10 AN ACT relating
to consumer protection; prohibiting certain acts.

12 Be it enacted by the Legislature of the
State of Kansas:
13 Section
1. (a) No supplier shall obtain or submit for payment,
other
14 than for the continuation of existing and
recurrent services, a check, draft
15 or other form of negotiable instrument or
payment order drawn on a
16 person's checking, savings, share or
similar account without the con-
17 sumer's express written authorization.
18 (b) Express
written authorization by a consumer includes:
19 (1) The
consumer's signature on a check, draft or other form of ne-
20 gotiable instrument or payment order;
or
21 (2) the
consumer's signature on a separate written agreement au-
22 thorizing single or periodic payments by
check, draft or other form of
23 negotiable instrument or payment order.
24 (c) Nothing in
this section shall prohibit a consumer from personally
25 directing the consumer's financial
institution to make payment from the
26 consumer's checking, savings, share or
similar account via electronic or
27 telephonic means in accordance with
procedures set by the consumer's
28 financial institution, nor shall this
section affect the right of a consumer
29 to transfer funds from one account to
another.
30 (d) A violation
of subsection (a) is an unconscionable act within the
31 meaning of K.S.A. 50-627, and amendments
thereto.
32 (e) This section
shall be part of and supplemental to the Kansas con-
33 sumer protection act.
34 Sec. 2. This act shall
take effect and be in force from and after its
35 publication in the statute book.
