
38       shall be in addition to any expenditure limitation imposed on the chil-

34       itures may be made by the above agency from the state of Kansas--
35       department of corrections inmate benefit fund for operating the thera-
36       peutic community program at Lansing correctional facility: Provided,
37       That expenditures for such purposes from the state of Kansas--depart-
38       ment of corrections inmate benefit fund for fiscal year 2001 shall not
39       exceed $495,000: Provided further, That all such expenditures for such
40       purposes from the state of Kansas--department of corrections inmate
41       benefits fund for fiscal year 2001 shall be made from the projected ending
42       cash balance in the state of Kansas--department of corrections inmate

  1       benefit fund as of June 30, 2000, and shall not result in any reduction of
  2       funding from the state of Kansas--department of corrections inmate ben-
  3       efit fund for other projects within the approved budget of expenditures
  4       from such fund as authorized by section 51(b) of 2000 House Substitute
  5       for Senate Bill No. 326.
  6        (h) On the effective date of this act, the amounts specified in section
  7       73 (c) of chapter 132 of the 1999 Session Laws of Kansas as being included
  8       in the facilities operations account of the state general fund for the fol-
  9       lowing correctional facilities for the fiscal year ending June 30, 2000, are
10       hereby changed to the amounts specified, but expenditures from the fa-
11       cilities operations account of the state general fund for such correctional
12       facilities shall not be limited to, or be required to be made in, the amounts
13       listed for the correctional facilities, as follows: (1) The amount for Larned
14       correctional mental health facility is hereby increased from $6,875,937 to
15       $6,877,925; (2) the amount for Hutchinson correctional facility is hereby
16       decreased from $22,487,669 to $22,476,313; and (3) the amount for To-
17       peka correctional facility is hereby increased from $13,198,883 to
18       $13,189,787.
19        (i) On the effective date of this act, of the $12,361,004 appropriated
20       for the above agency for the fiscal year ending June 30, 2000, by 73(a) of
21       chapter 132 of the 1999 Session Laws of Kansas from the state general
22       fund in the central administration operations and parole and post-release
23       supervision operations account, the sum of $4,037 is hereby lapsed.
24        (j) In addition to the other purposes for which expenditures may be
25       made by the department of corrections from the local jail payments ac-
26       count of the state general fund for fiscal year 2001 as authorized by sec-
27       tion 51(a) of 2000 House Substitute for Senate Bill No. 326, expenditures
28       may be made by the department of corrections from the local jail pay-
29       ments account of the state general fund for fiscal year 2001 for reim-
30       bursement costs incurred during fiscal year 2000.
31        (k) On July 1, 2001, the position limitation established by section 69(a)
32       of 2000 House Substitute for Senate Bill No. 326 for the above agency is

  5       director of accounts and reports shall transfer $250,000 from the Kansas
  6       economic development endowment account of the state economic de-
  7       velopment initiatives fund of the department of commerce and housing
  8       to the EDIF--local government outdoor recreation grants fund of the
  9       department of wildlife and parks.
10        (e) On July 1, 2000, the expenditure limitation established by section
11       67(b) of 2000 House Substitute for Senate Bill No. 326, on the parks fee
12       fund is hereby increased from $4,460,870 to $4,468,010.
13        Sec. 69.

OMBUDSMAN OF CORRECTIONS
15        (a) There is appropriated for the above agency from the state general
16       fund for the fiscal year or years specified, the following:
17       Adult corrections oversight
18       For the fiscal year ending June 30, 2001 $500
19        Sec. 70. (a) In addition to the other purposes for which expenditures
20       may be made by each state agency named in this act from the moneys
21       appropriated from the state general fund or from any special revenue
22       fund for fiscal year 2001 as authorized by this or other appropriation act
23       of the 2000 regular session of the legislature, expenditures shall be made
24       by each state agency named in this act from the moneys appropriated
25       from the state general fund or from any special revenue funds for fiscal
26       year 2001, to prepare a report identifying in detail all funding that will
27       be requested by such agency from the state general fund or any special
28       revenue funds for any and all substance abuse treatment, prevention or
29       education programs, including the administration of such programs, for
30       the fiscal year ending June 30, 2002: Provided, That each such agency
31       shall submit such report to the Kansas center for prevention leadership
32       of the governor's department on or before September 15, 2000: Provided
33       further, That each such agency shall submit a copy of such report to the
34       division of the budget and to the legislative research department at the
35       same time it is submitted to the Kansas center for prevention leadership
36       of the governor's department.
37        (b) On July 1, 2000, the provisions of section 71 of 2000 House Sub-
38       stitute for Senate Bill No. 326 are hereby declared to be null and void
39       and shall be of no force and effect.
40        Sec. 71. On July 1, 2000, K.S.A. 1999 Supp. 79-34,147, as amended by
41       section 106 of 2000 House Substitute for Senate Bill No. 326, is hereby
42       amended to read as follows: 79-34,147. (a) (1) On July 1, 1999, and quar-
43       terly thereafter the secretary of revenue shall certify to the director of

