12             AN  ACT concerning public lands; relating to grants of easements there
13             through; amending K.S.A. 75-2131 and repealing the existing section.

15       Be it enacted by the Legislature of the State of Kansas:
16             Section  1. K.S.A. 75-2131 is hereby amended to read as follows: 75-
17       2131. (a) Any agency head, as defined in K.S.A 75-3208, and amendments
18       thereto, or the governing body of any state board or agency having custody
19       and control of any land belonging to the state of Kansas, with or without
20       receiving consideration therefor, may grant or convey right-of-way ease-
21       ments across, over, upon or under any such state land to any municipal
22       corporation, quasi-municipal corporation, the secretary of transportation
23       or to any person, firm or corporation owning or operating any public
24       utility. No agency head shall grant any easement or right-of-way of more
25       than ten miles without first submitting notification to [the state finance
26       council,] the secretary of administration, the chief information architect,
27       the secretary of education technology architect and the joint committee
28       on information technology [and receiving the state finance council's
29       approval of the grant or conveyance]. Such easements may include
30       rights for municipal parking, playground or other municipal uses and
31       rights of ingress or egress for the purpose of constructing, maintaining or
32       removing any pipeline, power line, sewer or other public utility installa-
33       tion or any equipment or appurtenances necessary to the operation
34       thereof. Any such easement, before becoming operative, shall be sub-
35       mitted to the attorney general for approval as to form.
36        (b) Unless otherwise specifically provided by statute, any con-
37       sideration received for the grant of an easement across, over, upon
38       or under any state land shall be for the benefit and use of the state
39       of Kansas as a whole.
40        Sec.  2. K.S.A. 75-2131 is hereby repealed.
41        Sec.  3. This act shall take effect and be in force from and after its
42       publication in the statute book Kansas register.
