9 AN ACT
concerning emergency telephone taxes; relating to use of pro-
10 ceeds; amending K.S.A.
1999 Supp. 12-5304 and repealing the existing
11 section.

13 Be it enacted by the Legislature of the
State of Kansas:
14 Section
1. K.S.A. 1999 Supp. 12-5304 is hereby amended to read as
15 follows: 12-5304. (a) Any governing body
imposing the tax authorized by
16 K.S.A. 12-5302, and amendments thereto, may
contract directly with the
17 provider of the emergency telephone service
or may contract and coop-
18 erate with any public agency or with other
states or their political sub-
19 divisions or with any association or
corporation for their political subdi-
20 visions or with any association or
corporation for the administration of
21 emergency telephone service as provided by
law.
22 (b) Funds
collected from tax imposed pursuant to K.S.A. 12-5302,
23 and amendments thereto, shall be spent
solely to pay for any or all of the
24 following: (1) The monthly
recurring charges billed by the service supplier
25 for the emergency telephone
service; (2) initial installation, service estab-
26 lishment; nonrecurring start-up
charges billed by the service supplier for
27 the emergency telephone service;
(3) charges for capital improvements
28 and equipment or other physical
enhancements to the emergency tele-
29 phone system; or (4)
Costs of installation and establishment of emergency
30 telephone service, including
nonrecurring charges for such service, billed
31 by the service supplier; (2) recurring
periodic charges for emergency tel-
32 ephone service, billed by the service
supplier; (3) costs of capital improve-
33 ments, equipment and enhancements that
are part of or necessary to pro-
34 vision of emergency telephone service;
(4) costs of training personnel
35 engaged in providing emergency telephone
service, including training re-
36 lated to serving persons who have
hearing impairments; or (5) the ac-
37 quisition and installation of road signs
designed to aid in the delivery of
38 emergency service.
39 (c) Funds
collected from tax imposed pursuant to K.S.A. 12-5302, and
40 amendments thereto, shall not be spent
for any of the following: (1) Ex-
41 penses of designing, constructing,
remodeling, renovating or furnishing
42 any building; (2) salaries, benefits or
other costs of hiring personnel; (3)
43 costs of hiring consultants; or (4)
general operating costs, including office

1 supplies.
2 Sec. 2. K.S.A. 1999 Supp.
12-5304 is hereby repealed.
3 Sec. 3. This act
shall take effect and be in force from and after its
4 publication in the statute book.