  1       accounts and reports the amount equal to 7.628% of the total revenues
  2       received by the secretary from the taxes imposed under the Kansas re-
  3       tailers' sales tax act and deposited in the state treasury and credited to
  4       the state general fund during the preceding three calendar months.
  5        (2) On July 1, 2001, and quarterly thereafter, the secretary of revenue
  6       shall certify to the director of accounts and reports the amount equal to
  7       9.5% of the total revenues received by the secretary from the taxes im-
  8       posed under the Kansas retailers' sales tax act and deposited in the state
  9       treasury and credited to the state general fund during the preceding three
10       calendar months.
11        (3) On July 1, 2002, and quarterly thereafter, the secretary of revenue
12       shall certify to the director of accounts and reports the amount equal to
13       11% of the total revenues received by the secretary from the taxes im-
14       posed under the Kansas retailers' sales tax act and deposited in the state
15       treasury and credited to the state general fund during the preceding three
16       calendar months.
17        (4) On July 1, 2003, and quarterly thereafter, the secretary of revenue
18       shall certify to the director of accounts and reports the amount equal to
19       11.25% of the total revenues received by the secretary from the taxes
20       imposed under the Kansas retailers' sales tax act and deposited in the
21       state treasury and credited to the state general fund during the preceding
22       three calendar months.
23        (5) On July 1, 2004, and quarterly thereafter, the secretary of revenue
24       shall certify to the director of accounts and reports the amount equal to
25       12% of the total revenues received by the secretary from the taxes im-
26       posed under the Kansas retailers' sales tax act and deposited in the state
27       treasury and credited to the state general fund during the preceding three
28       calendar months.
29        (b) Upon receipt of each certification under subsection (a), the director
30       of accounts and reports shall transfer from the state general fund to the
31       state highway fund an amount equal to the amount so certified, on each
32       July 1, October 1, January 1 and April 1, except that (1)(A) the amount
33       of the transfer on each such date during state fiscal year 2000 shall not
34       exceed the amount equal to 101.7% of the amount of the transfer on each
35       such date during state fiscal year 1999 and (B) the aggregate amount of
36       all such transfers during state fiscal year 2000 shall not exceed
37       $62,240,428; and (2) the amount of the transfer on each such date during
38       state fiscal year 2001 shall not exceed $12,829,480.50 $12,927,149.75. All
39       transfers made pursuant to this section are subject to reduction under
40       K.S.A. 75-6704, and amendments thereto.
41        (c) All transfers made in accordance with the provisions of this section
42       shall be considered to be demand transfers from the state general fund.
43        Sec. 72. On July 1, 2000, K.S.A. 1999 Supp. 79-34,147, as amended by

