10 AN ACT relating
to property taxation; requiring certain actions relating
11 to the levying
thereof; amending K.S.A. 1999 Supp. 79-2925b and re-
12 pealing the existing
section.

14 Be it enacted by the Legislature of the
State of Kansas:
15 Section
1. K.S.A. 1999 Supp. 79-2925b is hereby amended to read
16 as follows: 79-2925b. (a) Without adoption
of a charter resolution or char-
17 ter ordinance so providing, the
governing body of any taxing subdivision
18 shall not approve any appropriation or
budget, as the case requires, which
19 may be funded by revenue produced from
property taxes, and which
20 provides for funding with such revenue in
an amount exceeding the prod-
21 uct of that of the next preceding
year, except with regard to revenue
22 multiplied by a fraction the numerator
of which is the average consumer
23 price index for all urban consumers
published by the federal department
24 of labor as of the close of the 12-month
period ending on August 31 of
25 the first calendar year preceding the
appropriate budget year and the
26 denominator of which is such index as of
such period ending on August
27 31 of the second calendar year preceding
the appropriate budget year.
28 Revenue produced and attributable to
the taxation of the following shall
29 not be considered in determining such
amount: (1) New improvements
30 to real property;
31 (2) increased
personal property valuation, other than increased val-
32 uation of oil and gas leaseholds and mobile
homes;
33 (3) property
located within added jurisdictional territory; and
34 (4) property
which has changed in use.
35 (b) The
provisions of this section shall be applicable to all fiscal
and
36 budget years commencing on and after the
effective date of this act.
37 (c) The
provisions of this section shall not apply to community
col-
38 leges or unified school
districts.
39 (d) The
provisions of this section shall not apply to revenue
received
40 from property tax levied:
41 (1) Pursuant
to the provisions of K.S.A. 1999 Supp. 72-6431, and
42 amendments thereto, and K.S.A. 1999
Supp. 72-6433, and amendments
43 thereto; and (2) for the sole
purpose of repayment of the principal of and

1 interest upon bonded indebtedness,
temporary notes and no-fund
2 warrants.
3 Sec. 2. K.S.A. 1999 Supp.
79-2925b is hereby repealed.
4 Sec. 3. This act
shall take effect and be in force from and after its
5 publication in the statute book.
