9 AN ACT
concerning certification of persons who measure bone mass.

11 Be it enacted by the Legislature of the
State of Kansas:
12 Section
1. For the purposes of this act:
13 (a) "Bone density
test" means any medically accepted measurement
14 of bone mass or bone mineral density used
to detect low bone mass and
15 to determine an individual's risk for
osteoporosis. Bone density test in-
16 cludes the use of any technology,
including, but not limited to, bone
17 densitometers.
18 (b) "Bone
densitometer" means any device or technology which is
19 fixed, mobile or portable, and uses
radio-isotopes, X-rays or ultrasound
20 to measure bone mass.
21 (c) "ISCD" means
the international society for clinical densitometry.
22 (d) "Licensed"
and "licensee" shall have the meaning ascribed to it
23 in K.S.A. 65-2802 and amendments
thereto.
24 Sec. 2. (a)
No person, other than a person who is currently certified
25 by ISCD, shall perform any diagnostic test
or other procedure involving
26 bone density testing or the use of a bone
density densitometer on another
27 human being for diagnostic or therapeutic
purposes.
28 (b) Any person
violating any provision of this act shall be guilty of a
29 class A misdemeanor.
30 (c) Any licensed
person or licensee who violated this act is guilty of
31 unprofessional conduct as defined in K.S.A.
65-2837 and amendments
32 thereto.
33 Sec. 3. This act shall
take effect and be in force from and after its
34 publication in the statute book.