  1       section 106 of 2000 House Substitute for Senate Bill No. 326, is hereby
  2       repealed.
  3        Sec. 73. Appeals to exceed position limitations. (a) The limitations im-
  4       posed by this act on the number of full-time and regular part-time posi-
  5       tions equated to full-time, excluding seasonal and temporary positions,
  6       paid from appropriations for the fiscal year ending June 30, 2000, made
  7       in chapter 132 or 160 of the 1999 Session Laws of Kansas or in or in any
  8       other appropriation act of the 2000 regular session of the legislature may
  9       be exceeded upon approval of the state finance council.
10        (b) The limitations imposed by this act on the number of full-time and
11       regular part-time positions equated to full-time, excluding seasonal and
12       temporary positions, paid from appropriations for the fiscal year ending
13       June 30, 2001, made in chapter 132 or 160 of the 1999 Session Laws of
14       Kansas or in this or in any other appropriation act of the 2000 regular
15       session of the legislature may be exceeded upon approval of the state
16       finance council.
17        Sec. 74. Appeals to exceed expenditure limitations. Upon written ap-
18       plication to the governor and approval of the state finance council, ex-
19       penditures from special revenue funds may exceed the amounts specified
20       in this act.
21        Sec. 75. Savings. (a) Any unencumbered balance as of June 30, 2000,
22       in any special revenue fund, or account thereof, of any state agency named
23       in this act which is not otherwise specifically appropriated or limited by
24       this or other appropriation act of the 2000 regular session of the legisla-
25       ture, is hereby appropriated for the fiscal year ending June 30, 2001, for
26       the same use and purpose as the same was heretofore appropriated.
27        (b) Any unencumbered balance in any special revenue fund, or account
28       thereof, of any state agency named in section 22 of chapter 132 of the
29       1999 Session Laws of Kansas which is not otherwise specifically appro-
30       priated or limited for fiscal year 2001 by this or other appropriation act
31       of the 1999 or 2000 regular session of the legislature, is hereby appro-
32       priated for fiscal year 2001 for the same use and purpose as the same was
33       heretofore appropriated.
34        Sec. 76. Federal grants. (a) Each federal grant or other federal receipt
35       which is received by a state agency named in this act and which is not
36       otherwise appropriated to that state agency by this or other appropriation
37       act of the 2000 regular session of the legislature, is hereby appropriated
38       for the fiscal year ending June 30, 2001, for that state agency for the
39       purpose set forth in such federal grant or receipt, except that no expend-
40       iture shall be made from and no obligation shall be incurred against any
41       such federal grant or other federal receipt, which has not been previously
42       appropriated or reappropriated or approved for expenditure by the gov-
43       ernor for fiscal year 2001, until the governor has authorized the state

  1       agency to make expenditures from such federal grant or other federal
  2       receipt for fiscal year 2001.
  3        (b) Each federal grant or other federal receipt which is received by a
  4       state agency named in section 22 of chapter 132 of the 1999 Session Laws
  5       of Kansas and which is not otherwise appropriated to that state agency
  6       for fiscal year 2001 by this or other appropriation act of the 1999 or 2000
  7       regular session of the legislature, is hereby appropriated for fiscal year
  8       2001 for that state agency for the purpose set forth in such federal grant
  9       or receipt, except that no expenditure shall be made from and no obli-
10       gation shall be incurred against any such federal grant or other federal
11       receipt, which has not been previously appropriated or reappropriated or
12       approved for expenditure by the governor for fiscal year 2001, until the
13       governor has authorized the state agency to make expenditures from such
14       federal grant or other federal receipt for fiscal year 2001.
15        Sec. 77. Any transfers of money during the fiscal year ending June 30,
16       2001, from any special revenue fund of any state agency named in this
17       act to the audit services fund of the division of post audit under K.S.A.
18       46-1121 and amendments thereto shall be in addition to any expenditure
19       limitation imposed on any such fund for the fiscal year ending June 30,
20       2001.
21        Sec. 78. Any correctional institutions building fund appropriation here-
22       tofore appropriated to any state agency named in this or other appropri-
23       ation act of the 2000 regular session of the legislature, and having an
24       unencumbered balance as of June 30, 2000, in excess of $100 is hereby
25       reappropriated for the fiscal year ending June 30, 2001, for the same uses
26       and purposes as originally appropriated unless specific provision is made
27       for lapsing such appropriation.
28        Sec. 79. Any Kansas educational building fund appropriation heretofore
29       appropriated to any institution named in this or other appropriation act
30       of the 2000 regular session of the legislature and having an unencumbered
31       balance as of June 30, 2000, in excess of $100 is hereby reappropriated
32       for the fiscal year ending June 30, 2001, for the same use and purpose as
33       originally appropriated, unless specific provision is made for lapsing such
34       appropriation.
35        Sec. 80. Any state institutions building fund appropriation heretofore
36       appropriated to any state agency named in this or other appropriation act
37       of the 2000 regular session of the legislature and having an unencumbered
38       balance as of June 30, 2000, in excess of $100 is hereby reappropriated
39       for the fiscal year ending June 30, 2001, for the same use and purpose as
40       originally appropriated, unless specific provision is made for lapsing such
41       appropriation.
42        Sec. 81. This act shall take effect and be in force from and after its
43       publication in the Kansas register.
