9 AN ACT
concerning certain animals; penalties for inflicting harm or
10 death; amending K.S.A.
1999 Supp. 21-4318 and repealing the existing
11 section.

13 Be it enacted by the Legislature of the
State of Kansas:
14 Section
1. K.S.A. 1999 Supp. 21-4318 is hereby amended to read as
15 follows: 21-4318. (a) Inflicting harm,
disability or death to a police or
16 arson, arson or search
and rescue dog is knowingly and intentionally, and
17 without lawful cause or justification
poisoning, inflicting great bodily
18 harm, permanent disability or death, upon a
police or arson, arson or
19 search and rescue dog.
20 (b) As used in
this section:
21 (1) "Arson dog"
means any dog which is owned, or the service of
22 which is employed, by the state fire
marshal or a fire department for the
23 principal purpose of aiding in the
detection of liquid accelerants in the
24 investigation of fires.
25 (2) "Fire
department" means a public fire department under the con-
26 trol of the governing body of a city,
township, county, fire district or
27 benefit district or a private fire
department operated by a nonprofit cor-
28 poration providing fire protection services
for a city, township, county,
29 fire district or benefit district under
contract with the governing body of
30 the city, township, county or district.
31 (3) "Police dog"
means any dog which is owned, or the service of
32 which is employed, by a law enforcement
agency for the principal purpose
33 of aiding in the detection of criminal
activity, enforcement of laws or
34 apprehension of offenders.
35 (4) "Search
and rescue dog" means any dog which is owned, or the
36 service of which is employed, by a law
enforcement or emergency response
37 agency for the purpose of aiding in the
location of persons missing in
38 disasters or other times of
need.
39 (c) Inflicting
harm, disability or death to a police or arson,
arson or
40 search and rescue dog is a class A
nonperson misdemeanor.
41 (d) This section
shall be part of and supplemental to the Kansas crim-
42 inal code.
43 Sec. 2. K.S.A. 1999 Supp.
21-4318 is hereby repealed.

1 Sec. 3. This act
shall take effect and be in force from and after its
2 publication in the statute book.
