  9             AN  ACT defining and classifying the crime of use of communication
10             facilities for harassment; amending K.S.A. 21-4113 and repealing the
11             existing section.

13       Be it enacted by the Legislature of the State of Kansas:
14             Section  1. K.S.A. 21-4113 is hereby amended to read as follows: 21-
15       4113. (a) Harassment by telephone is use of telephone communication
16       Use of communication facilities for harassment is use of any communi-
17       cation facility for any of the following purposes:
18             (1) Making or transmitting any comment, request, suggestion or pro-
19       posal which is obscene, lewd, lascivious, filthy or indecent;
20             (2) making a telephone call, whether or not conversation ensues, or
21       transmitting a telefacsimile communication committing any of the follow-
22       ing acts with intent to abuse, threaten or harass any person at the called
23       number: (A) Making a telephone call, whether or not conversation ensues;
24       (B) transmitting a telefacsimile communication; or (C) transmitting elec-
25       tronic mail;
26             (3) making or causing the telephone of another repeatedly to ring,
27       with intent to harass any person at the called number;
28             (4) committing any of the following acts solely to harass any person:
29       (A) Making repeated telephone calls, during which conversation ensues,
30       or; (B) repeatedly transmitting a telefacsimile communication solely to
31       harass any person at the called number; or (C) repeatedly transmitting
32       electronic mail;
33             (5) playing any recording on a telephone, except recordings such as
34       weather information or sports information when the number thereof is
35       dialed, unless the person or group playing the recording shall be identified
36       and state that it is a recording; or
37             (6) knowingly permitting any telephone or, telefacsimile communi-
38       cation machine, computer or electronic terminal under one's control to
39       be used for any of the purposes mentioned herein.
40             (b) Every telephone directory published for distribution to members
41       of the general public shall contain a notice setting forth a summary of the
42       provisions of this section. Such notice shall be printed in type which is
43       no smaller than any other type on the same page and shall be preceded

  1       by the word "WARNING."
  2             (c) Harassment by telephone Use of communication facilities for ha-
  3       rassment is a class A nonperson misdemeanor.
  4             (d) As used in this section,:
  5             (1) "Communications facility" means any instrument, apparatus,
  6       method, system or equipment used for transmission of messages, signals,
  7       facsimiles or other communications between physically separated persons.
  8       "Communications facility" includes, but is not limited to, facilities for
  9       transmission by means of telephone, telegraph, cable, wire or projection
10       of energy without physical connection.
11             (2) "Electronic mail" means an electronic message that is transmitted
12       between two or more computers or electronic terminals.
13             (3) "Telefacsimile communication" means a communication using
14       electronic equipment to send or transmit a copy of a document via tele-
15       communications facilities.
16             (4) "Telephone communication" shall include telefacsimile commu-
17       nication which is the use of electronic equipment to send or transmit a
18       copy of a document via telephone lines. 
19       Sec.  2. K.S.A. 21-4113 is hereby repealed.
20        Sec.  3. This act shall take effect and be in force from and after its
21       publication in the statute book.
