10 AN ACT
concerning retirement and pensions; relating to the Kansas
11 public employees
retirement system; normal retirement date; amend-
12 ing K.S.A. 1999 Supp.
74-4914 and repealing the existing section.

14 Be it enacted by the Legislature of the
State of Kansas:
15 Section
1. K.S.A. 1999 Supp. 74-4914 is hereby amended to read as
16 follows: 74-4914. (1) Except as
otherwise provided, the normal retirement
17 date for a member of the system shall be
the first day of the month
18 coinciding with or following termination of
employment with any partic-
19 ipating employer not followed by employment
with any participating em-
20 ployer within 30 days and the attainment of
age 65 or, commencing July
21 1, 1993, age 62 with the completion of 10
years of credited service or the
22 first day of the month coinciding with or
following the date that the total
23 of the number of years of credited service
and the number of years of
24 attained age of the member is equal to or
more than 85. The normal
25 retirement date for a member of the
system who is a fireman or policeman,
26 as defined in subsections (11) and (12)
of K.S.A. 74-4952 or an emergency
27 medical service technician as defined in
K.S.A. 74-4954a, and amend-
28 ments thereto, shall be the first day of
the month coinciding with or fol-
29 lowing termination of employment with
any participating employer not
30 followed by employment with any
participating employer within 30 days
31 and the attainment of age 65 or, age 62
with the completion of 10 yeas of
32 credited service or the first day of the
month coinciding with or following
33 the date that the total of the number of
years of credited service and the
34 number of years of attained age of such
member is equal to or more than
35 75. In no event shall a normal
retirement date for a member be before
36 six months after the entry date of the
participating employer by whom
37 such member is employed. A member may
retire on the normal retire-
38 ment date or on the first day of any month
thereafter upon the filing with
39 the office of the retirement system of an
application in such form and
40 manner as the board shall prescribe.
Nothing herein shall prevent any
41 person, member or retirant from being
employed, appointed or elected
42 as an employee, appointee, officer or
member of the legislature. Elected
43 officers may retire from the system on any
date on or after the attainment

1 of the normal retirement date, but no
retirement benefits payable under
2 this act shall be paid until the
member has terminated such member's
3 office.
4 (2) No
retirant shall make contributions to the system or receive
serv-
5 ice credit for any service after the
date of retirement.
6 (3) Any
member who is an employee of an affiliating employer pur-
7 suant to K.S.A. 74-4954b and
amendments thereto and has not withdrawn
8 such member's accumulated
contributions from the Kansas police and
9 firemen's retirement system may
retire before such member's normal
10 retirement date on the first day of any
month coinciding with or following
11 the attainment of age 55.
12 (4) Any member
may retire before such member's normal retirement
13 date on the first day of any month
coinciding with or following termination
14 of employment with any participating
employer not followed by employ-
15 ment with any participating employer within
30 days and the attainment
16 of age 55 with the completion of 10 years
of credited service, but in no
17 event before six months after the entry
date, upon the filing with the
18 office of the retirement system of an
application for retirement in such
19 form and manner as the board shall
prescribe.
20 (5) If a retirant
who retired on or after July 1, 1988, is employed or
21 appointed in or to any position or office
for which compensation for serv-
22 ice is paid in an amount equal to $15,000
or more in any one such calendar
23 year, by any participating employer for
which such retirant was employed
24 or appointed during the final two years of
such retirant's participation,
25 such retirant shall not receive any
retirement benefit for any month for
26 which such retirant serves in such position
or office. The participating
27 employer shall report to the system within
30 days of when the compen-
28 sation paid to the retirant is equal to or
exceeds any limitation provided
29 by this section. Any retirant employed by a
participating employer shall
30 not make contributions nor receive
additional credit under such system
31 for such service except as provided by this
section. Upon request of the
32 executive secretary of the system, the
secretary of revenue shall provide
33 such information as may be needed by the
executive secretary to carry
34 out the provisions of this act. The
provisions of this subsection shall not
35 apply to retirants employed as substitute
teachers or officers, employees,
36 appointees or members of the legislature or
any other elected officials.
37 (6) For purposes
of this section, any employee of a local governmental
38 unit which has its own pension plan who
becomes an employee of a
39 participating employer as a result of a
merger or consolidation of services
40 provided by local governmental units, which
occurred on January 1, 1994,
41 may count service with such local
governmental unit in determining
42 whether such employee has met the years of
credited service require-
43 ments contained in this section.

74-4914 is hereby repealed.
2 Sec. 3. This act
shall take effect and be in force from and after its
3 publication in the statute book.
